  2. ACCEPT the petitioner's offer to dedicate the easement for street and sidewalk purposes on the southeasterly sideline of Hill Street and the southwesterly sideline of 1st Street and the northwesterly line of Broadway (Right of Way No. 36000-2077), as depicted on the Exhibit Map in the September 14, 2015 City Engineer report to Council.

  3. AUTHORIZE the Board of Public Works to acquire the easement for street and sidewalk purposes on the southeasterly sideline of Hill Street and the southwesterly sideline of 1st Street and the northwesterly line of Broadway (Right of Way No. 36000-2077), as depicted on the Exhibit Map in the September 14, 2015  City Engineer report to Council.

  4. INSTRUCT the City Clerk to forward a copy of the Council action on this project to the Real Estate Division of the Bureau of Engineering for processing.

Fiscal Impact Statement:  The City Engineer reports that a $3,884.10 fee for processing this report was paid pursuant to Sections 7.3 and 7.41.1 of the Los Angeles Administrative Code. No additional City funds are needed.

Fiscal Impact Statement:  The CAO reports that authorization of the $23.92 million in MICLA funding requested in this action will have an impact on the General Fund.

 

Debt Impact Statement:  The CAO reports that the issuance of MICLA lease revenue bonds is a General Fund obligation. The proposed project cost of $23.92 million will result in an estimated total debt service of $37.71 million, which includes the borrowing amount and interest ($13.83 million). During the life of the bonds, the estimated average annual debt service is $1.88 million over 20 years. Actual interest rates may differ, as rates are dependent on market conditions at the time of issuance. The  CAO advises that it cannot fully predict what interest rates will be in the future.

 

In accordance with the City’s Debt Management Policy, the City has set debt ceilings to use as a guide in evaluating the affordability for future debt. The debt ceiling for non-voter direct debt service as percent of General Fund Revenues is six percent. The City is currently at 4.5 percent. The proposed issuance will not cause the City to exceed its debt ceiling.

COMMUNICATION FROM THE BUREAU OF STREET LIGHTING and ORDINANCE OF INTENTION FIRST CONSIDERATION relative to establishing a hearing date for the maintenance of the Hayvenhurst Avenue and Lanai Road Street Lighting District.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. ADOPT the report of the Director, Bureau of Street Lighting, dated September 16, 2015.

  2. PRESENT and ADOPT the accompanying ORDINANCE OF INTENTION setting the date of DECEMBER 9, 2015 as the hearing date for the maintenance of the Hayvenhurst Avenue and Lanai Road Street Lighting District, in accordance with Proposition 218, Articles XIIIC and XIIID of the California Constitution and Government Code Section 53753.

 

Fiscal Impact Statement:  The Bureau of Street Lighting reports that if adopted, $335.48 will be collected annually starting with tax year 2015-16 that will go into a dedicated street lighting maintenance assessment account for the use in the operation and maintenance of this street lighting system.

Recommendations for Council action:

 

  1. NOTE and FILE the EWDD reports, dated March 27, 2015, May 16, 2014, and April 7, 2014, in response to Motion (Huizar - Cedillo), relative to EWDD's efforts to create a Citywide economic development plan, establish department economic development functions, and implement its role in the City's economic development strategy.

  2. INSTRUCT the EWDD, Chief Legislative Analyst (CLA), and City Administrative Officer (CAO) to report with recommendations to implement the economic development actions identified in the EWDD report dated March 27, 2015.

  3. DIRECT the CLA to report on the use of boomerang funds for affordable housing and economic development purposes.

Fiscal Impact Statement:  None submitted by the EWDD.  Neither the CAO nor the CLA has completed a financial analysis on this report.

REAFFIRM the FINDINGS of August 17, 2011, that the vacation of Ridgewood Place easterly of Van Ness Avenue from Fountain Avenue to its northerly terminus, pursuant to the City of Los Angeles Environmental Guidelines, is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City of Los Angeles Environmental Guidelines.

  2. REAFFIRM the FINDINGS of August 17, 2011, that this vacation is in substantial conformance with the General Plan pursuant to Section 556 of the Los Angeles City Charter.

  3. ADOPT the accompanying RESOLUTION TO VACATE No. 15-1400811 for the vacation of Ridgewood Place easterly of Van Ness Avenue from Fountain Avenue to its northerly terminus.

  2. AUTHORIZE the Department of Public Works - Bureau of Sanitation to draw a demand on said account in the amount of $150,000 and made payable to Michael Bejarano and Freiman law.

  3. AUTHORIZE the City Attorney, or designee, to prepare Controller instructions for any necessary technical adjustments, subject to the approval of the City Administrative Officer; and, AUTHORIZE the Controller to implement the instructions.
