Recommendations for Council action:

 

  1. FIND that the Dedication is categorically exempt from the California Environmental Quality Act of 1970 pursuant to Article III, Class 5(19) of the City's Environmental Guidelines.

  2. ACCEPT the petitioner's offer for the Dedication, substantially as shown on the Exhibit Maps of the July 2, 2019 City Engineer report, attached to the Council file.

  3. AUTHORIZE the Board of Public Works to acquire the Dedication.

  4. INSTRUCT the City Clerk to forward a copy of the Council action on this project to the Bureau of Engineering, Real Estate Division for processing.

 

Fiscal Impact Statement: The City Engineer reports that a $4,000.73 fee for processing this report was paid pursuant to Sections 7.3 and 7.41.1 of the Los Angeles Administrative Code. No additional City funds are needed.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND, based on the independent judgement of the decision-maker, after consideration of the administrative record, the Project was assessed in MND No. ENV-2016-3181-MND, adopted on February 23, 2018; and pursuant to California Environmental Quality Act (CEQA) Guidelines, Sections 15162 and 15164, no subsequent Environmental Impact Report, negative declaration, or addendum is required for approval of the Project.
       
  2. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of Council.
           
  3. PRESENT and ADOPT the accompanying ORDINANCE dated May 9, 2019, effectuating a Vesting Zone Change from C2-1 and R4-1 to (T)(Q)RAS4-1, for the demolition of an existing gas station, 32 apartment units and 8,942 square feet of medical office, and the use, construction and maintenance of a seven-story mixed-use building with 228 residential units and 53,498 square feet of commercial uses, which includes 565 vehicular parking spaces within two levels of subterranean, at-grade and mezzanine level parking, and provides 310 bicycle parking spaces (including 260 long-term and 50 short-term spaces), and contains two existing billboards which are proposed to remain; for the property located at 1000 South Vermont Avenue, subject to Conditions of Approval.

  4. RESOLVE TO DENY THE APPEAL filed by Rosita Lopez on behalf of the Coalition for an Equitable Westlake/Macarthur Park (Representative: Claudia Medina, Law Office of Claudia Medina), and THEREBY APPROVE the Master Conditional Use to permit the sale and dispensing of a full line of alcoholic beverages for off-site consumption in conjunction with a market and the sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with three establishments, and the Site Plan Review for a development which creates, or results in an increase of 50 or more residential units over 50,000 square feet of commercial area, subject to Conditions of Approval.

  5. ADVISE the applicant, pursuant to Los Angeles Municipal Code Section 12.32 G:

    ...property shall not remain in a Q Qualified classification for more than six years unless during that time: (1) there is substantial physical development of the property to allow for one or more of the uses for which the Q Qualified classification was adopted; or (2) if no physical development is necessary, then the property is used for one or more of the purposes for which the Q Qualified classification was adopted... When these time limitations expire, the Q Qualified classification and the authority contained therein shall become null and void, the rezoning proceedings shall be terminated, and the property thereafter may only be utilized for those purposes permitted prior to the commencement of such rezoning proceedings.

  6. ADVISE the applicant that, pursuant to State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring.

  7. ADVISE the applicant that, pursuant to State Fish and Game Code Section 711.4, a Fish and Game Fee and/or Certificate of Fee Exemption is now required to be submitted to the County Clerk prior to or concurrent with the Environmental Notice of Determination filing.

GENERAL EXEMPTION and ENERGY, CLIMATE CHANGE, AND ENVIRONMENTAL JUSTICE COMMITTEE REPORT relative to the Los Angeles Department of Water and Power's (LADWP) Clean Grid LA: 300 Megawatt (MW) Feed-in Tariff (FiT) Program Expansion.

 

Recommendations for Council action:

 

  1. FIND that in accordance with the California Environmental Quality Act (CEQA), it has been determined that the amendment to expand the FiT Program is exempt pursuant to the General Exemption in CEQA Guidelines Section 15061(b)(3).

  2. NOT PRESENT and ORDER FILED  the accompanying ORDINANCE dated October 31, 2019, amending Section 10.5.2 of the Los Angeles Administrative Code increasing the Board of Water and Power Commissioners’ (Board) authority to enter into contracts for the purchase of local renewable energy from 150 MW to 450 MW, lowering the cap on the average purchase price from $300 per MW- hour to $250 per MW-hour, and increasing the facility effective capacity limit from 3 to 10 MW. 

  3. REQUEST City Attorney to prepare and present an Ordinance amending Section 10.5.2 of the LAAC increasing the Board's authority to enter into contracts for the purchase of local renewable energy from 150 MW to 450 MW, lowering the cap on the average purchase price from $300 per MW-hour to $250 per MW-hour, and increasing the facility effective capacity limit from 3 to 10 MW including the following:

    1. Purchase price cap of $250.00 per MW-hour shall apply to the initial 200 MW (150 MW of current program and 50 MW of expanded program) of the local renewable energy/FiT Program excluding projects already completed or in process of being completed. 

    2. The remaining 250 MW of the local renewable energy/FiT Program shall be subject to a review conducted by the LADWP to determine and recommend an applicable purchase price cap.
                 
  4. AUTHORIZE the expansion of the current FiT Program for an incremental increase of 50 MW, and the revised Program Guidelines.

  5. CONCUR with the Board's action of September 24, 2019, Resolution No. 020-059, which approves Clean Grid LA: 300 Megawatt FiT Program Expansion.
     
  6. REQUEST that the LADWP make technical modifications to the local renewable energy/FiT Program guidelines consistent with the language found in the requested Ordinance.  

 

Fiscal Impact Statement: The City Administrative Officer reports that there is no General Fund impact. Approval of the proposed Resolution and Ordinance authorizes additional expenditures of up to $11.9 million per year for the first incremental increase to the FiT Program. Funding is provided in the LADWP’s Fiscal Year 2019-20 Adopted Budget within the Power Revenue Fund's Fuel and Purchased Power Budget line item. The proposed action complies with LADWP’s Financial Policies.

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

PRESENT and ADOPT the accompanying ORDINANCE dated November 20, 2019, amending Section 10.5.2 of the LAAC increasing the Board’s authority to enter into contracts for the purchase of local renewable energy from 150 megawatts (MW) to 450 MW, lowering the cap on the average purchase price from $300 per MW- hour to $250 per MW-hour, and increasing the facility effective capacity limit from 3 to 10 MW, including the following:

  1. The purchase price cap of $250 per MW-hour shall apply to the initial 200 MW of capacity (150 MW of previously authorized capacity and 50 MW of expanded program capacity) excluding projects already completed or in process of being completed under the existing feed-in tariff program.

  2. The remaining 250 MW of capacity authorized by Subsection (1)(b) of Section 10.5.2 of the LAAC shall be subject to a review conducted by the Los Angeles Department of Water and Power to determine and recommend any necessary amendment to the purchase price cap set forth in Subsection (1)(c) of Section 10.5.2 of the LAAC.

 

Fiscal Impact Statement:  None submitted by the City Attorney.  Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.

CONTINUED CONSIDERATION OF COMMUNICATION FROM THE CITY ATTORNEY and ORDINANCE FIRST CONSIDERATION relative to amending Chapter 68 of the Los Angeles Administrative Code (LAAC) to retitle and update the special trust fund for the City’s Sidewalk and Park Vending Program and to amend Los Angeles Municipal Code (LAMC) Section 42.13 to retitle the City’s vending program and specify the graduated permit fee amount.

 

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

PRESENT and ADOPT the accompanying ORDINANCE, dated November 7, 2019, amending Chapter 68 of the LAAC to retitle and update the special trust fund for the City’s Sidewalk and Park Vending Program and to amend LAMC Section 42.13 to retitle the City’s vending program and specify the graduated permit fee amount.

 

Fiscal Impact Statement: None submitted by the City Attorney. Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.
