    That petitioner make satisfactory arrangement with the Bureau of Engineering, Real Estate Group (BOE) with respect to the payment of the document recording fee.

  3. PRESENT and ADOPT the accompanying ORDINANCE, dated August 8, 2018, authorizing the quitclaim of an easement for sanitary sewer, lying on 3780 West Martin Luther King Jr Boulevard, northeasterly of Santa Rosalia Drive and easterly of Buckingham Road.

PERSONNEL AND ANIMAL WELFARE AND BUDGET AND FINANCE COMMITTEES' REPORT relative to the Los Angeles Department of Building and Safety (LADBS) 2018-19 interim budget request.

 

Recommendations for Council action:

 

  1. RECEIVE and FILE the request from the LADBS for interim position authorities to address ongoing workload and support for various inspection, engineering and technology divisions.

  2. DIRECT the City Administrative Officer (CAO) to address the LADBS funding reimbursements from the Department of City Planning needed to support the Monitoring, Verification and Inspection Program for 2018-19 in a future Financial Status Report.

  3. DIRECT the LADBS, with the assistance of the CAO, to evaluate the utilization of 120-day authorities and other administrative remedies, including substitute authorities, to address operational needs in the current fiscal year.

  4. CONSIDER the LADBS requests in connection with additional staffing for electrical inspection, fire sprinkler inspection, structural plan check, internal auditing, and graphics design as part of the 2019-20 budget development process.

 

Fiscal Impact Statement:  The CAO reports that there is no impact to the General Fund.  The recommendations contained in the February 11, 2019 CAO report, attached to the Council file, comply with City Financial Policies in that the recommended actions are fully supported by special finds and existing budgetary appropriations.

Recommendations for Council action, as initiated by Motion (Blumenfield - Harris-Dawson), SUBJECT TO THE APPROVAL OF THE MAYOR:

  1. DETERMINE the Bridge Housing Project on 7621 Canoga Avenue, which allows the development and use of the property as a temporary shelter, is categorically exempt from the provisions of the. California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Article 19, Sections 15301, Class 1(a)(b), 15303, Class 3(d)(e), and the City of Los Angeles CEQA Guidelines, Article Ill, Section 1, Class 1(1)(2) and Class 3(5)(6), as set forth in the Notice of Exemption, attached to the Council file.

  2. APPROVE funds in an amount up to $4,300,000 to support the purchase of a building at 7621 Canoga Avenue, Los Angeles, CA 91304, to establish a bridge housing facility. Funds to be appropriated from the Homeless Emergency Aid Program Grant Fund No. 60P/10, AC-1 - Capital and Operating Support.
           
  3. APPROVE the conditional grant of $4,300,000 to the County of Los Angeles (County) for the purpose of assisting in the acquisition of certain real property located at 7621 Canoga Avenue; and, AUTHORIZE the City Administrative Officer (CAO), with the assistance of the City Attorney, to negotiate and execute contracts, covenant/regulatory agreements, and any other documents necessary to implement the conditional grant in the amount of $4,300,000 to the County for the purpose of assisting in the acquisition of certain real property located at 7621 Canoga Avenue.

  4. AUTHORIZE the Controller to appropriate the amount of $4,300,000 within Homeless Emergency Aid Program Grant Fund No. 60P/10, AC-1 - Capital and Operating Support to develop Crisis and Bridge Housing in Council District Three.
                   
  5. DIRECT the CAO to prepare any additional Controller instructions or make any necessary technical adjustments consistent.

HOMELESSNESS AND POVERTY COMMITTEE REPORT relative to a shelter crisis declaration and a request for an Ordinance to align the Los Angeles City Municipal Code (LAMC) Sections 12.80 and 12.81 with State Government Code Section 8698, and ensure that the LAMC is not in conflict with existing State and local laws or regulations.

 

Recommendations for Council action, as initiated by Motion (O'Farrell - Harris-Dawson):

 

  1. RESOLVE to pursue the development of temporary homeless shelters under Government Code Section 8698.4.  The City affirms that the same conditions which gave rise to the City's declaration of the shelter crisis pursuant to Government Code Section 8698.4 last year continue to exist - specifically, that the number of homeless people who need shelter significantly outnumbers the shelter beds that are available to them, despite the City's notable efforts to develop temporary homeless housing.  Thus the City remains in a shelter crisis, as defined by Government Code Section 8698, et seq.

  2. REQUEST the City Attorney, with the assistance of the Planning Department to prepare and present an Ordinance that would align the LAMC with State Government Code Section 8698 relative to the shelter crisis declaration, to ensure that the LAMC is not in conflict with existing State and local laws or regulations, and take effect on or before April 17, 2019.

  2. INSTRUCT the City Homeless Coordinator to coordinate with Los Angeles County to identify funds for operations at the site, including, but not limited to, State funding and County Measure H, if the property is determined to be suitable for development as a Crisis and Bridge Housing Program facility.

TRANSPORTATION COMMITTEE REPORT relative to providing safe bicycle connections to the Los Angeles River Path.

 

Recommendations for Council action:

 

  1. INSTRUCT the Bureau of Engineering to report with recommendations to ensure that all major capital projects in the vicinity of the Los Angeles River, including bridge projects and new segments of the Los Angeles River Path, are designed to safely accommodate all legal road users and to provide connections to the City’s bicycle network.

  2. INSTRUCT the Department of Recreation and Parks, in consultation with the Los Angeles Department of Transportation (LADOT), to report to the Public Works and Gang Reduction and Transportation Committees with recommendations for providing safe and convenient bicycle connections between the Los Angeles River Bike Path and Griffith Park.

  3. RECEIVE and FILE LADOT report dated February 27, 2019 relative to providing safe bicycle connections to the Los Angeles River Path.

In addition, the contracts contain a Financial Liability Clause which limits the City’s financial obligation to the amount approved by the Mayor and Council. The above recommendation complies with the City's Financial Policies as project funding will be used to support project expenditures.
