- DETERMINE that the Project, consisting of graffiti abatement services and improvements including, but not limited to, the removal of existing graffiti, anti-graffiti protection and the installation of murals is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to the Section 15301 of the State CEQA Guidelines. The Project is also exempt under the City CEQA Guidelines Article III, Class 1(4).
- APPROVE up to $66,000 in taxable, and $434,000 in tax-exempt, CRA/LA EBP for a combined total of $500,000 available to Council District 7 from the Pacoima/Panorama City Redevelopment Project Area to be utilized for the Project.
- AUTHORIZE the Board of Public Works (BPW), Office of Community Beautification (OCB) to be the implementing department for activities related to the Project.
- REQUEST the BPW to approve, negotiate and execute contracting documents as required with Northeast Graffiti Busters, Contract No. C-122617 to effectuate the Project subject to the approval of City Attorney as to form no later than September 30, 2019.
- INSTRUCT the OCB to transmit copies of all executed contract(s) under the Project to the Economic and Workforce Development Department (EWDD).
- INSTRUCT the OCB to file a CEQA Notice of Exemption with the City Clerk and Los Angeles County Clerk upon Council approval.
- INSTRUCT the OCB to expend the EBP appropriation no later than December 31, 2024.
- INSTRUCT the OCB to report on its work accomplishments to the City Administrative Officer (CAO), and fund expenditures to the EWDD, on a quarterly and as-needed basis.
- AUTHORIZE the Controller, subject to the availability of funds and a duly executed and encumbered contract, to expend up to $66,000 from the EBP Fund No. 57D, Account No. 22L9MT, Pacoima/Panorama City Taxable Series 2006-B, and $434,000 from EBP Fund No. 57D, Account No. 22L9MN, Pacoima/Panorama City Tax-Exempt Series 2006-C, for activities related to the Project upon presentation of proper documentation by OCB, and satisfactory review and approval of the EWDD in accordance with the terms and conditions of the Bond Expenditure Agreement.
- AUTHORIZE the Interim General Manager, EWDD, or designee, to prepare Controller instructions and/or make technical adjustments that may be required and are consistent with this action, subject to the approval of the CAO; and, AUTHORIZE the Controller to implement these instructions.
Fiscal Impact Statement: The CRA/LA Bond Oversight Committee reports that
there is no impact on the City’s General Fund from the proposed appropriation of CRA/LA EBP. The CRA/LA EBP Fund No. 57D is funded solely from two transfers of approximately $86 million in pre-2011 tax allocation bond proceeds from CRA/LA to the City. Said transfers have been deposited with the Controller.

Fiscal Impact Statement: The CAO reports that the 2019-20 LAFD Adopted Budget includes funding in the amount of $4,022,163 in the Contractual Services Account. There is no additional impact to the General Fund. The estimated cost for the five-year extension is $20,519,570. For Fiscal Year 2019-20, the anticipated cost for helitanker services is $4,022,400 for the minimum 150-day stand-by service rate and standard 10 flight hours. Costs in excess of the budgeted amount will be supported through savings. Funding for subsequent years is contingent upon available funding through the annual budget process. This agreement is consistent with the City's Financial Policies in that ongoing revenues will be used to support these services.

The 2017-18 Year-end Financial Status Report included a re-appropriation in the amount of $129,910 to the Department's Fiscal Year 2018-19 Contractual Services Account and there is also an additional $375,000 that is provided in the Fiscal Year 2019-20 Proposed Budget. The Department plans to absorb any potential shortfalls through savings in its other Contractual Services line items. Execution of this contract complies with the City's Financial Policies in that contract expenditures will be limited to the use of approved budgeted funds.
