PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to affordable housing and labor standards as related to implementation of Measure JJJ.

 

Recommendations for Council action:

 

  1. APPROVE the Bureau of Contract Administration (BCA) recommendations in the report dated June 6, 2018 (attached to the Council file).

  2. INSTRUCT the BCA as the lead, with the assistance of the City Attorney, the Los Angeles Department of Building and Safety (LADBS) and the Department of City Planning (DCP), to prepare and present an Ordinance for the administration of projects subject to Measure JJJ, and in consultation with the City Administrative Officer (CAO) and the Chief Legislative Analyst (CLA) to include the following:

    a.  Authorizing the use of the State of California Prevailing Wage Rates as determined by the Office of Policy, Research and Legislation as the appropriate wage rates to be paid to all workers employed on any project awarded subject to Measure JJJ, and in lieu of an advertised date, the date of the developer's first submittal of a proposal for a project will be used to ascertain the appropriate prevailing wage determination.
     
    b.  Applying the Processes and Procedures prepared by the BCA to be utilized as the Bureau's administrative and enforcement guidelines, which are consistent with existing policies and procedures employed by the BCA, in its enforcement of state and federal prevailing wage rates and the City's Project Labor Agreements, which include the imposition of penalties, identified in the Proposed JJJ Penalty Chart presented by the BCA, in the event of non-compliance with any of the labor standards mandated by the measure.
     
    c.  Authorizing the BCA, in coordination with the CAO, to hire one Management Analyst for the purpose of administering the requirements on Measure JJJ.

    d.  Authorizing the BCA, in coordination with the LADBS, to not provide clearance for any Certificate of Occupancy for a project until it has been determined that the project has satisfied the labor requirements of Measure JJJ, or until the developer has created an Escrow Account in an amount to be determined by the BCA.
                                    
    e.  Authorizing the BCA to provide status updates during the construction of a project, at the hallway and 3/4 points, to determine compliance.

      
    f.  Requiring the developer to submit a fee or other funding mechanism to compensate the Bureau for its administrative and monitoring costs, with this submission being done at the time of, and in no event later than, the issuance of the first building permit for each project which is subject to Measure JJJ.
      
    g.  Identifying a fee to implement BCA oversight utilizing the Processes and Procedures, and a fund where such fee would be deposited.
     
    h.  Allowing the BCA, in coordination with the CAO, to identify the funds, either in an Escrow Account or the General Fund, where the fees associated with oversight shall be deposited.
     
  3. RECEIVE and FILE the DCP report dated June 6, 2018 (attached to the Council file), inasmuch as the report is provided for informational purposes.

Recommendation for Council action, pursuant to Motion (O'Farrell - Huizar):

 

INSTRUCT the Department of City Planning (DCP), in consultation with the City Attorney, to report within 30 days, on the impact of the Community Redevelopment Agency/LA, A Designated Local Authority (CRA/LA-DLA) June 27, 2018 Memorandum, indicating that six City Redevelopment Plans have land use limitations that potentially detrimentally affect 25 development projects in Redevelopment Project areas, because they conflict with Measure JJJ's TOC Incentives, and to provide: 1) an update on the status of 25 TOC projects; 2) information as to what development project applicants have been informed by staff regarding their filed applications or those filing applications; and 3) information as to any communication, if any, that has occurred between the DCP and CRA/LA-DLA as to the land use impacts/ramifications of the Memorandum.

Mackey, Little Wood Landing, LLC; and Mark Tarczynski and THEREBY SUSTAIN the decision of the CLAAPC in approving MND No. ENV-2015-3927-MND as the environmental clearance for a Project Permit Compliance, Project Permit Adjustment and Conditional Use Permits, subject to Conditions of Approval, for the demolition of an existing surface parking lot and construction of a unified, mixed-use development comprising of a 36-story, 402,939 square-foot, mixed-use building containing 422 residential dwelling units and approximately 5,597 square feet of ground floor commercial retail uses and a portion of the apartment building in Site A and a seven-story, 71,571 square-foot hotel with 126 guest rooms and ground floor retail uses in Site B, for the properties located at 675-685 South Bixel Street; 1111 West 7th Street; and 1112-1142 West Ingraham Street.

 

Fiscal Impact Statement:  The CLAAPC reports that there is no General Fund impact as administrative costs are recovered through fees.

COMMUNICATION FROM THE CITY ENGINEER relative to initiating vacation proceedings for the northeasterly side of Barrington Avenue between Santa Monica Boulevard and Idaho Avenue (VAC-E1401336).

 

Recommendations for Council action:

 

  1. INITIATE vacation proceeding to vacate the northeasterly side of Barrington Avenue between Santa Monica Boulevard and Idaho Avenue as shown on the map attached to the City Engineer report to Council dated March 28, 2018, attached to the Council file, pursuant to California Streets and Highways Code, Division 9, Part 3, Public Streets, Highways and Service Easements Vacation Law.

  2. INSTRUCT the Bureau of Engineering to:

    1. Investigate the feasibility of this vacation request.

    2. Report to the Public Works and Gang Reduction Committee relative to the feasibility of vacating the requested area.

 

Fiscal Impact Statement: The City Engineer reports that a fee of $14,980 was paid by the petitioner for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC). Any deficit fee to recover the cost pursuant to LAAC Section 7.44 will be required of the petitioner.

COMMUNICATION FROM THE COMMUNITY REDEVELOPMENT AGENCY OF LOS ANGELES (CRA/LA) BOND OVERSIGHT COMMITTEE (BOC) relative to appropriating CRA/LA Excess Non-Housing Bond Proceeds (EBP) for the Destination Crenshaw Placemaking and Streetscape Improvements Project (Project).

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND that the action of appropriating and withholding expenditure of funds for the Project pending the completion, review and consideration of planning and environmental documents related to the Project is not a project pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(4) because it merely creates a funding mechanism or other government fiscal activity that does not commit the City to a project that may result in a potentially significant impact on the environment, and that preparing preliminary planning and environmental documents is not a project pursuant to CEQA Guidelines Section 15378(b)(5) because it is an administrative activity that will not result in physical changes in the environment.

  2. AUTHORIZE the Bureau of Engineering (BOE) to be the implementing department for Project.

  3. AUTHORIZE the Controller, subject to the requirements below and the availability of funds and duly executed and encumbered contract(s), to expend up to $1,234,138 plus all earned interests from the CRA/LA EBP Fund No. 57D, Account No. 22L9DT, Crenshaw Slauson Taxable Series 2002A and 2007B, for activities related to the Project upon presentation of proper documentation from the BOE and satisfactory review by the Economic and Workforce Development Department (EWDD) in accordance with the terms and conditions of the Bond Expenditure Agreement.

  4. AUTHORIZE the BOE to perform limited preliminary planning as may be necessary to conduct the environmental review for the Project from the above-noted funds appropriated to the Project.

  5. INSTRUCT the BOE to withhold expending, or committing to expend, any of the remainder of the above-noted funds appropriated to the Project until all of the following have occurred:

    1. The BOE has completed the preliminary planning documents and environmental review documents.

    2. The City has complied with the requirements of the CEQA with respect to the Project, including obtaining any necessary CEQA clearances.

    3. The Board of Public Works has considered and approved the Project for expenditure of the remaining funds.

  6. INSTRUCT the BOE to report on its work accomplishments to the City Administrator Officer (CAO), and fund expenditures to the EWDD, on a quarterly and as-needed basis.

  7. AUTHORIZE the Interim General Manager, EWDD, or designee, to prepare Controller instructions and/or make technical adjustments that may be required and are consistent with this action, subject to the approval of the CAO; and, AUTHORIZE the Controller to implement these instructions.

 

Fiscal Impact Statement: The CRA/LA BOC reports that there is no impact on the City’s General Fund from the proposed appropriation of $1,234,138 in CRA/LA EBP. The CRA/LA EBP Fund No. 57D is funded solely from transfers of approximately $86 million in pre-2011 tax allocation bond proceeds from CRA/LA to the City (Council file Nos. 14-1174 and 14-1174-S36). Said transfers have been deposited with the Controller.

Shaw Wetland Park in Council District 6.

  2. RESOLUTION (MARTINEZ - HARRIS-DAWSON) relative to establishing the City's position regarding a proposed Measure A Expenditure Plan in a report entitled Proceedings of the Measure A Implementation Steering Committee.

 

Recommendations for Council action, SUBJECT TO THE CONCURRENCE OF THE MAYOR:

 

  1. RESOLVE to include in the City's 2019-2020 State Legislative program support for any legislation or administrative action by the Los Angeles County Board of Supervisors that will ensure that the Measure A Expenditure Plan proposed in the report entitled Proceedings of the Measure A Implementation Steering Committee commit at least 30 percent of funding from Competitive Grant Categories 3 and 4 to projects that not only serve High and Very-High Need study areas, but are also physically located within the study area to ensure maximum project benefits to the community and that the Board of Supervisors reject any interpretation in the Measure A Expenditure Plan that inaccurately calculates this 30 percent factor from a smaller subset of Categories 3 and 4 in a manner that reduces funding for these communities.

  2. RESOLVE that the County maintain the Technical Assistance Program's focus on High and Very High Need Study areas and include community based organizations and consultants with requisite experience in park development, community engagement and other relevant planning areas to build capacity and readiness in High Need and Very High Need communities among its pool of contracted TA providers.
