  1. APPROVE and AUTHORIZE the General Manager, Personnel Department, to execute the proposed First Supplemental Agreement to Professional Services Agreement C-127171 with Mercer, subject to City Attorney approval as to form, to:

    1. Extend the term two additional years resulting in a five year term effective July 1, 2015 through June 30, 2020.

    2. Increase the expenditure authority by $379,000 providing for a not to exceed total of $649,000.

  2. INSTRUCT the Personnel Department to work with the City Ethics Commission (CEC) to ensure that Mercer submits current documents for compliance with the applicable contracting requirements prior to executing the Agreement including the Bidder Certification CEC Form 50 and Prohibited Contributors (Bidders) CEC Form 55.

 

Fiscal Impact Statement:  The City Administrative Officer reports that there is no impact on the General Fund.  Contractual services supporting the Deferred Compensation Plan and Pension Savings Plan are paid by third party administrators and funded by participant fees, in accordance with Los Angeles Administrative Code Division 4, Section 4.1407(f) and Section 4.1610(a), respectively.  Approval of the proposed Agreement complies with the City's Financial Policies as sufficient funds are available to support the proposed expenditures in the Agreement.

PERSONNEL AND ANIMAL WELFARE COMMITTEE REPORT relative to proposed Second Amendment to Contract No. C-126901 with the Amanda Foundation for a mobile spay/neuter clinic.

 

Recommendation for Council action:

 

AUTHORIZE the General Manager, Department of Animal Services (DAS), or designee, to execute the Second Amendment to Contract No. C-126901 with the Amanda Foundation for the operation of a spay and neuter clinic from December 17, 2018 through December 16, 2019 for an amount not to exceed $500,000, subject to the review and approval by the City Attorney as to form.

 

Fiscal Impact Statement:  The City Administrative Officer (CAO) reports that approval of the recommendation contained in the February 15, 2019 CAO report, attached to the Council file, will have no impact on the General Fund.  Funding for this contract is provided off-budget through the Animal Sterilization Trust Fund (Fund), which includes a $425,000 appropriation in the 2018-19 Adopted Budget and an additional $425,000 provided in the Unappropriated Balance.  The Fund is administered by the General Manager, DAS, in accordance with Los Angeles Administrative Code Section 5.199. Execution of the proposed agreement complies with the City’s Financial Policies in that budgeted funds are used for intended purposes.

INFORMATION, TECHNOLOGY, AND GENERAL SERVICES and BUDGET AND FINANCE COMMITTEES' REPORT relative to the development and operation of the Los Angeles Street Civic Building (LASCB) located at 150 North Los Angeles Street.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. APPROVE the Revised Fiscal Year (FY) 2017-18 and 2018-19 Budget for the Demolition and Pre-Design Component of the LASCB Project and increase $2,554,567 from $21,000,000 to $23,554,567 in order to accommodate the pace of demolition activities and actual costs incurred.

  2. REAUTHORIZE the use and issuance of $2,554,567 in Municipal Improvement Corporation of Los Angeles (MICLA) Commercial Paper and INCREASE appropriations in MICLA Fund No. 298, Account No. 50NTCD, titled Los Angeles Street Civic Center Building/Parker Center Demo Project.   

  3. RECOGNIZE that the overall conceptual budget of up to $32,300,000 for the project and anticipated December 2019 completion for demolition date remains unchanged.

  4. DIRECT the City Administrative Officer (CAO) to make any technical corrections as needed in order to carry out the intent of the Council.

 

Fiscal Impact Statement:  The Municipal Facilities Committee (MFC) reports that approval of the recommendation for additional MICLA funds will have an impact on the General Fund, however, this impact will not result in an increase of the already approved conceptual total budget, as funding anticipated for FY 2019-20 to complete the project will be commensurately reduced to $8,745,433.

 

Debt Impact Statement: The MFC reports that based on the CAO's analysis, the issuance of MICLA Bonds is a General Fund obligation. This reauthorization of MICLA for an additional $2,554,557 from $21,000,000 to $23,554,567 for the demolition and pre-design component of the LASCB Project would cause the City to borrow a total of $23,554,567 at an approximate 5.5 percent interest rate over 20 years. The total estimated debt service is $39,420,000, including interest of $15,860,000. During the life of the bonds, the estimated average annual debt service is $1,970,000 over 20 years.

  1. REAFFIRM the Personnel Department’s role as the lead agency for Equal Employment Opportunity (EEO) policy and complaint resolution, specifically as it relates to monitoring policy compliance and investigating and resolving complaints of discrimination, harassment, and retaliation.

  2. APPROVE and AUTHORIZE the Personnel Department to undertake the following actions as detailed in the April 10, 2019 Personnel Department report, attached to the Council file, except as otherwise noted, subject to consultation with the City's labor partners as appropriate:

    1. Policies:

      1. Update the City’s Discrimination Free Workplace Policy Resolution with current protected bases and references to federal, state and local policies and submit to Council for adoption.

      2. Create a comprehensive Citywide Harassment and Discrimination-Free Workplace Policy that simplifies and consolidates existing harassment, discrimination, and other related policies, addresses acts of bullying and hazing to the greatest extent feasible and ensures continued compliance with state and federal laws

      3. Ensure all policies are written in clear, concise, and plain language.

      4. Consistent with the California Code of Regulations, establish an affirmative responsibility for supervisors to report all potential violations of the new Harassment and Discrimination Free Workplace Policy to the Personnel Department and to take appropriate action to correct and eliminate harassment and discrimination in the workplace.

      5. Incorporate into the Harassment and Discrimination Free Workplace Policy a provision that each Department head ensures that supervisors report violations of this Policy and take appropriate action (counseling, retraining, or discipline) against any supervisor who fails to report policy violations.

      6. Develop a policy that provides for retraining or counseling of parties involved in incidents of harassment and discrimination where applicable and appropriate (for less severe or complex cases of harassment and discrimination).

      7. Update disciplinary policies (Section 33, Policies of the Personnel Department) with supervisory standard for failure to report potential policy violations and guidelines for offense(s) and suggested action(s), subject to approval by the Board of Civil Service Commissioners.

      8. Develop strategies that encourage all employees to report potential violations of the Harassment and Discrimination Free Workplace Policy.

      2. Establish guidelines and criteria, and incorporate a protocol, for referring complaints received by the Personnel Department centralized intake unit to entities for investigation.

      3. Establish guidelines for the centralized intake unit in closing out investigations of all incidents.

      4. Ensure a fair, neutral process by creating independent review panel(s) comprised of impartial members with expertise in human resources practices and employment law who can be called upon to review certain complex or sensitive cases and provide recommendations.

      5. Establish guidelines for independent review panel(s) to include:

        1. Authority, jurisdiction, and responsibility.

        2. Protocols for the referral and review of investigations and submission of recommendations to Department heads.

        3. Protocols to address cases where the Panel and Department heads disagree with the findings of an investigation and/or a recommendation for discipline.

      6. Establish guidelines for Department heads to include:

        1. Protocols for interaction of Department head, or designee, with the panel.

        2. Guidelines for department response to panel recommendations.

        3. Protocols for reporting actions taken in response to panel recommendations.

      7. Standardize on-boarding processes across all Departments; allow time for new employees and volunteers to review the City’s policies; and require new employees and volunteers to confirm that they have read and understand the City’s policies and procedures.

        1. Key skills required in effectively resolving interpersonal conflicts and intervening incidents of harassment and discrimination.

        2. Retaliation prevention training

        3. City policies, and employee rights and responsibilities relating to harassment and discrimination

        4. Supervisory and leadership-level responsibilities relating to harassment and discrimination.

      2. Develop a suite of 30-60 minute training modules to be taken over time, with the goal of establishing mandatory training requirements for all full-time and part-time City employees.

      3. Recommend to Department heads that they require specific training modules (not to exceed two hours) be completed by all employees as a condition of passing probation following their initial appointment to City service.

      4. Work with the Board of Civil Service Commissioners to include appropriate training modules as a minimum eligibility requirement for civil service examinations, including more extensive training modules for supervisory classifications.

      5. Ensure that all training records are consistently documented in the Citywide training platform as a risk management mitigation tool.

      6. Develop training materials for a variety of circumstances and on a variety of topics to make it easy for departments to customize them and roll them out to staff, including:

        1. A toolbox of short and simple training curricula for supervisors to deliver during staff, tailgate, and roll call meetings.

        2. Regular email communications that can be sent by City leadership that include information on preventing and responding to incidents of harassment and discrimination, and on creating and maintaining a civil workplace.

        3. Content that is Department and job specific; tailoring examples to meet a wide variety of work environments; and scenarios that speak to the highest liabilities the City incurs.

        4. Content that is easily understandable and appropriate to the varying literacy and language abilities of city employees, and where possible delivered in different formats and languages.

        5. Specific in-person and video trainings for part-time and volunteer staff who currently do not have access to the City’s online training platform, with the aim of ensuring these staff have access to high quality training materials that meet their unique needs.

        6. Establish training and guidelines for supervisors to address harassing, discriminating, and retaliating conduct in the workplace.

        7. Curriculum should be curricula consistent with the rest of the recommendations and where possible, make training videos and curriculum available for use by other organizations in order to make it easier for them to prevent harassment and discrimination in their own workplaces.

    4. Technology:

      1. Develop a user-friendly reporting system that reduces barriers to reporting incidents.

      2. Develop a resource hub for all staff to learn about their rights and responsibilities relating to harassment and discrimination.

      3. Develop a case management system that allows for timely and effective investigation and resolution of complaints.

      4. Where possible make the code for elements of MyVoiceLA.org open source, so that other organizations may use it to build their own reporting system and resource hub.

      5. Update MyVoiceLA to include the following elements:

        1. Streamlined complaint form
