COMMUNICATIONS FROM THE DEPARTMENT OF GENERAL SERVICES (GSD) and THE MUNICIPAL FACILITIES COMMITTEE relative to authorization to negotiate and execute an amendment to an existing lease at 221 North Figueroa with the law firm of Lewis, Brisbois, Bisgaard & Smith (LBBS) to address rights and notifications.

Recommendation for Council action:

AUTHORIZE the GSD to negotiate and execute an amendment to the lease of LBBS which will modify Section 10.03 of the lease to provide both:

1. A 90-day period during which the City may notify LBBS of its decision on whether or not to repair the damaged tower as outlined in the January 5, 2015 GSD report, attached to the Council file.
   
   
2. A 90-day period during which LBBS may terminate the lease under conditions as outlined in the January 5, 2015 GSD report, attached to the Council file.

Fiscal Impact Statement:  The GSD reports that there is no impact to the General Fund.

COMMUNICATIONS FROM THE DEPARTMENT OF GENERAL SERVICES (GSD) and THE MUNICIPAL FACILITIES COMMITTEE relative to authorization to increase the contract ceiling for CBRE, Inc. (CBRE) for property management and other related services.

Recommendation for Council action:

AUTHORIZE the GSD to increase the Fiscal Year 2014-15 contractual authority for CBRE contract number 111811 for its property management services and related recovery activites and forensic analysis of damage at the Figueroa Plaza towers by $6.7 million, from the current funding level of $9.26 million, to a total revised authority of $15.96 million.

Fiscal Impact Statement:  The GSD reports that it is anticipated that there will be no General Fund impact due to proceeds from the insurance policy that the City carries which covers this event.
