PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to options for an increased fee structure to cover demolition work enforcement cost and public notification for demolition of structures.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

  1. FIND, that the California Environmental Quality Act (CEQA) does not apply to continuing administrative activities or organizational activities of government that will not result in specific direct or indirect physical changes in the environment, or to the creation of government funding mechanisms or other governmental fiscal activities that do not commit to any specific project that may result in potentially significant environmental impacts. Pub. Res. Code § 21065 and State CEQA Guideline §15378(b).  This proposed ordinance merely establishes a public notification process that alerts affected persons whenever an individual applies for a demolition permit to demolish an older structure under existing permit procedures. On that basis, the proposed ordinance is not subject to CEQA.

  2. PRESENT and ADOPT the accompanying ORDINANCE, dated October 15, 2014, to add Sections 91.106.4.5.1, 91.106.4.5.2, 91.106.4.5.3, 91.106.4.5.4 and 91.106.4.5.5 to Article 1 of Chapter IX of the Los Angeles Municipal Code (LAMC) to add a public notification process for the demolition of older structures and adopt a fee to cover administrative costs.

  3. NOT PRESENT and ORDER FILED the Ordinances, dated October 1, 2014 and July 28, 2014. 

Fiscal Impact Statement:  The City Attorney reports that a fee of $60.00 is introduced to cover increased administrative costs for the demolition of older buildings, as directed by the City Council in its May 20, 2014, budget resolution and based on the Los Angeles Department of Building and Safety's fee study.  The fee is in addition to preinspection fees set forth in Section 91.107.3.2 of the LAMC and will be used to fund the expansion of the City's demolition program.  The fee reflected in the proposed draft ordinance should increase annual fee revenue by .08%, or $95,000, if implemented for a full fiscal year.  This change is not anticipated to have a significant impact on revenues, inasmuch as the anticipated increase in the revenue has already been projected in the FY 2014-2015 Budget.

  2. INSTRUCT the DAS to report to the Board of Animal Services Commissioners on the effectiveness of the Contractor's performance and of targeting specific Zip Codes for spay/neuter surgeries prior to consideration of a contract renewal.

Fiscal Impact Statement:  The City Administrative Officer (CAO) reports that approval of the recommendations as detailed in the October 21, 2014 CAO report, attached to the Council file, will authorize the DAS to execute a contract with SPAY4LA to provide mobile spay/neuter services at an annual cost not to exceed $500,000.  Funding is available in the Animal Sterilization Trust Fund for this purpose, including a $545,218 appropriation in 2014-15 from the General Fund.  There is no additional impact to the General Fund.  The proposed contract complies with the City's Financial Policies in that budgeted funds are used for budgeted purposes.

  3. REQUEST departments to continue identifying locations of damaged sidewalks abutting City facilities and begin implementing repairs through the Bureau of Engineering (BOE).

  4. REQUEST the Proprietary Departments (Los Angeles Department of Water and Power, Harbor, and Airport) to identify and present a plan to Council for implementing sidewalk related repairs adjacent to their facilities, beginning in Fiscal Year 2015-16.

  5. REQUEST the BOE, with assistance from the Department of Recreation and Parks, Bureau of Street Services and Bureau of Contract Administration, to report periodically on the progress of the Sidewalk Repair Program, including workload indicators that can be used to develop program metrics.

  6. AUTHORIZE the Controller to establish a new appropriation account within the Capital Improvement Expenditure Program, Fund 100, Department 54, as follows:

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

  1.  FIND that:

    1. The assessments imposed by the Chatsworth BID for the 2014/15 fiscal year provide services that directly benefit each of the businesses which pay the assessments.

    2. The services funded by the assessment are provided only to each of the assessed businesses within the boundaries of the District.

    3. The assessment imposed does not exceed the reasonable cost of conferring the benefits.

    4. The assassin for the proposed business-based District are not taxes and that the District qualifies for exemption from Proposition 26 under Exemption 1 of Article 1 XIII C §1(e)(1).

    5. The services to be provided by the Owners' Association are in the nature of professional, expert, technical or other special services, that the services are of a temporary and occasional character, and that the use of competitive bidding would be impractical, not advantageous, undesirable or where the common law otherwise excuses compliance with competitive bidding requirements.

  2. APPROVE the Chatsworth B.I.D., Inc., a California non-profit mutual benefit corporation, to administer the proposed services of the Chatsworth BID pursuant to Section 36500 et seq. of the California Streets and Highways Code and City regulations.

  2. AUTHORIZE the Controller to expend funds up to $150,000 in Fiscal Year 2014-15 for a REAP landlord outreach contract as stated in Recommendation No. 1 above, as well as to expend funds up to $150,000 annually for the two one-year renewal options that are subject to satisfactory contract performance and availability of sufficient funding through future City budgets, upon proper written demand by the General Manager, HCIDLA, or designee. The initial contract amount will be expended from General Fund Number 100/43, Account 3040, Contractual Services. The above fund is to be reimbursed from the Rent Stabilization Trust Fund Number 440/43 and from the Code Enforcement Trust Fund Number 41M/43.

  3. AUTHORIZE the General Manager, HCIDLA, or designee, to prepare Controller instructions and make any necessary technical adjustments consistent with the Mayor and Council action on this and other approved projects, subject to the approval of the City Administrative Officer; and, AUTHORIZE the Controller to implement the instructions.

Fiscal Impact Statement:  The HCIDLA reports there is no impact to the General Fund. The contract is fully fee-supported, with 95 percent of the proposed budget ($142,500 annually) from the Code Enforcement Trust Fund and 5 percent ($7,500 annually) from the Rent Stabilization Trust Fund.

Recommendations for Council action:

  1. ADOPT the determination by the Los Angeles Harbor Department that the proposed action is exempt under the California Environmental Quality Act (CEQA) as provided in Article II, Section 2(f) of the Los Angeles City CEQA Guidelines.

  2. APPROVE the agreement by and among the City of Los Angeles Harbor Department, the City of Long Beach Harbor Department, and Cal Pacific Land Services, Inc. for property management services for jointly-owned railroad properties.

Fiscal Impact Statement: The City Administrative Officer reports that the proposed request by the Harbor Department will have no impact on the City General Fund. The cost of the proposed five-year Agreement, with two renewal options, will be split equally between the Harbor Department and the Port of Long Beach. The maximum compensation for the initial five-year contract, including reimbursable expenses, will not exceed $1,918,000. The compensation for the Harbor Department will be $959,000 over the proposed five-year contract agreement. The Harbor Department has included funding for the first year in its Fiscal Year 2014/15 adopted budget in the amount of $175,000. AUTHORIZE the General Manager, HCIDLA, or designee, to negotiate and execute amendments related to the existing HCIDLA and Community Redevelopment Agency loan agreements. Revisions will include, but are not limited to, changes to the interest rate, execute subordination agreements to new bond documents, allow the transfer to a new limited partnership to enable admittance of tax credit investors, and allow the interest accrued during construction to continue to accrue and to be amortized at the permanent phase.  All changes are subject to the Affordable Housing Trust Fund Program guidelines and shall be subject to approval by the City Attorney as to form and legality.

Fiscal Impact Statement:  The HCIDLA reports there will be no fiscal impact on the General Fund as a result of the issuance of the bonds. The City is a conduit issuer and does not incur liability for repayment of the bonds. The bonds are a limited obligation payable strictly from revenue from the project and the City will in no way be obligated to make payments on the bonds.

  1. AUTHORIZE the City Clerk to enter into an MOU with the LADWP to establish a cooperation agreement for contributions to the City's BIDs for a period of three years with two one-year extensions.

  2. AUTHORIZE the City Clerk to accept $140,000, and other amounts as funds become available in future years, on behalf of the City's BIDs.

  3. AUTHORIZE the City Clerk to distribute $140,000, and other amounts if funds become available for this purpose, via interoffice transfers in amounts not to exceed $35,000 from the BID Trust Fund Account to the individual BID fund accounts as approved by the BID Working Group.

  4. RECOGNIZE that the BID Working Group is comprised of the LA BID Consortium Chair or a representative, an LADWP representative of its Economic Development Group, and the City's Director of BIDs or a representative; and, AUTHORIZE the City Clerk to pay those funds to the BIDs pursuant to the established contracts.

  5. AUTHORIZE the Controller to establish a separate account in the BID Trust Fund 659 for the allocation of the $140,000, or any other amounts if provided, from the LADWP to the BIDs pursuant to the MOU agreement to be filed in the Office of the City Clerk upon execution.

  6. AUTHORIZE the City Clerk through the BID Program to provide the approval of expenditures from the fund upon the authority of the BID Working Group for the MOU provided by a signed memo from the Group.

  7. AUTHORIZE the City Clerk to make technical corrections as necessary to effectuate the intent of this action.

  2. Direct the LA-RICS to report back to the Public Safety Committee within 30 days regarding the progress of their site visits and communications with stakeholders regarding final cell tower location sites and the alternatives for those locations.

  3. That any use of the LA-RICS network infrastructure for commercial purposes or by commercial entities be subject to a separate action of the City Council and Mayor in authorizing such use during the life of this program.
