Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:  

 

  1. CONCUR with the Board of Water and Power Commissioners' (Board) June 2, 2015 action (Resolution No. 015-234) authorizing the commencement of eminent domain proceedings to acquire 33 interests in mineral rights at the BSP site in the vicinity of the community of Cantil in Kern County, California as described in the June 3, 2015 Board report, attached to the Council file.

  2. ADOPT the accompanying RESOLUTION OF NECESSITY as incorporated in Resolution No. 015-234 and pursuant to Charter Section 675(d)(1), attached to the Council file, authorizing the Los Angeles Department of Water and Power (LADWP) to exercise eminent domain for the acquisition of mineral interests necessary for the BSP located in the vicinity of the community of Cantil in Kern County, California.

  3. PRESENT and ADOPT the accompanying ORDINANCE finding that the public interest and necessity require the acquisition by eminent domain of mineral rights interests at the BSP site in the vicinity of the community of Cantil in Kern County, California for the development of the BSP.

  4. FIND that:

    1. The environmental impacts of the BSP were evaluated in the Final EIR certified by the Kern County Board of Supervisors on September 27, 2012, along with the adopted mitigation measures and provides adequate environmental review of the BSP pursuant to the California Environmental Quality Act (CEQA).

    2. In accordance with the CEQA Guidelines Section 15162, no subsequent or supplemental EIR is required for the BSP, and the City Council had reviewed and considered the EIR as part of the process of determining whether to acquire the properties as described in the June 2, 2015 Board report, attached to the Council file.  

 

Fiscal Impact Statement:  The City Administrative Officer reports that approval of Resolution No. 015-234 and Ordinance authorizes a process to legally acquire 33 mineral rights interests.  The total appraised value of the parcels to be acquired through this proposed process is approximately $112,429.  Sufficient funding exists within the Power Revenue Fund.  The proposed resolution complies with the LADWP's adopted Financial Policies.  There is no impact to the City’s General Fund.

 

Community Impact Statement:  None submitted.

  1. CONCUR with the Board of Water and Power Commissioners' (Board) May 5, 2015 action (Resolution No. 015-208) authorizing the commencement of eminent domain proceedings to acquire 46 parcels of real property in the vicinity northeast of Mojave and south of the BRSS in Kern County, California as described in the May 6, 2015 Board report, attached to the Council file.

  2. ADOPT the accompanying RESOLUTION OF NECESSITY as incorporated in Resolution No. 015-208 and pursuant to Charter Section 373(d)(2), attached to the Council file, authorizing the Los Angeles Department of Water and Power to exercise eminent domain for the acquisition of land necessary for the Barren Ridge Renewable Transmission Project (BRRTP) located in Kern County, California.

  3. PRESENT and ADOPT the accompanying ORDINANCE finding the public interest and necessity require the acquisition by eminent domain of those certain real properties located in the vicinity northeast of Mojave and south of the BRSS in Kern County, south to the area west of Lancaster down to the Los Angeles County Line and south to the vicinity of the California Aqueduct in Los Angeles County, California and legally described in Attachment A of the May 14, 2015 City Attorney report, attached to the Council file, for the BRRTP.

 

Fiscal Impact Statement:  The Board reports that funding for the acquisition of all the properties necessary for the BRRTP, including legal and transaction costs, is budgeted for $22 million.

 

Community Impact Statement:  None submitted.

    That petitioner make satisfactory arrangement with the Real Estate Group of the Bureau of Engineering with respect to the payment of the document recording fee.

  2. ACCEPT the petitioner's offer to dedicate the easement for sidewalk purposes on Rey Terrace Way north of Jimenez Street, as depicted on the Exhibit Map in the June 30, 2015 City Engineer report, attached to the Council file.

GENERAL EXEMPTION, COMMUNICATION FROM THE CITY ATTORNEY and ORDINANCE FIRST CONSIDERATION relative to the amendment of Section 63.44 of the Los Angeles Municipal Code (LAMC) to add certain definitions and revise in its entirety the previously suspended prohibition on vending in public parks, to further define the prohibition against camping in parks and to specify the penalties for violation of LAMC 63.44.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND that this action is exempt from the California Environmental Quality Act (CEQA) pursuant to:

    1. State CEQA Guidelines Section 15378 because the ordinance is not a project, in that it represents general policy and/or procedure making. 

    2. State CEQA Guidelines Section 15301 (City CEQA Guidelines, Article III, Section 1.a.), in that the ordinance involves negligible or no expansion of use of existing facilities.

    3. State CEQA Guidelines Section 15305 (City CEQA Guidelines, Article III, Section 1.e.), in that the ordinance implements a minor change in park limitations.

    4. State CEQA Guidelines Section 15323, in that the ordinance provides for the normal operation of existing facilities for public gatherings.

    5. City CEQA Guidelines, Article II, Section 1 (General Exemption), because it can be seen with certainty that there is no possibility that the action in question may have a significant effect on the environment.

  2. PRESENT and ADOPT the accompanying ORDINANCE amending Subsections A and Subdivision 3 of Subsection B of Section 63.44 of Chapter VI of the LAMC to prohibit vending of commercial items or services in all public parks (including beach parks and recreation areas), and amending Subdivision 4 of Subsection D and Subdivision 9 of Subsection I of Section 63.44 of Chapter VI of the LAMC to further define and prohibit camping, including the use of tents, within all City parks, except in locations designated for such purposes, adding a new Subsection R to Section 63.44 to specify penalties for violations, and adding a new Subsection S to Section 63.44 to add a severability clause to ensure that if a court declares any portion of the section to be unlawful that the remaining portions of Section 63.44 remain in full force and effect.

  2. INSTRUCT the LAFD and the City Administrative Officer (CAO), with the assistance of the City Attorney, to report on the feasibility of establishing a $1,000 fine for any person cited for smoking in a Very High Fire Hazard Severity Zone and placing the fine amount on posted No Smoking Signs.

  3. INSTRUCT the CAO, in conjunction with the LAFD and the Department of Recreation and Parks, to identify funding for the installation of No Smoking signs in Very High Fire Hazard Severity Zones.

  4. INSTRUCT the LAFD, LADOT, and Department of Recreation and Parks to recommend strategies for enhanced enforcement, and to offer an opportunity for groups, such as Neighborhood Councils and Homeowners Associations, to sponsor the printing and installation of signs.

COMMUNICATION FROM THE ECONOMIC AND WORKFORCE DEVELOPMENT DEPARTMENT relative to approval of funding and a strategic plan for the for Day Labor Program.

 

Recommendations for Council action:

 

  1. AUTHORIZE the General Manager, Economic and Workforce Development Department (EWDD), or designee, to negotiate and execute new contracts through June 30, 2016 as indicated in Attachment A of the EWDD report dated June 15, 2015 (attached to Council file No. 10-1610), subject to the review and approval of the City Attorney as to form and legality.

  2. INSTRUCT the EWDD, and the Los Angeles Housing and Community Investment Department, to present recommendations on how to increase the employment, social, education, and civic engagement outcomes of the Day Labor Program participants.

  3. INSTRUCT the EWDD to report  in 90 days on specific program recommendations for re-branding and redesigning the program for enhanced services to the day laborer community.

  4. AUTHORIZE the General Manager, EWDD, or designee, to prepare a Request for Proposals (RFP) for the Day Labor Program to be effective July 1, 2016, and to release the RFP document subject to review and approval by the City Attorney as to form and legality.

  5. DIRECT the General Manager, EWDD, or designee, subsequent to completing the Day Labor Program proposal evaluation process, to submit recommendation(s) to the Mayor and City Council for Day Labor Program contractor selection and funding for the twelve (12) month period from July 1, 2016 through June 30, 2017.

Fiscal Impact Statement:  The EWDD reports that there is no additional impact on the General Fund as all items are funded through the approved Annual Budget Resolution for Fiscal Year 2015-16.
