- DETERMINE that the Project is exempt pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15060(c)(3), since an activity is not subject to the CEQA if it does not meet the definition of a project, and Section 15378(b)(5) states that organizational or administrative activities that will not result in direct or indirect physical changes in the environment do not meet such definition; therefore, the action of granting an easement of Cactus Flats Road over certain real property owned by the City and under the management and control of the LADWP to the County is not subject to the CEQA.
- CONCUR with the Board of Water and Power Commissioners' (Board) action of November 17, 2020, Resolution No. 021 083, resolving that the LADWP's and the public's interest will be furthered by granting an easement to the County for public roadway purposes on City-owned property located in Inyo County, California under the management and control of the LADWP, identified as a portion of Assessor's Parcel Numbers 033-110-20, 033-140-05, and 033-210-26 (Property); approving and recommending the Council's approval and authorization by Ordinance the granting of an easement to the County for public purposes, in accordance with City Charter Section 675(d)(2); and, authorizing and directing the LADWP to execute an instrument in writing, approved as to form and legality by the City Attorney, conveying said easement to the County for and on behalf of the LADWP in accordance with City Charter Section 675(d)(2).
- PRESENT and ADOPT the accompanying ORDINANCE, dated December 8, 2020, approving Board Resolution No. 021 083 authorizing the LADWP to grant an easement over said Property to the County for public roadway purposes.

Fiscal Impact Statement: The City Administrative Officer (CAO) reports that there is no impact to the General Fund. Approval of the Resolution authorizes a one-time reimbursement expenditure up to $6 million for ATRW service at the Valero Wilmington Refinery, and $29.15 million in anticipated revenue for the Water Revenue Fund for the initial 10-year term. This fiscal impact does not assume anticipated revenue resulting from any contract extensions.

- Accept reimbursements from the Social Security Administration (SSA) for serving as an Employment Network under the SSA’s Ticket to Work Program, previously approved under Council file No. 12-0818; and, authorize the EWDD to appropriate and expend within the Disability Employment Initiative Fund No. 54N upon presentation of supporting documentation.
- Negotiate and execute agreements and amendments to agreements with the service providers and funding as detailed in Attachment 1 of the December 24, 2020 EWDD/WDB report, attached to the Council file, subject to City Attorney review and approval as to form, legality, and procurement requirements, and compliance with City contracting requirements, including Charter Section 1022.
- Make technical corrections as necessary to transactions included in this Report to implement Mayor and Council intentions, subject to the approval of the CAO.
- AUTHORIZE the Controller to implement the Controller instructions listed in the Attachment of the January 21, 2021 CAO report, attached to the Council file.
Fiscal Impact Statement:
The CAO reports that there is an indirect impact to the General Fund. Approval of the recommendations contained in the January 21, 2021 CAO report, attached to the Council file, would reduce reimbursements for salary related costs to the General Fund from the Workforce Innovation and Opportunity Act Fund in the amount of $918,828.
Financial Polices Statement: The CAO reports that the recommendations contained in the January 21, 2021 CAO Report, attached to the Council file, are in compliance with the City’s Financial Policies in that funding for the 2020-21 WDB Annual Plan is provided by Special Funds and the Adopted Fiscal Year 2020-21 Budget.

- AUTHORIZE the City Administrative Officer (CAO) to prepare any necessary technical adjustments; and, AUTHORIZE the Controller to implement those instructions.
- INSTRUCT the Department of General Services and the Bureau of Engineering to report to the MFC on long-term infrastructure improvements, such as ultraviolet disinfection technologies, that are recommended as standards for development of new facilities and upgrades for existing City facilities.
- INSTRUCT City departments to include any additional requests for COVID-19 Workplace Safety Facility Improvements that are not recommended for funding through said MFC report, as part of their respective funding requests for the upcoming FY 2021-22 City Budget.
Fiscal Impact Statement: The MFC reports that adoption of the above recommendations will have no additional impact on the General Fund beyond funding previously budgeted within the CIEP.

- INSTRUCT the GSD, with the assistance of the City Attorney and the Department of Recreation of Parks (RAP), to negotiate a non-profit lease agreement, subject to Council approval, with the San Pedro Skatepark Association for the operation and maintenance of the Channel Street Skatepark, which should specify that the RAP will oversee the completion of all necessary improvements and repairs identified in the City-approved construction plans that are needed to bring the Skatepark into compliance with relevant codes.

- Prepare any Controller’s instructions needed to implement actions approved by the Council and Mayor on matters presented in or deriving from the transmittal, and or to make necessary technical adjustment, and further, request that the Controller implement these instructions.
- AUTHORIZE the DCA to accept grant funding, if awarded, from the National Endowment for the Arts for up to $20,000 for a one-year grant period, from July 1, 2021 through June 30, 2022.
- AUTHORIZE the DCA to receive and expend National Endowment for the Arts grant funds for activities for all eligible purposes for the twelve month grant period.
- AUTHORIZE the Controller to:
- Establish a new appropriation account within Fund No. 337, Cultural Affairs Grants, to be labeled NEA BIG READ FY21/22.
- Appropriate up to $20,000 received from the National Endowment for the Arts into the newly established account within Fund No. 337, NEA BIG READ FY21/22.

However, City departments that receive Tenth Cycle funding awards may have increased operational and maintenance costs associated with completed capital projects that would be addressed as part of the City budget process in future years. Funding made available through the RFP will be programmed over a three year period from July 1, 2022 through June 30, 2025.
