Recommendations for Council action:

 

  1. CONSIDER protests relative to the proposed vacation of a portion of the L-shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue.

  2. FIND that the vacation of a portion of the L-shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines.

  3. FIND that the street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of way indicated below and shown colored blue on Exhibit B of the January 16, 2015 City Engineer report, attached to the Council file:

    A portion of the L-Shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue.

  4. FIND that the vacation of the area shown colored orange on Exhibit B of the January 16, 2015 City Engineer report, attached to the Council file, be denied.

  5. FIND that there is a public benefit to the vacation of a portion of the L-shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue. Upon vacation of the alley, the City is relieved of its ongoing obligation to maintain the right-of-way. In addition, the City is relieved of any potential liability that might result from continued ownership of the involved alley easement.

  6. FIND that the vacation of a portion of the L-shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue is in substantial conformance with the purposes, intent and provisions of the General Plan, in conformance with Section 556 of the City Charter.

  7. FIND that of a portion of the L-shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue is not necessary for non-motorized transportation facilities, in conformance with Section 892 of the California Streets and Highways Code.

  8. FIND that of a portion of the L-shaped alley northerly of Wilshire Boulevard and westerly of La Brea Avenue is not necessary for present or prospective public use, in conformance with Section 8324 of the California Streets and Highways Code.

  9. ADOPT the City Engineer's report dated January 16, 2015 as amended in the Public Works and Gang Reduction Committee deleting conditions 5b, 5c, and 6b.

 

Fiscal Impact Statement: The City Engineer reports that the petitioner has paid a fee of $32,100 for the investigation of this request pursuant to Section 7.42 of the Administrative Code. Any deficit fee to recover the cost pursuant to Section 7.44 of the Administrative Code will be required of the petitioner. Maintenance of the public easement by City forces will be eliminated.

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

PRESENT and ADOPT the accompanying ORDINANCE amending LAMC Section 53.15.5 by requiring that the $15 cost of a mandatory electronic animal identification device (microchip) be included as part of the adoption fees for a rabbit, which will increase the adoption fees for a rabbit from $56 to $71.

  

Fiscal Impact Statement:  Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.

  1. DETERMINE that the Public Convenience or Necessity WILL NOT be served by the sale of alcoholic beverages for off-site consumption at 7-Eleven food market located at 6051 West Hollywood Boulevard Unit 111, Los Angeles, 90028, inasmuch as the site is located in a high crime reporting district and in a census tract with an over-concentration of existing retail sellers of alcoholic beverages.

  2. DENY the application for Determination of Public Convenience or Necessity for the sale of alcoholic beverages for off-site consumption at 6051 West Hollywood Boulevard Unit 111, based upon the above finding and the negative influence associated with the sale of alcohol in the concerned community.

  3. INSTRUCT the City Clerk to transmit this determination to the State Department of Alcoholic Beverage Control as the required findings under Business and Professions Code Section 23958.4.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

  1. TRANSFER $545,794 between departments and funds as specified in Attachment 1 of the City Administrative Officer (CAO) report dated March 24, 2015 attached to the Council file.

  2. TRANSFER $4,250,313 between funds and other financings, as specified in Attachment 2.

  3. TRANSFER $1,975,827 between accounts within departments and funds as specified in Attachment 3.
       
  4. TRANSFER $6,987,640 between departments and funds from General Obligation Bond Funds as specified in Attachment 4.
       
  5. AUTHORIZE the Controller, in accordance with Attachment 2, to transfer cash from Special Funds to reimburse the General Fund on an as-needed basis upon proper documentation from the departments and approval of the Program Managers and the CAO.

  11. INSTRUCT the Bureau of Street Services to submit required documentation to Caltrans and the Los Angeles Metropolitan Transportation Authority (MTA) to cancel and deobligate $4,695,000 in grant funds for the Sunset Junction Phase II Project.
      
  12. INSTRUCT the Fire Department, in accordance with Attachment 2, to reduce $1.7 million of their authorized 2014-15 MICLA funding for fleet replacement and INSTRUCT the City Engineer to proceed with the Mount Lee Water Pipeline Replacement and Pump Improvements and report the progress to the Street and Transportation Projects Oversight Committee.

  13. RESCIND the appropriation of $75,000 from Measure R Local Return Funds to the General Services Department as recommended in Attachment 2 relative to the Pacific Avenue Bridge over Ballona Creek - Sidewalk Repair Project from the 2013-14 Third Construction Projects Report approved by Council on May 1, 2014 (Council file No. 13-1498).

  14. AUTHORIZE the Public Works - Bureau of Engineering, in accordance with Attachment 3, to accept and deposit a total of $863,904 of reimbursable federal SAFETEA-LU grant funds awarded for the Children's Museum/Discovery Science Center (CMLA-DSC) project, located in the Hansen Dam Recreation Area, to Fund 100/ 54, Revenue Source 3684.

    1. Appropriate SAFETEA-LU receipts up to a total of $863,904 to a new account to be established in Fund 100/54, Account No. 00LSTL entitled CMLA-DSC SAFETEA-LU GRANT.

    2. Transfer expenditures from Fund 100/54, Account No. 00T729 entitled Children's Museum-Hansen Dam to the new account in Fund 100/54, Account No. 00LSTL entitled CMLA-DSC SAFETEA-LU GRANT, up to a total of $863,904.    
         
  15. AUTHORIZE the Controller, in accordance with Attachment 3, to increase appropriations to the Capital Finance Administration Fund, Commercial Paper Account No. 0316, totaling $388,944 for quarterly payments paid by the Greater Los Angeles Zoo Association for the Elephants of Asia Exhibit MICLA Debt Service.

  16. AUTHORIZE the CAO to make technical corrections, as necessary, to those transactions included in this report to implement Mayor and Council intentions.

 

Fiscal Impact Statement:  The CAO reports that transfers, appropriations and expenditure authority totaling $25,184,063 are recommended in this report. Of this amount, $2,736,191 is for transfers, appropriations, and expenditure authority to the General Services Department and $3,654,668 is for other City funds, $18,404,260 is for staff cost reimbursements, and $388,944 for the Capital Finance Administration Fund. All transfers and appropriations are based on existing funds, reimbursements or revenues. There is no estimated annual impact due to operations and maintenance costs as a result of these recommendations (Attachment No. 9).
