Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND, pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15074(b), after consideration of the whole of the administrative record, including ND No. ENV-2016-2613-ND, and all comments received, there is no substantial evidence that the project will have a significant effect on the environment, that the ND reflects the independent judgment and analysis of the City; and, ADOPT the ND.
  2.  

  3. DETERMINE, that based on the whole of the administrative record, the project is exempt from CEQA pursuant to CEQA Guidelines Section 15332, an Exemption from CEQA for infill development, and there is no substantial evidence demonstrating that an exception to a categorical exemption pursuant to CEQA Guidelines Section 15300.2 applies.

  5. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of the Council.

PRESENT and ADOPT the accompanying ORDINANCE dated March 22, 2018, effectuating a Vesting Zone Change from the [Q]C1.5-1VL and P-1VL Zones to the (T)[Q]RAS4-1VL Zone for the demolition of an existing car dealership that consists of four buildings including one vacant single-family home onsite, and the construction of a mixed-use project with 67 residential units and 2,100 square feet of commercial space, proposed at 60 feet (five stories) in height, with four parking spaces for the commercial use and 80 parking spaces for the residential units, requiring 9,000 cubic yards of grading for cut and export to accommodate subterranean parking, for the property located at 13724-13732 West Victory Boulevard, subject to Conditions of Approval.

  9. ADVISE the applicant, pursuant to Los Angeles Municipal Code Section 12.32 G:

    ...the Council may decide to impose a permanent Q Qualified classification... identified on the Zoning Map by the symbol Q in brackets... There shall be no time limit on removal of the brackets around the [Q] Qualified designation nor on removal of the T Tentative designation. After the conditions of the permanent [Q] Qualified classification have been fulfilled, the brackets surrounding the Q symbol shall be removed.

     

  11. ADVISE the applicant that, pursuant to State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring.

HOUSING COMMITTEE REPORT and RESOLUTION relative to authorization to issue up to $32,007,814 in tax-exempt multifamily conduit revenue bonds or notes for the development of the SP7 Apartment Scattered Site Project (SP7 Project).

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. ADOPT the accompanying RESOLUTION authorizing the issuance up to $32,007,814 in tax-exempt multifamily conduit revenue bonds or notes for the development of the SP7 Project.  

  2. AUTHORIZE the General Manager, Los Angels Housing and Community Investment Department (HCIDLA), or designee, to:

    1. Negotiate and execute relevant loan documents and amendments to Contract No. C-131386, including but not limited to:

      1. Amending interest rates, loan and affordability terms, and loan amount.

      2. Executing separate promissory notes and regulatory agreements for the two properties.

      3. Subordination to new permanent loans; and, assumption, assignment, and transfer of ownership to a new limited partnership, subject to the approval of the City Attorney as to form.

    2. Negotiate and execute the relevant bond documents for the development, subject to the approval of the City Attorney as to form.

  3. AUTHORIZE the General Manager, HCIDLA, or designee, to prepare Controller instructions and any necessary technical adjustments consistent with the Mayor and Council actions on this matter, subject to the approval of the City Administrative Officer (CAO); and, AUTHORIZE the Controller to implement those instructions.

  4. AUTHORIZE the General Manager, HCIDLA, or designee, to reduce the interest rate of the SP7 Project's Proposition HHH loan of $12,000,000 from three percent to a one percent simple interest rate.

   

Fiscal Impact Statement:  The CAO reports that there will be no impact to the General Fund as a result of the issuance of these tax-exempt multi-family conduit revenue bonds for the SP7 Project.  The City is a conduit issuer and does not incur liability for the repayment of the bonds, which are a limited obligation payable solely from the revenues of the Project, and the City will in no way be obligated to make payments on the bonds.

INSTRUCT the Los Angeles Housing and Community Investment Department to work with the Chief Legislative Analyst (CLA) and the City Attorney to develop, within 120 days, recommendations, including prospective costs and funding sources, for a City of Los Angeles right to counsel Ordinance and/or program to ensure that tenants have access to the information and representation they need when faced with alleged landlord harassment, rental agreement and lease issues, and eviction for any reason.

ARTS, ENTERTAINMENT, PARKS AND RIVER COMMITTEE REPORT relative to the agreement between the City and the Los Angeles Community Garden Council (LACGC) for the operation and maintenance of five community gardens.

 

Recommendation for Council action:

 

APPROVE the proposed ten-year Agreement (attached to the Council file) between the City and the LACGC, a California non-profit organization, for the continued operation and maintenance of Solano Canyon Community Garden, Drew Street Community Garden, El Sereno Community Garden, Patton Street Community Garden, and East Wilmington Community Garden.

 

Fiscal Impact Statement:  The Department of Recreation and Parks (RAP) reports that the proposed Agreement will have no adverse fiscal impact on RAP’s General Fund as the cost of operations and maintenance for all five community gardens, including utilities, will be the responsibility of the LACGC.

ARTS, ENTERTAINMENT, PARKS AND RIVER COMMITTEE REPORT relative to the Request for Proposals for concessions at the Los Angeles Zoo.

 

Recommendations for Council action:

 

  1. REQUEST the City Attorney with the assistance from the Zoo Department to prepare and present an amendment to extend the current Concessions Agreement between the City and the Greater Los Angeles Zoo Association (GLAZA) for an additional six months to February 17, 2019, with a six-month renewal option at the City's discretion, to allow time for the issuance of the Concessions Request for Proposals (RFP), revision of the draft concessions services agreement and the selection of the proposed vendor, subject to Council approval.

  2. INSTRUCT the Offices of the Chief Legislative Analyst (CLA) and the City Administrative Officer (CAO) to continue discussions with GLAZA and the Zoo Department (Zoo) in order to achieve a final RFP document and transmit that document to Council for consideration within 45 days.

  3. INSTRUCT GLAZA and REQUEST the City Attorney to redraft the proposed concessions services agreement to better clarify the financial and revenue sharing proposals and submit that item to Council within 30 days for approval in order to make the documents available for review during the RFP Process.

  4. INSTRUCT the Zoo and GLAZA to negotiate a new concessions agreement to replace the 1981 concessions agreement between GLAZA and the Department of Recreation and Parks to reflect a new revenue sharing model and increase revenue allocations to the Zoo which may result from the responses to the RFP. This new concessions agreement will supersede any prior agreements.

 

Fiscal Impact Statement: The CAO and the CLA report that there is no projected impact from the recommendations contained within the joint report. The recommendations included in the report are consistent with the City’s Financial Policies, as on-going expenditures will be fully supported by on-going revenues. The revenues generated from concessions in 2017-18 totaled approximately $12 million and $1.8 million in commissions was paid to the Zoo Enterprise Trust Fund under the terms of the 1981 Concessions Agreement.

Recommendations for Council action, pursuant to Motion (Harris-Dawson - Wesson - Huizar), SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. APPROVE $2,270,000 from the Homeless Services Programs line item to fund pre-development work associated with the Crisis and Bridge Housing Program.

  2. AUTHORIZE the Controller to transfer and appropriate $2,270,000 from the Homeless Services Programs line item in the Unappropriated Balance to the Department of Public Works, Bureau of Engineering Fund No. 100/78 for staff and consultant costs associated with surveys, structural analysis, and geotechnical and environmental review, and other costs to analyze the feasibility of proposed crisis and bridge housing sites identified by Council as follows:

  1. AUTHORIZE the Director of Planning, or designee, to take the following actions:

    1. Enter into a project agreement (contract) with the State Office of the Historic Preservation, subject to the approval of the City Attorney as to form and legality, to accept a grant in the amount of $36,000 which will be used to integrate historic resources data into HistoricPlacesLA, requiring that all expenses for work to be performed be incurred within the period of October 1, 2018 through September 30, 2019.

    2. Set up a grant receivable of $36,000 and establish an appropriation account within the City Planning Grant Trust Fund No. 46Y/68 for the disbursement of funds for the project.

    3. Submit grant reimbursement requests to the State Office of Historic Preservation and deposit grant receipts in the City Planning Grants Trust Fund No. 46Y.

  2. AUTHORIZE the City Administrative Officer to make any technical corrections to the above fund transfer instructions in order to effectuate the intent of this Motion.
