PRESENT and ADOPT the accompanying ORDINANCE dated February 10, 2021 to amend Los Angels Administrative Code Section 10.5.2 to permit the Board of Water and Power Commissioners (Board) to enter into contracts to purchase local renewable energy from facilities, combined with an electric energy storage system, that also provide for the use of energy generated by such renewable electric generation facilities to serve customer load directly during a grid outage and to reduce customer energy consumption from the grid as determined by the Los Angeles Department of Water and Power.

HOMELESSNESS AND POVERTY COMMITTEE REPORT relative to a report on the status of Measure H outreach programs and all funded outreach contracts and services carried out by either the County, the Los Angeles Homeless Service Authority (LAHSA) or the City. 

 

Recommendations for Council, pursuant to Motion (Raman - Martinez): 

 

  1. REQUEST that the LAHSA, in coordination with the Homeless Initiative division within the County CEO, which administers Measure H outreach programs, report within 60 days on the status of outreach programs in Los Angeles, and include the following:

    1. A review of how teams are managed and coordinated.

    2. The amount of time and funding resources allocated to outreach programs.

    3. Where in the city these outreach efforts are taking place and with what consistency.

    4. How such outreach efforts are coordinated with the Los Angeles County Department of Mental Health and Department of Health Services.

    5. How and what kind of data is shared about these efforts with the City.

    6. How funds and time are distributed between proactive and reactive outreach efforts.

    7. Solutions and opportunities to align outreach programs in a manner that would most effectively serve persons experiencing homelessness.

    8. Details regarding each data point LAHSA collects through all outreach activities.

      1. Which of those data points are, or are not shared with the City.

      2. The legal justification for collecting and sharing all data points.

    9. How outreach data can more effectively be shared with Council offices for the coordination of homeless services, while safeguarding privacy requirements, and with the understanding that sharing of data shall not be used for law enforcement purposes.  

  2. INSTRUCT the City Administrative Officer (CAO), with the assistance of the Chief Legislative Analyst (CLA), to report back on all City funded outreach contracts and services, both proactive, reactive, and those available on an emergency basis, which are carried out by either the County, LAHSA, or the City.

Recommendations for Council, pursuant to Motion (de Leon - Martinez): 

 

  1. INSTRUCT the Chief Legislative Analyst (CLA), with assistance of necessary departments, to evaluate the availability of CDBG-CV funding, Quimby, and Measure A local return, and other available sources, to fund the leasing, community outreach, and eventual purchase of all properties identified as suitable for housing or other community uses.

  2. INSTRUCT the Los Angeles Housing and Community Investment Department (HCIDLA) and REQUEST the Housing Authority of the City of Los Angeles (HACLA), in partnership with the Department of General Services and Department of Recreation and Parks (RAP) as needed, to immediately begin negotiating leases with Caltrans for all vacant 710 North Freeway Extension homes and parcels within the City of Los Angeles

  3. REQUEST the HACLA, in coordination with Los Angeles Homeless Service Authority, to house tenants in each unit no later than fifteen days after they are deemed habitable with priority given to El Sereno unhoused residents

  4. INSTRUCT the Department of City Planning, in coordination with HCIDLA and RAP, to conduct a community outreach and engagement plan with El Sereno residents and stakeholders to solicit feedback on the best long term use of all leased parcels and report to Council detailing the recommended uses for each parcel.

DIRECT the LAPD to report in 30 days in regard to a comparative analysis of the current race/ethnicity and gender demographics of sworn personnel in the LAPD as compared to 10 years ago, and a forecast of where the LAPD expects to be in the next five years with said analysis to include information on how this data relates to command staff within the LAPD and what current standards are used to prioritize diversity in promotional positions.

  2. DIRECT the Civil, Human Rights, and Equity Department to review the LAPD's report, and report in regard to any issues of concerns or interest that the LAPD might identify.

PUBLIC SAFETY COMMITTEE REPORT relative to authority to execute the Fourth Amendment to Contract No. C-128380 between the City and Bode Cellmark Forensics, Inc. for forensic Deoxyribonucleic Acid (DNA) analysis on an as-needed basis. 

 

Recommendation for Council action: 

 

AUTHORIZE the Chief, Los Angeles Police Department, of designee, to execute the Fourth Amendment to Contract No. C-128380 between the City and Bode Cellmark Forensics, Inc. for forensic DNA analysis services on an as-needed basis, subject to the review and approval by the City Attorney as to form. The Fourth Amendment will extend the term of the contract an additional two years from July 1, 2020 through June 30, 2022, provide an updated Statement of Work, and provide an updated Fee Schedule. 

Fiscal Impact Statement: The City Administrative Officer (CAO) reports that approval of the recommendation in this report will have no additional impact to the General Fund. Funding for the agreement has been provided in the Los Angeles Police Department Fiscal Year 2020-21 Contractual Services Account. 

Financial Impact Statement: The CAO reports that the recommendation in this report complies with the City's Financial Policies in that contract expenditures will be limited to the use of approved budgeted funds.

PLANNING AND LAND USE MANAGEMENT (PLUM) and HOUSING COMMITTEES' REPORTS relative to the implementation of Senate Bill (SB) 330 (Skinner), the Housing Crisis Act of 2019.

 

  1. PLUM COMMITTEE REPORT

    Recommendations for Council action, as initiated by Motion (Ryu - Harris-Dawson):
       
    1. INSTRUCT the Department of City Planning (DCP), Los Angeles Department of Building and Safety (LADBS), and the Los Angeles Housing and Community Investment Department (HCIDLA), to prepare a report with recommendations on development trends before the end of Fiscal Year 2020-21, with an analysis of the impact of SB 330 on by-right development, and trends on the location and typologies of by-right housing development.

    2. INSTRUCT the DCP, LADBS, and HCIDLA to report on recommended policies for the City to develop, in addition to SB 330, for ministerial projects where there is a loss of projected units.

    3. INSTRUCT the DCP to report on supplemental administrative procedures outlining how SB 330 will apply to projects that also require a Mello Act Compliance Review, which should clarify how SB 330 will apply to projects when the Bill provides stricter standards to preserve affordable housing than the Interim Administrative Procedures for Complying with the Mello Act, also known as the IAP.

    4. INSTRUCT the HCIDLA to report on a plan to create a program that includes outreach and education to ensure that, at a minimum, requirements such as relocation benefits, a right of first refusal, and occupancy for tenants up to six months prior to the start of construction are fully satisfied per SB 330; such report should consider and present immediate actions that the City Council can take to allow for recourse or a private right of action for developer noncompliance; and, should include staffing and resource requirements to implement these services.

    5. REQUEST the PLUM Committee to consider the preparation of an ordinance to extend the definition of a housing development project to include new single family homes; such ordinance should prevent all new and substantially remodeled single family residences in all multi-family zones, and ban construction of a new single family home where two or more units of housing were demolished at the site; and, should include additional No Net Loss provisions to restrict housing developments from replacing the existing density on a lot.

    6. INSTRUCT the DCP, LADBS, and HCIDLA to provide clarification on the definitions of bedrooms and bedroom size as they relate to replacement units.
         
  2. HOUSING COMMITTEE REPORT

 

Recommendations for Council action: 

 

  1. CONCUR with the January 21, 2021 Planning and Land Use Management Committee recommendations.

  2. DIRECT the Department of City Planning (DCP), Los Angeles Department of Building and Safety (LADBS), and Los Angeles Housing and Investment Department (HCIDLA) to report on relocation costs, and the possibility of making the City the trustee for relocation costs as opposed to the developer, the ability to facilitate the right of return for tenants, and related costs associated with implementing such a process to make the program more effective.

    5. Allow the transfer of the City’s financial commitment for all of the projects identified in this report’s Table to a limited partnership or other legal entity formed solely for the purpose of owning and operating the project in accordance with City and Federal requirements.

The City is a conduit issuer and does not incur liability for the repayment of the bonds, which are a limited obligation payable solely from the revenues of the Project, and the City will in no way be obligated to make payments on the bonds.

  1. INSTRUCT the City Administrative Officer (CAO) to do the following:

    1. Report to Council on potential funding sources for a substantially increased utilization of Project Roomkey that would be FEMA-reimbursement eligible and not restricted from federal reimbursement like the Coronavirus Relief Funds, including but not limited to borrowing from special funds.

    2. Seek immediate written guidance from FEMA on the timeline for when the City will receive reimbursements for these expenses.

    3. Seek revisions of FEMA's previously issued guidance to specify that all unhoused people are inherently more vulnerable to COVID-19 and therefore Project Roomkey expenses for sheltering any unhoused person are reimbursable.

  2. REQUEST a report from the City Attorney on whether the City can use federal funds, including FEMA reimbursements, for any activity that could be considered a taking, and whether requiring involuntary hotel participation in Project Roomkey could endanger the availability of FEMA reimbursement.

  3. INSTRUCT the Chief Legislative Analyst (CLA) and CAO, in consultation with the City Attorney, to report on whether the pending American Recovery Plan legislation would allow the City to spend funds allocated to the City on FEMA-reimbursable expenses or whether the use of new federal aid funds would preclude the City from seeking FEMA reimbursements for otherwise eligible expenses financed out of new federal relief.

  4. REQUEST the Emergency Operation Center, including the Emergency Management Department, the CAO, and the Los Angeles Housing and Community Investment Department to formally request through the California Office of Emergency Services, an advance of $150,000,000 from FEMA, creating an opportunity to front fund 40 percent of an effort to provide 10,000 hotel rooms for the next six months.
