ENVIRONMENTAL IMPACT REPORT, PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to a Zone Change for the project site located at 14130 and 14154 West Riverside Drive, 4715 - 4745 North Hazeltine Avenue.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND that based on the independent judgment of the decision-maker, after consideration of the whole of the administrative record, the project was assessed in the previously certified Environmental Impact Report No. ENV-2014-1362-EIR (SCH No. 2014071001), which includes the Draft EIR dated July 2016, and the Final EIR, dated August 2019, certified on September 10, 2019; and pursuant to CEQA Guidelines, Sections 15162 and 15164, no subsequent EIR, negative declaration, or addendum is required for approval of the Project.

  2. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of the Council.

  3. PRESENT and ADOPT the accompanying ORDINANCE dated October 24, 2019 effectuating a Zone Change  from P-1L-RIO, PB-1L-RIO and C2- 1L-RIO to (T)(Q)C2-1 L-RIO for Proposed Lot 1 and P-1 L-RIO, PB-1L-RIO and C2-1L-RIO to (T)(Q)RAS3-1 L-RIO for Proposed Lot 2 for the Final EIR Reduced Alternative 5 which includes the development of 249 multi-family residential units and 27,470 square feet of commercial uses, these new uses would be provided within two new buildings located to the north of the existing Sunkist Building; the Reduced Alternative 5 would provide 1,141 parking spaces within above- and below-grade parking levels within the northern portion of the Project Site, a surface parking lot within the eastern portion of the Project Site, and an above- and below-grade parking structure within the western portion of the Project Site; as part of the Reduced Alternative 5, portions of the interior and exterior of the Sunkist Building would be renovated; in total, the Reduced Alternative 5 would involve the development of up to 287,924 square feet of new floor area (not including the 126,674-square-foot Sunkist Building to remain) for the project site located at 14130 and 14154 West Riverside Drive; 4715 - 4745 North Hazeltine Avenue, subject to Conditions of Approval.

  4. ADVISE the applicant that, pursuant to State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring.

  5. ADVISE the applicant that, pursuant to State Fish and Game Code Section 711.4, a Fish and Game Fee and/or Certificate of Fee Exemption is now required to be submitted to the County Clerk prior to or concurrent with the Environmental Notice of Determination filing.

CONTINUED CONSIDERATION OF HEALTH, EDUCATION, NEIGHBORHOODS, PARKS, ARTS, AND RIVER COMMITTEE REPORT relative to authorizing an increase of funds in the approved project budget for the Studio City Recreation Center, New Gymnasium Project.

Recommendations for Council action:

  1. AUTHORIZE an increase of $5,319,459 in the approved project budget for the Studio City Recreation Center, New Gymnasium Project from $10,686,000 to $16,005,459.

  2. REQUEST the Board of Recreation and Parks Commissioners approve the release of the call for bids for the project, with final award of the Project to be subject to the identification of full funding prior to award.

  3. INSTRUCT staff from the Bureau of Engineering, Department of Recreation and Parks, and related departments to continue to work concurrently with Council District 2 to develop a funding plan for addressing any remaining funding shortfall following the award determination for State grant funds anticipated by January 2020.
      

Fiscal Impact Statement:  The LA for Kids Steering Committee reports that there is a potential future impact on the General Fund to the extent that funding shortfalls for the project are not resolved through additional commitments of supplemental program funds, other Special Fund monies or grant opportunities. The Department of Recreation and Parks is currently pursuing up to $8.5 million in grant funds.

Recommendation for Council action:

 

APPROVE Amendment No. 5, attached to the Council file and approved as to form and legality by the City Attorney, to Contract No. C-123811 with the ASPCA to continue contractual services beyond the third and final extension option for operation of the spay/neuter clinic at the South Los Angeles Animal Services Center through December 31, 2020.

 

Fiscal Impact Statement:  The Department of Animal Services reports that there is no fiscal impact to the General Fund as all spay/neuter costs are paid through the Animal Sterilization Fund.

HOMELESSNESS AND POVERTY and BUDGET AND FINANCE COMMITTEES' REPORT relative to funding for A Bridge Home site at 14333 Aetna Street.

 

Recommendations for Council action, pursuant to Motion (Martinez - Krekorian), SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. APPROVE funds in the amount of $3,885,300 for the crisis and bridge housing project proposed at 14333 Aetna Street. 

  2. AUTHORIZE the Controller to process a Reserve Fund loan(s) in a cumulative amount up to $3,885,300 to support construction costs for the bridge housing facility at 14333 Aetna Street, which will be reimbursed through State of California Homeless Housing, Assistance, and Prevention Program (HHAP) grant receipts. 

  3. INSTRUCT the City Administrative Officer (CAO) to reimburse the Reserve Fund upon receipt of the City's HHAP grant award.

  4. AUTHORIZE the Controller to:

    1. Transfer up to $3,885,300 from the Reserve Fund to the Special Fund HHAP, Department No. 10, Account No. FC-1: A Bridge Home Capital and Operating Gap, as authorized by Council file No. 19­-0914. 

    2. Transfer up to $3,305,300 from Special Fund HHAP, Department No. 10, Account No. FC-1; A Bridge Home Capital and Operating Gap to the Capital Improvements Expenditure Program, Fund No. 100/54, Account No. 00S715, A Bridge Home - Aetna Street. 

    3. Transfer up to $580,000 from Special Fund HHAP, Department No. 10, Account FC-1: A Bridge Home Capital and Operating Gap, to the Bureau of Engineering Fund No. 100/78, Account No. 001010, Salaries General. 

  5. INSTRUCT the City Homeless Coordinator to continue to coordinate with the Los Angeles Homeless Services Authority (LAHSA), the County of Los Angeles, and the State of California to identify funds for interim housing operations at this site, including but not limited to County Measure H revenue, LAHSA and County HHAP allocations, or additional State funding.

  6. DIRECT the CAO to prepare any additional Controller instructions to reimburse City departments for the accrued labor, material, or permit costs related to this project from Bridge Housing - Aetna Street account consistent with the Mayor and Council action on this matter; and, AUTHORIZE the Controller to implement these instructions.

  7. DIRECT the CAO to prepare any additional Controller instructions or make any necessary technical adjustments consistent with the Mayor and Council action in this matter; and, AUTHORIZE the Controller to implement these instructions.

Fiscal Impact Statement: Neither the CAO nor the Chief Legislative Analyst has completed a financial analysis of this report.

Recommendations for Council action, pursuant to Motion (O'Farrell - Rodriguez), SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. APPROVE funds in the amount of $3,546,978.24 for the crisis and bridge housing project proposed at 1215 Lodi Place. 

  2. AUTHORIZE the Controller to process a Reserve Fund loan(s) in a cumulative amount up to $978,384.13 to support the security deposit and leasing costs for up to nine months, which will be reimbursed through State of California Homeless Housing, Assistance, and Prevention Program (HHAP) grant receipts. 

  3. INSTRUCT the City Administrative Officer (CAO) to reimburse the Reserve Fund upon receipt of the City's HHAP grant award.

  4. AUTHORIZE the Controller to:

    1. Transfer up to $978,384.13 from the Reserve Fund to the Special Fund HHAP, Department No. 10, Account No. FC-1: A Bridge Home Capital and Operating Gap, as authorized by Council file No. 19­-0914. 

    2. Transfer up to $978,384.13 from Special Fund HHAP, Department No. 10, Account No. FC-1; A Bridge Home Capital and Operating Gap to the Department of General Services Fund No. 100/40, Account No. 006030, Leasing Account. 

    3. Transfer the balance of the leasing costs, up to $3,507,782.87 from Special Fund HHAP, Department No. 10, Account FC-1: A Bridge Home Capital and Operating Gap, upon receipt of HHAP funding from the State. 

    4. Transfer $39,190.37 from the Capital Improvements Expenditure Program to the Department of Disability's Fund No. 100/65, Account No. 003040, Contractual Services. 

  5. DIRECT the CAO to prepare any additional Controller instructions or make any necessary technical and/or accounting corrections or clarifications consistent with the Mayor and Council action in this matter; and, AUTHORIZE the Controller to implement these instructions.

  6. INSTRUCT the City Homeless Coordinator to coordinate with Los Angeles County to identify funds for interim housing operations at this site, including but not limited to County Measure H revenue.

  3. INSTRUCT the City Administrative Officer (CAO) to reimburse the Reserve Fund upon receipt of the City's HHAP grant award.

  4. AUTHORIZE the Controller to:
