COMMUNICATION FROM THE CITY ATTORNEY and ORDINANCE FIRST CONSIDERATION relative to banning the possession of large-capacity magazines.

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

PRESENT and ADOPT the accompanying ORDINANCE relative to adding a new Article 6.7 to Chapter IV of the Los Angeles Municipal Code declaring any large-capacity magazine to be a public nuisance and an immediate threat to the public, health, safety, and welfare of the citizens of Los Angeles.

Fiscal Impact Statement: None submitted by the City Attorney.  Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.

Community Impact Statement: None submitted.

AMEND to suspend the Rules and PRESENT and ADOPT the attached Ordinance, in lieu of the Ordinance attached to the file.

Recommendation for Council action:

AMEND amending Motion 43A relative to banning the possession of large-capacity magazines to replace the language in the Motion with the following recommendations:

1. REQUEST the City Attorney to draft an amendment to the Ordinance (attached to Council file No. 13-0068),  that would provide an exemption to any retired peace officer holding a valid, current, Carry Concealed Weapons permit pursuant to the California Penal Code.
   
   
2. INSTRUCT the City Clerk to place the amended Ordinance on the August 4, 2015 Council agenda.
