CONSIDERATION OF PROTESTS, CATEGORICAL EXEMPTION and PUBLIC WORKS AND GANG REDUCTION COMMITTEE REPORT relative to the vacation of a portion of the southwesterly side of Ventura Boulevard from approximately 720 feet to 835 feet westerly of Whitsett Avenue, VAC-E1401331 (Vacation).

 

Recommendations for Council action:

 

  1. CONSIDER protests relative to the proposed Vacation.

  2. FIND that the Vacation is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines.

  3. FIND that the street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of way indicated below and shown on the map of the October 16, 2019 City Engineer report, attached to the Council file:

    A portion of southwesterly side of Ventura Boulevard from approximately 720 feet to 835 feet westerly of Whitsett Avenue, adjoining Lots 10 and 11, Tract No. 5896, in excess of a 105-foot right-of-way from the existing northerly right-of-way line of Ventura Boulevard.

  4. FIND that there is a public benefit to the Vacation. Upon vacation of the street, the City is relieved of its ongoing obligation to maintain the street. In addition, the City is relieved of any potential liability that might result from continued ownership of the involved street easements.

  5. FIND that the Vacation is in substantial conformance with the purposes, intent and provisions of the General Plan, in conformance with Section 556 of the City Charter.

  6. FIND that the Vacation is not necessary for non-motorized transportation facilities, in conformance with Section 892 of the California Streets and Highways Code.

  7. FIND that the Vacation is not necessary for present or prospective public use, in conformance with Section 8324 of the California Streets and Highways Code.

  8. ADOPT the said City Engineer's report with the conditions contained therein.

 

Fiscal Impact Statement: The City Engineer reports that the petitioner has paid a fee of $14,980 for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC). Any deficit fee to recover the cost pursuant to Section 7.44 of the LAAC will be required of the petitioner. Maintenance of the public easement by City forces will be eliminated.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. RESCIND Recommendation No. 3 of the Council action of November 13, 2019 (Council file No. 19-1251).

  2. AUTHORIZE the Controller to transfer $150,000 from the Liability Claims Fund No. 100/59, Account No. 009793, Public Works, Engineering Liability Payouts, back to Fund No. 100/59, Account No. 009798, Miscellaneous Liability Payouts. 

  3. AUTHORIZE the City Attorney to draw the demand from the Liability Claims Fund No. 100/59, Account No. 009794, Public Works, Sanitation Liability Payouts, as follows: Bice Murphy Law Client Trust Account and Lisa Brescher in the amount of $150,000. 

  4. AUTHORIZE the City Attorney, or designee, to make necessary technical adjustments, subject to the approval of the City Administrative Officer (CAO); and, AUTHORIZE the Controller to implement the instructions.

  2. APPROVE the Board recommendation to authorize the HCIDLA to remove from its active accounts receivables 10 uncollectible invoices totaling $199,250.69. 

Fiscal Impact Statement: The Board reports the proposed action will decrease the City's receivable base by $361,361.52.

Recommendations for Council action, pursuant to Motion (Buscaino - Harris-Dawson):

 

  1. FIND that the Wilmington Jaycees Foundation is eligible to purchase one surplus 2007 Chevrolet Uplander Van [Vehicle Identification Number (VIN)1GDBV13W78D206840], at below market value ($1.00), in accordance with the Los Angeles Administrative Code Section 22.547 (Donation of Surplus City Equipment), as amended by the City Council on November 28, 2006 (Council file No. 04-1822), inasmuch as the Wilmington Jaycees Foundation is a 501(c)3 tax-exempt non-profit organization located in the City of Los Angeles.

  2. REQUEST the City Attorney to expedite preparation of appropriate documents to effectuate the sale and transfer of the above identified surplus equipment at below market value ($1.00) to the Wilmington Jaycees Foundation.

  3. INSTRUCT the City Clerk to inform the Wilmington Jaycees Foundation [Maria Martinez, Director of Aging Programs, (310) 518-4533, 1371 North Eubank Avenue, Wilmington, CA 90744] that the surplus  2007 Chevrolet Uplander Van must be claimed within 60 days from the date of Council approval of the request or notification of availability of the equipment, whichever occurs later, at which time it will revert to the City's surplus equipment pool for disposal by the Department of General Services.
