CONSIDERATION OF PROTESTS, CATEGORICAL EXEMPTION and PUBLIC WORKS AND GANG REDUCTION COMMITTEE REPORT relative to the vacation of a portion of the easterly side of Western Avenue and a portion of the westerly side of Oxford Avenue both southerly of 8th Street, VAC-E1401353 (Vacation).

 

Recommendations for Council action:

 

  1. CONSIDER protests relative to the proposed Vacation.

  2. FIND that the Vacation is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines.

  3. FIND that the street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of-way indicated below and shown on the map of the August 20, 2019 City Engineer report, attached to the Council file:

    A 7-foot wide and variable width portion of the easterly side of Western Avenue between 8th Street and approximately 75 feet southerly thereof; also, a 1.5-foot wide and variable width portion of the westerly side of Oxford Avenue between 8th Street and approximately 85 feet southerly thereof.

  4. FIND that there is a public benefit to the Vacation. Upon vacation of the street, the City is relieved of its ongoing obligation to maintain the street. In addition, the City is relieved of any potential liability that might result from continued ownership of the involved street easements.

  5. FIND that the Vacation is in substantial conformance with the purposes, intent and provisions of the General Plan, in conformance with Section 556 of the City Charter.

  6. FIND that the Vacation is not necessary for non-motorized transportation facilities, in conformance with Section 892 of the California Streets and Highways Code.

  7. FIND that the Vacation is not necessary for present or prospective public use, in conformance with Section 8324 of the California Streets and Highways Code.

  8. ADOPT the said City Engineer's report with the conditions contained therein.

 

Fiscal Impact Statement: The City Engineer reports that the petitioner has paid a fee of $14,980 for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC). Any deficit fee to recover the cost pursuant to Section 7.44 of the LAAC will be required of the petitioner. Maintenance of the public easement by City forces will be eliminated.

HOMELESSNESS AND POVERTY COMMITTEE REPORT relative to Proposition HHH Permanent Supportive Housing Loan Program Commitments for Fiscal Year 2018-19, Round 3 Call For Projects.

 

Recommendations for Council action:

 

  1. AUTHORIZE the Los Angeles Housing and Community Investment Department (HCIDLA) to issue letters of commitment for each of the projects identified in Table 2A of the September 9, 2019, Proposition HHH Administrative Oversight Committee (AOC) report, attached to the Council file. The recommended projects are the result of the 2018-19 Call for Projects Round 3, and are subject to the following conditions:

    1. The final Proposition HHH Permanent Housing Loan Program financial commitment will not exceed $238,120,946, per the breakdown of projects listed in Table 2A and summarized on Table 4 of the September 9, 2019, Proposition HHH AOC report, attached to the Council file, including a commitment of $7 million for the project proposed as the result of a Request for Proposals to identify a developer for the City- owned site at 11010 Santa Monica Boulevard.
                 
    2. The disbursement of Proposition HHH Permanent Housing Loan Program funds will not take place until a project sponsor is able to obtain enforceable commitments for all proposed project funding, including, but not limited to, the full amount of funding and/or tax credits proposed in the Call for Projects application.

    3. Proposition HHH Permanent Housing Loan Program financial commitments are conditional upon passing HCIDLA's background check process, including a legal review.

    4. Withhold the Florence Avenue Apartments and Sola at 87th, for further consideration for a maximum of four weeks for community outreach.

Recommendations for Council action:

 

  1. AUTHORIZE the General Manager, Los Angeles Housing and Community Investment Department (HCIDLA), or designee, to enter into a Memorandum of Understanding (MOU), subject to the approval of the City Attorney, for each of the proposals with specific amounts not to exceed those identified in Table 2 of the September 9, 2019, Prop HHH Administrative Oversight Committee (AOC) report, attached to the Council file. The recommended projects are subject to Council approval with the following conditions:

    1. The total Prop HHH Challenge MOU financial commitment will not exceed $120 million, per the breakdown of proposals listed in Table 2 of the September 9, 2019, AOC report, attached to the Council file.

    2. The disbursement of HHH funds will not take place until a lead developer obtains site control and enforceable commitments for all proposed project funding, including but not limited to, the full amount of funding and/or tax credits proposed in the Request for Proposal (RFP) application.

    3. Changes to the MOU amounts are subject to Council approval.

  2. INSTRUCT the General Manager, HCIDLA, or designee, to make any necessary adjustments to the standard HHH loan Program, including but not limited to the items below, and subject to Council approval of the financial commitment and related loan documents:

    1. Mercy/LAFH/Abode’s proposed use of a portion of their funding award ($5 million out of $40 million) as a short term Revolving Construction Loan Fund (RCLF) including but not limited to entering into an inter-creditor agreement with a RCLF administrator (see Staff Report, attached to the Council file,  for additional terms).

    2. Daylight’s proposal contemplates creating two Tranched (Tranch A and B) loans for each of their three proposed projects (see Staff Report, attached to the Council file,  for additional terms).

  3. AUTHORIZE the General Manager, HCIDLA, or designee, to negotiate and execute MOU agreements with the recommended proposers with terms acceptable to HCIDLA, subject to the approval of the City Attorney as to form.

  4. INSTRUCT the General Manager, HCIDLA, or designee, with assistance from the City Attorney, to negotiate project-specific financial commitments and related documents with terms acceptable to HCIDLA, including but not limited to loan agreements, loan security documents, subordination agreements, disposition and development agreements, and agreements governing project affordability requirements and report to Council for approval within 180 days for those projects that have secured site control.

  5. INSTRUCT the HCIDLA and the City Administrative Officer (CAO) to report on the 2020-21 Project Expenditure Plan to fund HHH Challenge projects once a project has reached funding readiness.

  6. INSTRUCT the General Manager, HCIDLA, to report to Council with bimonthly updates on the Challenge proposals.

  7. INSTRUCT the General Manager, HCIDLA, and CAO to transmit all Challenge-related actions directly to Council.

  3. AUTHORIZE the Controller and the City Administrative Officer (CAO) to correct any clerical errors or make necessary technical corrections subsequent to City Council approval.

 

Fiscal Impact Statement:  The CAO reports that the annual ongoing cost is $11.82 million after the implementation of all of the salary adjustments.  This includes $8.23 million in general salary adjustments, $0.86 million in special adjustments, and $2.73 million in pension costs.  In addition, there is a one-time non-pensionable payment of $1.25 million in 2019-20.

An additional contribution of $900,000 was provided by BOS from the Sewer Operations and Maintenance Fund ($450,000) and the Solid Waste Resources Revenue Fund ($450,000), which has already been appropriated within the General City Purposes Fund.
