Recommendation for Council action:
CONSIDER appeals filed by the Natural Resources Defense Council, the San Pedro Peninsula Homeowners United, the Coalition for Clean Air, the Urban and Environmental Policy Institute at Occidental College, the Long Beach Alliance for Children with Asthma, and the East Yard Communities for Environmental Justice; the South Coast Air Quality Management District; and, the California Air Resources Board of the action taken by the BOHC at its special meeting held October 8, 2019, to certify the Final SEIR for the Berth Nos. 97-109 China Shipping Container Terminal Project (APP No. 150224-504; SCH No. 2003061153), and taking the following additional actions recommended by the Port of Los Angeles (POLA):
- Adopt the Findings of Fact and Statement of Overriding Considerations.
- Find that, in accordance with the information contained in the Final SEIR, the Revised Project will have significant environmental effects on air quality and meteorology, greenhouse gas emissions and climate change, and ground transportation as defined by Public Resources Code Sections 21068 and 21082.2, and CEQA Guidelines, Sections 15064, 15064.4, 15064.5, and 15382.
- Find that, in accordance with the provisions of CEQA Guidelines Section 15091(a)(1), changes or alterations have been required in, or incorporated into, the Revised Project, which substantially lessens or avoids one or more of the significant adverse environmental impacts identified in the Final SEIR.
- Find that, in accordance with the provisions of CEQA Guidelines Section 15091(a)(3), specific economic, legal, social, technological, or other considerations, make infeasible certain mitigation measures such that some environmental impacts remain significant and unavoidable.
- Find that, all information added to the Final SEIR after public notice of the availability of the Recirculated Draft SEIR for public review but before certification, merely clarifies, amplifies, or makes insignificant modifications in an adequate Environmental Impact Report and recirculation is not necessary.
- Find that, in accordance with Public Resources Code Section 21081(b) and CEQA Guidelines Section 15093, the benefits of the Revised Project outweigh the significant and unavoidable environmental impacts, and adopt the Findings of Fact and Statement of Overriding Considerations.
- Adopt the Supplemental Mitigation Monitoring and Reporting Program (MMRP) as required by Public Resources Code, Section 21081.6.
- Approve the Revised Project identified in the Final SEIR Report including all feasible mitigation measures and lease measures with consideration of the Findings of Fact and Statement of Overriding Considerations, and the Mitigation Monitoring and Reporting Program.
- Direct POLA's Cargo and Industrial Real Estate Division to incorporate by reference the Final SEIR, mitigation measures, lease measures, and Mitigation Monitoring and Reporting Program into any and all lease agreements or assignments encompassed in the approved Revised Project.
- Authorize POLA's Environmental Management Division to file the Notice of Determination with the Los Angeles County Clerk and the Los Angeles City Clerk.
- Adopt Resolution No. 19-9548.

- INSTRUCT the Department of City Planning (DCP), in coordination with staff assigned to the development of the Wildlife Protection Areas Study (Council file No. 14-0518) and Environmental Policy Unit, to report to Council on ongoing tree and biodiversity planning, strategies and/or efforts at the DCP and Urban Forestry Division (Council file No. 03-1459-S3) to protect and grow the City’s urban canopy, including cost, staffing and budget recommendations for the creation of a division of biologists and/or arbor culturists to consult on management of the private tree population and coordinate efforts with city departments.
- INSTRUCT the DCP, Los Angeles Department of Building and Safety (LADBS) and Bureau of Street Services (BSS), in consultation with any other departments as necessary, to report to Council with recommendations for improvements to strengthen and expand the Protected Tree Ordinance and any other relevant tree planting or replacement requirements for individual private development projects with the goal of comprehensively preserving, maintaining and growing the City’s private tree population.
- INSTRUCT the DCP and BSS to report to Council with an interpretation of Los Angeles Municipal Code Article 6 and Article 7, Section 17.05 of Chapter I, to further clarify language, namely Subsection 46.02(b)1, (reasonable development of a property) to ensure alternate site designs are explored; Subsection 46.02(c) (approximate value and reasonable probability) to ensure consideration of the full economic and environmental cost of tree removal and replacement; and, Subsection 46.01 to ensure protected species that are planted or grown as a part of a tree planting program are not excluded from the Protected Tree Ordinance.
- INSTRUCT the DCP, LADBS, BSS, Urban Forestry Division, and any other departments as necessary, to report to Council with recommendations for the creation of protocols for tree removals, to include all non-protected mature, healthy trees, regardless of their status as native or non-native (unless considered invasive) such that removal of any mature trees will result in replacement, or mitigation banking aligned with the Conservation Element of the City’s General Plan and any other relevant general plan policies and goals to enhance urban biodiversity.
- INSTRUCT the DCP and LADBS, with the assistance of the BSS and any other departments as necessary, to report to Council with recommendations for the enhancement of the notification process for tree removals on private property (Council file No. 14-1634), ensuring the removal and notification process is consistent with the street tree removal and notification process, and that residents on neighboring parcels are fully informed of pending tree removals.
- INSTRUCT the DCP and LADBS, with the assistance of the Urban Forestry Division, to evaluate the placement and timing of tree removals in the permitting process; and, to report to Council with recommendations to require approval earlier in permitting review process to ensure that approvals of tree removals are completed prior to final permit approvals for development projects.
