Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. PRESENT and ADOPT the accompanying six ORDINANCES all dated July 18, 2017, approved as to form and legality by the City Attorney, amending Ordinance No. 184251 of the LAAC (2015-16 to 2017-18 Fiscal Year Salaries and Benefits) to provide the following technical changes:
       
    a.  Delete class code and titles for certain City Attorney classifications in accordance with applicable Memorandum of Understanding, and to correct a typographical error for one class code.
     
    b.  Eliminate compensation for attendance at meetings by Members of the Innovation and Performance Commission, in accordance with the LAAC Section 8.237.
     
    c.  Reflect a bargaining unit change approved by the Employee Relations Board for the classification of Senior Fire Statistical Analyst.
     
    d.  Reflect bargaining unit changes approved by the Employee Relations Board for the classification of Duplicating Machine Operator and Senior Duplicating Machine Operator.

    e.  Reflect class title changes adopted by the Civil Service Commission for the classification of Clerk Typist and Senior Clerk Typist.
     
    f.  Reflect class title changes adopted by the Civil Service Commission for the classification of Community Police Aide, EMS Nurse Practitioner Supervisor and Zoo Research Director. 

  2. PRESENT and ADOPT the accompanying ORDINANCE dated July 18, 2017, approved as to form and legality by the City Attorney, amending Ordinance No. 184869 of the LAAC, which amended Ordinance No. 184251 of the LAAC (2015-16 to 2017-18 Fiscal Year Salaries and Benefits), to correct the title of the new classification of Assistant Airport Manager (Code 7259).

  3. AUTHORIZE the Controller and the City Administrative Officer (CAO) to correct any clerical errors, or if approved by the City Attorney, any technical errors in the above Ordinances.

 

Fiscal Impact Statement:  The CAO reports that there is no fiscal impact associated with the above-described technical corrections to the LAAC.

BUDGET AND FINANCE COMMITTEE REPORT relative to the Second Amended and Restated Master Placement Agreement between the City of Los Angeles and FUSE Corps.

 

Recommendations for Council action:

 

  1. APPROVE and AUTHORIZE the City Administrative Officer (CAO) to execute, the proposed Second Amended and Restated Master Placement Agreement with FUSE Corps, a California Nonprofit Corporation, for a term effective June 1, 2015 through September 20, 2023, subject to the approval of the City Attorney.

  2. AUTHORIZE General Managers to execute Individual Task and Placement Agreements and Executive Advisor Task and Placement Agreements with FUSE Corps in accordance with the terms of this Master Placement Agreement, subject to the availability of budgeted funding.

Fiscal Impact Statement:  The CAO reports that funding will be provided on a per Fellow basis by the participating department(s) that place a Fellow. There will be no additional fiscal impact. Therefore, approval of the recommendations of this report are in compliance with the City's Financial Policies as budgeted funds will be available to support the proposed Agreement expenditures.

Recommendation for Council action, as initiated by Motion (Englander - Blumenfield):

 

INSTRUCT the Office of Finance, with the assistance of the City Administrative Officer (CAO) and Controller, to report in 30 days to the City Council with an analysis of the impacts of extending the City business tax deadline to April to align with State and federal tax deadlines, and to also include in the analysis:

 

  1. The potential to recover any initial implementation costs and provide estimates of ongoing savings that can be expected from this alignment.

  2. Recommendations on mitigating the impact on small individual filers of paying City business tax liabilities at the same time as State and Federal tax liabilities under the alignment.

  3. Proposals for outreach to businesses on the alignment.

  4. Impacts on the City's ability to forecast and budget the revenues from the Gross Receipts Tax.

  5. Impacts on revenue and cash flow from late filers under the alignment, and costs to the City for short-term borrowing.

This does not change available funds for 2017-18 appropriations. There is no additional impact to the General Fund.

  1. ADOPT the determination by the Board of Harbor Commissioners that the proposed action is generally and categorically exempt under the California Environmental Quality Act (CEQA) in accordance with Article II, Section 2(f) and Article III Class 6 of the Los Angeles City CEQA Guidelines.

  2. APPROVE Port Resolution No. 17-8153 authorizing Revenue Allocation Agreement No. 17-3518 with GE addressing the partnership arrangement for the Data Portal project to digitize and enhance maritime supply chain performance for a term of three years, followed by a second two-year term, and an option to purchase a subscription for use of the Data Portal for an additional 10 years thereafter.

 

Fiscal Impact Statement: The City Administrative Officer reports that the proposed agreement enables the Port and GE to commercialize and implement a revenue sharing arrangement and general business partnership for an informational data portal project system. Under a separate report, the Port will amend the current expenditure amount for the portal project up to a total of $13,100,420, because additional shipping lines and terminals are requesting to participate and use the Portal project. Expenditures under the agreement are the financial responsibility of the Port. The Port states that it may fully recoup or surpass expenditures for the Portal, contingent upon future business demand for use of the Portal, but such demand cannot be determined at this time. The Port will not be obligated to spend this entire expenditure amount because the agreement includes as-needed options.

  1. AUTHORIZE the City Attorney to settle the above-entitled matter along the following proposed key terms:

    1. Government Code Section 34090

      The City agrees that Government Code Section 34090 does not allow for the destruction of documents less than two years old.

    2. City’s Administrative Code

      The City agrees that Section 12.3 et seq. of the Administrative Code requires all records to be retained for a minimum of two years unless a shorter period is otherwise permitted by law or a longer period is otherwise required by law, or unless, consistent with state law, a different period of retention is established by order or resolution of the City Council subject to the notice provision described below.

    3. Records Disposition Schedules

      The City agrees to add to all currently existing and future Records Disposition Schedules (as that term is defined in Section 12.3 et seq. of the City’s Administrative Code) the following Schedule Item Number at the top of the schedule:

      All records shall be retained for a minimum of two years, including records not included in the Schedule items listed below unless a shorter period is otherwise specified by law or a longer period is otherwise required by law, or unless, consistent with state law, a different period of retention is established by order or resolution of the City Council.

      The City also agrees that any provision of law which the City relies on to implement a records disposition schedule of less than two years shall be enumerated in the Records Disposition Schedule.

    4. Notice

      For a period of five years after the date of the Settlement, should the City take any future action to establish a records retention period of less than two years for any record or category of records, such action shall not be implemented until the First Amendment Coalition receives at least 30 days’ notice of such action by mailing notice to its executive director at the address listed on the First Amendment Coalition’s website or the First Amendment Coalition provides written notice of agreement to such action, whichever comes first.

    5. In exchange for these terms, and the payment of the First Amendment Coalition’s attorneys’ fees and costs ($20,000), the City receives a full release for the claims asserted in the Litigation.

  2. AUTHORIZE the City Attorney, or designee, to execute all documents necessary to implement the proposed Settlement.
