PERSONNEL AND ANIMAL WELFARE and BUDGET AND FINANCE COMMITTEES' REPORT relative to increasing the reimbursement rate for forensic evidentiary examinations.

 

Recommendations for Council action:

 

  1. AUTHORIZE and INSTRUCT the Personnel Department to:

    1. Increase the reimbursement rate for all completed sexual assault and child abuse victim forensic examinations from $730 to $1,020 per exam.

    2. Increase the reimbursement rate for all suspect forensic examinations from $200 to $1,020 per exam.

    3. Increase the reimbursement rate for incomplete forensic examinations from $200 to $300 per exam.

  2. INSTRUCT that the reimbursement rates for all forensic sexual assault and child abuse evidentiary examinations to be adjusted annually beginning in 2019-20 by the lesser of the Consumer Price Index (CPI) for medical care in the West Urban Area for the preceding 12 months or three percent, unless the CPI declines, in which case the rate shall remain unchanged.

  3. INSTRUCT the City Administrative Officer (CAO),  with the assistance of the Personnel Department, to monitor the fiscal impact of the revised reimbursement rate and to report to Council as part of the Financial Status Report (FSR) on ways to address any account shortages resulting from the revised reimbursement rate.

 

Fiscal Impact Statement:  The CAO reports that approval of the proposed increase to reimbursement rates for forensic evidentiary examinations is forecasted to increase annual expenditures by approximately $2.35 million resulting in a projected total annual expenditure of $3.75 million.  The General Fund impact of this increased cost in 2018-19 is anticipated to be $1.37 million.  The Personnel Department is directed to monitor its Contractual Services account and report any shortages in future FSRs which may include requests for additional General Fund appropriations to support the proposed reimbursement rates.  The source of the additional General Fund appropriations in 2018-19 will need to be identified in a future FSR and may include the Reserve Fund if no other sources are available.

ADMINISTRATIVE EXEMPTION and COMMUNICATIONS FROM THE BOARD OF HARBOR COMMISSIONERS AND THE CITY ADMINISTRATIVE OFFICER (CAO) relative to a Port of Los Angeles (POLA) Foreign Trade Zone (FTZ) General Purpose Operating Agreement with California Steel Industries, Inc.

 

Recommendations for Council action:

 

  1. ADOPT the determination by the Board of Harbor Commissioners that the proposed action is administratively exempt under the California Environmental Quality Act (CEQA) in accordance with Article II, Section 2(f) of the Los Angeles City CEQA Guidelines.

  2. APPROVE the POLA Resolution No. 18-8381 authorizing proposed FTZ General Purpose Operating Agreement No. 18-3611 with California Steel Industries, Inc., for the use of a steel producing facility, warehouse, and office space totaling approximately 360 acres located at FTZ Site No. 202, Site No. 55 at 14000 San Bernardino Avenue, Fontana.

Fiscal Impact Statement: The CAO reports that California Steel Industries, Inc., has paid the POLA a one-time application fee of $5,000. In addition, California Steel Industries, Inc., will pay an annual administrative fee of $10,000 per year or $50,000 for a one five-year contract term, and each subsequent five-year contract term. California Steel Industries, Inc., will have three additional renewal contract options, subject to approval by the Board, up to a total 20-year contract term. Total revenue amount may generate up to $205,000, including the $5,000 application fee, over the 20-year contract period. In Fiscal Year 2017-2018, the POLA incurred expenses of approximately $36,575 for FTZ-related consulting services and collected $344,746 in revenue from FTZ operators. The POLA provides FTZ sites as a service to its customers to promote international trade and commerce in the region.

ADMINISTRATIVE EXEMPTION and COMMUNICATIONS FROM THE BOARD OF HARBOR COMMISSIONERS AND THE CITY ADMINISTRATIVE OFFICER (CAO) relative to a Port of Los Angeles (POLA) Consent to Assignment and Assumption of Agreement with the General Electric Transportation Parts, LLC.

 

Recommendations for Council action:

 

  1. ADOPT the determination by the Board of Harbor Commissioners that the proposed action is administratively exempt under the California Environmental Quality Act (CEQA) in accordance with Article II, Section 2(f) of the Los Angeles City CEQA Guidelines.

  2. APPROVE the POLA Resolution No. 18-8394 authorizing the Consent to Assignment and Assumption of Agreement No. 17-3518 (Agreement No. 18-3518-A) formally and fully transferring contractual rights to General Electric Transportation Parts, LLC, from the General Electric Company for a common user, digitized informational data portal project at the Port of Los Angeles.

Fiscal Impact Statement: The CAO reports that approving the POLA's request for Agreement No. 17-3518 will formalize an internal re-organization of General Electric Company, which will include a change of control and transfer of all of its business operations, including assets and liabilities, from the General Electric Company to General Electric Transportation Parts to carry-out the POLA's data portal project. All other contractual terms and conditions will remain unchanged and will not result in additional financial expenditure.
