CATEGORICAL EXEMPTION and PUBLIC SAFETY COMMITTEE REPORT relative to the vacation approval for the T-shaped alley southerly of Washington Boulevard and easterly of Santa Fe Avenue.

 

Recommendation for Council action:

 

DISAPPROVE the following:

 

  1. Find that the street vacation proceedings, pursuant to the Public Streets, Highways and Service Easements Vacation Law, be initiated for the vacation of the public right-of-way shown in blue of Exhibit B of the Bureau of Engineering (BOE) report dated October 3, 2013, attached to the Council file, and that the limits of the vacation area be not be permitted to be adjusted based on the final alignment of the right-of-way of Santa Fe Avenue, as follows:

    The T-shaped alley southerly of Washington Boulevard and easterly of Santa Fe Avenue.

       
  2. Find that the vacation (No. VAC-E1401221) is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines.

  3. Find that there is a public benefit to this street vacation and upon vacation of the street, the City is not relieved of its ongoing obligation to maintain the street and any potential liability that might result from continued ownership of the involved street easement.

  4. Find that in conformance with Section 556 of the City Charter, the vacation is in substantial conformance with the purposes, intent and provisions of the General Plan.

  5. Find that in conformance with Section 892 of the California Streets and Highways Code, the vacation area is not necessary for non-motorized transportation facilities.

  6. Adopt the BOE report dated October 3, 2013, with the conditions contained therein.

 

Fiscal Impact Statement:  The BOE reports that the petitioner has paid a fee of $14,980 for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC).  Any deficit fee to recover the cost pursuant to Section 7.44 of the LAAC will be required of the petitioner.  Maintenance of the public easement by City forces will be eliminated.

AD HOC COMMITTEE ON COMPREHENSIVE JOB CREATION PLAN REPORT relative to a public bank framework and existing housing and economic development funding programs.

 

Recommendations for Council action:

 

  1. REQUEST and INSTRUCT as appropriate the Commission on the Status of Women and the Los Angeles Housing and Community Investment Department (HCIDLA) to evaluate and report on actions to improve the participation of unmarried female heads-of-households in banking.

  2. INSTRUCT the HCIDLA to report on actions to improve the participation of Black and Hispanic households, and households earning less than $75,000, in banking services.

  3. INSTRUCT the HCIDLA to reevaluate and report on development and implementation of a City Service Card Program that would offer debit card-type financial services.

  4. INSTRUCT the Economic and Workforce Development Department (EWDD) to report on the extension of BusinessSource Center services to support new businesses through financing and start-up.

  5. INSTRUCT the Office of Finance (Finance) to convene the Banking Development Districts Task Force and report within 180 days on options and actions necessary to form such districts.

  6. INSTRUCT Finance to report on the feasibility of including a requirement that banking services contractors provide no-cost public workshops regarding personal banking.

  7. INSTRUCT the Chief Legislative Analyst (CLA) to continue to monitor and report on State legislation concerning public banking; actions by governmental entities in other states concerning public banking; and, other legislative or regulatory actions related to public banking.

  8. INSTRUCT the CLA to report on the necessary steps for the City to work with established financial institutions as a conduit to provide banking services until such time as the City's proposed public bank could assume the provision of those services.

  9. INSTRUCT the EWDD to report on the feasibility of issuing a Request for Qualifications for financial institutions to partner with the City to provide loans to startup, small, minority-owned, and other businesses seeking capitalization, that would be prequalified through the City.

  10. INSTRUCT the HCIDLA to explore coordination with the Los Angeles Unified School District, Los Angeles Community College District, Los Angeles Public Library, and the FamilySource and Workforce Development system to expand financial literacy and financial coaching efforts, and determine how these efforts would be scaled.

  11. INSTRUCT the HCIDLA to report on integrating the City's transit hubs into a City Service Card Program, and incentivizing a commercial bank, either the City's proposed public bank or another bank, to site at those locations (similar to bank branches sited in grocery stores).

  12. INSTRUCT the CLA to meet with individuals or groups that promote the public banking concept to discuss solutions to the various hurdles to such a concept, and provide a report to the Committee on the meeting(s).

  13. INSTRUCT the CLA to explore the possibility of meeting with representatives of the Bank of North Dakota (Bank) to discuss the Bank's profitability and what actions the Bank took to insulate itself during the last economic downturn, and report to the Committee on the meeting.

Fiscal Impact Statement:  The CLA reports that there is no impact to the General Fund associated with the recommendations in this report.

Recommendations for Council action:

 

  1. FIND, based on the whole of the administrative record, that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15332 (Class 32 Infill Development), and there is no substantial evidence demonstrating that an exception to a CE pursuant to CEQA Guidelines Section 15300.2 applies.

  3. ADOPT the FINDINGS of the Central Los Angeles Area Planning Commission (CLAAPC) as the Findings of the Council.

RESOLVE TO DENY THE APPEAL filed by Abraham Soghomonian and Alex Kondracke, Concerned Citizens of Los Feliz, and THEREBY SUSTAIN the determination of the CLAAPC in approving Vesting Tentative Tract No. VTT-74730-SL-1A and its environmental clearance for the demolition of an existing two-story commercial building, subdivision of three lots comprising of 28,409 net square feet of lot area into 18 small lots, and construction, use and maintenance of a three-story, single-family dwelling with an attached two-car garage on each of the 18 subdivided lots, with four guest parking spaces to be provided, with the floor area of each dwelling ranging from 1,794 to 2,969 square feet, totaling 31,245 square feet for all 18 dwellings, and with the removal of three non-protected trees on the property and four non-protected street trees, with approximately 2,000 cubic yards of earth material to be exported, requiring a haul route approval, for the property located at 1710, 1718, 1720 North Berendo Street and 4765, 4767, 4773 West Hollywood Boulevard, subject to Conditions of Approval.

Recommendation for Council action:

 

ADOPT, pursuant to Rule 77,  the following changes to the Rules of the Los Angeles City Council:

 

  1. Council Rule 7: Add the following as a separate paragraph to the end of Rule 7:

    A member of the public who disrupts and is removed from a Council or committee meeting shall be excluded from attending all Council and committee meetings for the remainder of that day. A member of the public who disrupts and is removed from a Council or committee meeting and who then disrupts and is removed from a Council or committee meeting on any of the next 3 business days shall be excluded from attending all Council and committee meetings for the remainder of that day and the following 3 business days. A member of the public excluded for the remainder of a day and the following 3 business days who then disrupts and is removed from a Council or committee meeting on any of the next 3 business days shall be excluded from attending all Council and committee meetings for the remainder of that day and the following 6 business days. A business day is every calendar day on which a Council and/or committee meeting is held.

  2. Council Rule 63: Add the following as a separate paragraph to the end of Rule 63:

    A member of the public who disrupts and is removed from a committee meeting shall be excluded from attending committee and/or Council meetings as provided by Rule 7.
