Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. HEAR PROTESTS against the proposed levying of the special assessment for the District’s 2018-2019 fiscal year, pursuant to Section 36524 of the California Streets and Highways Code.

  2. PRESENT and ADOPT the accompanying ORDINANCE, dated September 7, 2018, levying the special assessment for the District’s 2018-2019 fiscal year, if a majority protest, as defined by Section 36525 of the California Streets and Highways Code is found not to exist.

  3. APPROVE the Chatsworth Business Improvement District Advisory Board for the District’s 2018-2019 Fiscal Year.

  4. AUTHORIZE the City Clerk, subject to City Attorney approval, to prepare, execute and administer a contract between the City and the Chatsworth Business Improvement District Corporation, the nonprofit service provider for administration of the District.

 

Fiscal Impact Statement: The City Clerk reports that direct costs for Department administration of the District program for its 2018-2019 Fiscal Year will be recovered from the assessments collected. There are no assessments to be paid for City-owned properties located within the boundaries of the District. Therefore, there is no impact on the General Fund.

PERSONNEL AND ANIMAL WELFARE COMMITTEE REPORT relative to the 2018-22 Memorandum of Understanding (MOU) for the Airport Supervisory Peace Officers Unit (MOU 39).

 

Recommendations for Council action:

 

  1. ADOPT the June 24, 2018 through June 18, 2022 MOU 39, attached to the Council file.
           
  2. AUTHORIZE the City Administrative Officer (CAO) and City Controller to correct any clerical errors in the MOU, or if approved by the City Attorney, any technical errors.

 

Fiscal Impact Statement:  The  CAO reports that the proposed agreement will have no impact on the General Fund.  The Airports Department will fund all additional costs. The proposed MOU would increase costs to fund MOU 39 by no more than $650,000 in Fiscal Year (FY) 2018-19, $645,000 in FY 2019-20, $585,000 in FY 2020-21, and $795,000 in FY 2021-22.

BUDGET AND FINANCE COMMITTEE REPORT relative to approval for the Office of Finance (Finance) to execute a Fifth Amendment to Contract Nos. C-114826 and C-114564 with Wells Fargo Bank for City general banking services.

 

Recommendation for Council action:

 

AUTHORIZE the Director of Finance, or designee, to execute amendments to Contract Nos. C-114826 and C-114564 with Wells Fargo Bank for banking services, to extend the terms for an additional two years in one one-year increment and two six-month increments so long as all other terms and conditions remain the same, subject to final approval as to form and legality by the City Attorney.

 

Fiscal Impact Statement:  Finance reports that there is no fiscal impact to the General Fund. Funding was appropriated in the Finance's Fiscal Year 2018-19 Bank Service Fees Account (Department No. 39, Account No. 4040) and is available to pay for the services described in these amendments. Finance reviewed the proposed Fee Schedule and can maintain its bank service fees within the appropriation expenditure limits and will monitor the monthly service charges and report back to Council through the Financial Status Reports on any significant changes in the expenditures from Account No. 4040.

AUTHORIZE the Director of Finance, or designee, to execute the Supplemental Agreement to Contract No. C-125798 with ICE Data Analytics, LLC, formerly known as BondEdge Solutions, LLC, to extend the term for one year, from August 31, 2018 to August 30, 2019, and increase the expenditure authority by $196,272, from $728,820 to $925,092 over the five year term, subject to the review and approval of the City Attorney as to form.

  2. INSTRUCT Finance to ensure the necessary insurance documentation meeting the limits deemed appropriate by the City Administrative Officer's (CAO) Risk Manager has been submitted through KwikComply prior to executing the Supplemental Agreement.

Fiscal Impact Statement:  The CAO reports that Finance's 2018-19 Contractual Services Account includes funding for the Contract in the amount of $190,560. The 2018-19 cost of the Contract is $196,272. Finance reports that it will identify savings in the amount of $5,712 in other accounts to transfer to the Contractual Services Account to cover the total 2018-19 cost. Continuation of this agreement beyond 2018-19 is contingent on the availability and approval of funding by the City Council for such purpose. The recommendation is in compliance with the City's Financial Policies in that there is no additional General Fund impact.

CONTINUED CONSIDERATION OF MOTION (WESSON - ET AL. - HUIZAR - ET AL.) relative to adopting changes to the Rules of the Los Angeles City Council and its committees to prevent disruptions at Council and committee meetings.

 

Recommendation for Council action:

 

ADOPT, pursuant to Rule 77,  the following changes to the Rules of the Los Angeles City Council:

 

  1. Council Rule 7: Add the following as a separate paragraph to the end of Rule 7:

    A member of the public who disrupts and is removed from a Council or committee meeting shall be excluded from attending all Council and committee meetings for the remainder of that day. A member of the public who disrupts and is removed from a Council or committee meeting and who then disrupts and is removed from a Council or committee meeting on any of the next 3 business days shall be excluded from attending all Council and committee meetings for the remainder of that day and the following 3 business days. A member of the public excluded for the remainder of a day and the following 3 business days who then disrupts and is removed from a Council or committee meeting on any of the next 3 business days shall be excluded from attending all Council and committee meetings for the remainder of that day and the following 6 business days. A business day is every calendar day on which a Council and/or committee meeting is held.

  2. Council Rule 63: Add the following as a separate paragraph to the end of Rule 63:

    A member of the public who disrupts and is removed from a committee meeting shall be excluded from attending committee and/or Council meetings as provided by Rule 7.

 

(The Council may recess to Closed Session to confer with its legal counsel relative to the above matter based on a significant exposure to litigation, pursuant to Government Code Section 54956.9(d)(2) and (e)(4). (One potential case.))

 

(Pursuant to Council Rule 77, an affirmative vote of two-thirds of all members of the Council shall be necessary to amend these Rules.  Each proposed amendment shall be presented to the Council and then laid over one week before it can be adopted.)

MOTION (WESSON - ET AL. - HUIZAR - ET AL.) relative to adopting changes to the Rules of the Los Angeles City Council and its committees to prevent disruptions at Council and committee meetings, with these changes to be effective on January 1, 2019.

 

Recommendation for Council action:

 

ADOPT, pursuant to Rule 77 and in light of the facts and findings prepared by the City Attorney (attached to the Council file), the following changes to the Rules of the Los Angeles City Council, with these changes to be effective on January 1, 2019:

Disruptions

 

  1. Council Rule 7: Add the following to the end of Rule 7:

    A member of the public who disrupts and is ordered removed from a Council meeting or a Committee meeting shall be excluded from the remainder of that meeting.

    A member of the public excluded from a Council or Committee meeting who then disrupts and is ordered removed from any Council or Committee meeting later that day or during any of the following 3 business days shall be excluded from attending all Council and Committee meetings for the remainder of that day and for the following business day.

    A member of the public excluded from Council and Committee meetings for the following business day who then disrupts and is ordered removed from a Council or Committee meeting on any of the 3 business days immediately following the day of exclusion shall be excluded from attending all Council and Committee meetings for the remainder of that day and for the following 3 business days.

    A member of the public excluded from Council and Committee meetings for 3 business days who then disrupts and is ordered removed from a Council or Committee meeting on any of the 3 business days immediately following the third day of exclusion shall be excluded from attending all Council and Committee meetings for the remainder of that day and for the following 6 business days.

    A member of the public excluded from Council and Committee meetings for 6 business days who then disrupts and is ordered removed from a Council or Committee meeting on any of the 3 business days immediately following the sixth day of exclusion shall be excluded from attending all Council and Committee meetings for the remainder of that day and for the following 6 business days.


    A business day is every calendar day on which a Council and/or Committee meeting is held.

       
  2. Council Rule 63: Add the following as a separate paragraph to the end of Rule 63:

    A member of the public who disrupts and is ordered removed from a Committee meeting shall be excluded from attending Committee and/or Council meetings as provided in Rule 7.

 

(The Council may recess to Closed Session to confer with its legal counsel relative to the above matter based on a significant exposure to litigation, pursuant to Government Code Section 54956.9(d)(2) and (e)(4). (One potential case.))

 

(Pursuant to Council Rule 77, an affirmative vote of two-thirds of all members of the Council shall be necessary to amend these Rules.  Each proposed amendment shall be presented to the Council and then laid over one week before it can be adopted.)
