CATEGORICAL EXEMPTION, TRANSPORTATION COMMITTEE REPORT, and RESOLUTION relative to the conversion of Temporary Preferential Parking District (TPPD) No. 44 in the Cahuenga Pass area of Council District 4 to Preferential Parking District (PPD) No. 44, and expansion of its boundaries.

 

Recommendations for Council action:

 

  1. FIND that patrons of commercial businesses in the Cahuenga Pass neighborhood cause adverse parking impacts on the adjacent residential blocks from which residents deserve immediate relief.

  2. FIND that the conversion of TPPD No. 44 to PPD No. 44 and the expansion of its boundaries, pursuant to Los Angeles Municipal Code (LAMC) Section 80.58.d, is exempt from the California Environmental Quality Act (CEQA) as a Class 1 Categorical Exemption, under Article III.1.a.3 of the 2002 Los Angeles City CEQA Guidelines.

  3. ADOPT the accompanying Resolution to convert TPPD No. 44 to PPD No. 44 and expand its boundaries, pursuant to the Council's Rules and Procedures for Preferential Parking Districts, dated November 6, 2018, which currently includes the residential portion of the following blocks:

    1. Dos Palos Drive between Bennett Drive and Barbara Court 

    2. Barbara Court between Cahuenga Boulevard and Dos Palos Drive

Fiscal Impact Statement: The LADOT reports that revenue from the sale of permits will cover the cost of implementing, administering, and enforcing PPD No. 44. Violations of the posted parking restrictions may result in citation fines deposited into the General Fund.

TRANSPORTATION COMMITTEE REPORT and RESOLUTION relative to authorizing the Los Angeles Department of Transportation to apply for and accept grant funding from the Volkswagen Environmental Mitigation Trust (VEMT) Fund for 18 battery-electric DASH buses.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. AUTHORIZE the General Manager, Los Angeles Department of Transportation (LADOT), or Chief of Transit Programs, to apply for and accept grant funds from the VEMT Fund, in an amount up to $3,250,000; and, execute any necessary agreements, subject to the approval of the City Attorney.

  2. ADOPT the accompanying RESOLUTION authorizing the LADOT to submit an application and sign certain assurances for the VEMT applications for local, State, and Federal programs, projects, or grants relative to the receipt of the VEMT funding.

 

Fiscal Impact Statement: The LADOT reports that there is no impact to the General Fund. Grant funding will be deposited into the Proposition A Fund 385, Revenue Source Code 33361, State Grants - Other to offset the cost of the 18 BYD battery-electric buses on order.

  2. INSTRUCT the Department of Animal Services (DAS) to:

    1. Implement a temporary waiver of redemption fees for low income residents negatively impacted by the COVID-19 pandemic upon City Council’s approval.

    2. Report the number of redemption waivers granted and their associated costs on a monthly basis through the DAS’s monthly Financial Status Reports.

 

Fiscal Impact Statement:  The DAS reports that  approval of this request will impact General Fund revenue at an estimated cost of approximately $20,000 to $100,000, based upon the number of requests received and the duration of the pandemic; however, waiver costs are off-set by daily care and feed cost savings for pets not redeemed and held for over two days.

  3. AUTHORIZE the General Manager,  HCIDLA, or designee, to:

    1. Negotiate and execute the relevant bond documents for the Berendo Sage Apartments, subject to the approval of the City Attorney as to form.

    2. Negotiate and reduce, if necessary, the interest rate of the Berendo Sage Apartments Project’s Proposition HHH Supportive Housing loan of $6,620,000 from 3 percent to a 1 percent simple interest rate.

BUDGET AND FINANCE COMMITTEE REPORT relative to an update and the status of the Los Angeles Justice Fund (LAJF).

 

Recommendations for Council action:

 

  1. AUTHORIZE the $1 million allocation in the Fiscal Year 2020-21 Adopted Budget for a one-year extension of the LAJF from July 1, 2020 through June 30, 2021, to allow grantees to continue to provide legal representation services to new and existing cases.

  2. INSTRUCT the Chief Legislative Analyst (CLA) and City Administrative Officer (CAO) to report with a strategic plan for a longer term multi-year funding program for removal defense. The CLA and CAO will report with a plan that will include a negotiated Memorandum of Understanding with the County of Los Angeles, Department of Consumer and Business Affairs - Office of Immigrant Affairs, to better align metrics, reporting requirements, the identification of additional funding contributions to promote the sustainability of the program, and recommendations for a reduced number of legal service providers.

  3. INSTRUCT the CLA to work with the City Attorney and CAO to report on the feasibility of creating a Request for Proposals consisting of immigration legal service provider(s) with demonstrated capacity and experience.

  4. INSTRUCT the CAO, with the assistance of the California Community Foundation (CCF), to report on the impact to open LAJF cases should funding not be available in the future.

  5. INSTRUCT the CLA to report on various scenarios of servicing the immigrant community after the November elections.

  6. NOTE and FILE the CAO report dated March 5, 2020 relative to the LAJF Status Report - November 27, 2017 through September 30, 2019.

Recommendations for Council action:

 

  1. INSTRUCT the Los Angeles Housing and Community Investment Department (HCIDLA) to develop a COVID-19 Emergency Eviction Defense Program and report to Council in a week.

  2. ALLOCATE up to $8 million from CDBG-CV to HCIDLA for a one year emergency program and instruct the department to report back to Council with the outcomes of the COVID-19 Emergency Eviction Defense Program at the end of the year and return any unspent funds.

  3. ALLOCATE the $1,916,911.18 of the unencumbered funds from the previous Emergency Renters Relief Program to the COVID-19 Emergency Eviction Defense Program.

Recommendations for Council action:

 

  1. INSTRUCT the Los Angeles Department of Building and Safety (LADBS), in consultation with the City Attorney, to prepare and present an Ordinance to suspend all citation enforcement provisions, and thereby waive the requirement for businesses to obtain a permit for temporary signs that are tacked, pasted or otherwise temporarily affixed to windows and/or on the walls of buildings, barns, sheds or fences, as defined by Los Angeles Municipal Code Section 14.4.16, and rescind the fourteen Order to Comply citations for temporary sign violations issued from March 4, 2020 through July 24, 2020, and allow temporary signs until the end of the COVID-19 State of Emergency, with notifications to property owners as to its sunset date.

  2. INSTRUCT the LADBS, in consultation with the City Attorney, to prepare a report with recommendations on which codes present life safety concerns and should continue to be enforced during the COVID-19 State of Emergency.
