Recommendations for Council action:

 

  1. CONSIDER protests relative to the proposed vacation of the westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace.

  2. FIND that the vacation of the westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines.

  3. FIND that the street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of way indicated below and shown colored blue on Exhibit A of the August 19, 2016 City Engineer report, attached to the Council file:

    The westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace.

  4. FIND that there is a public benefit to the vacation of the westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace. Upon vacation of the street, the City is relieved of its ongoing obligation to maintain the right-of-way. In addition, the City is relieved of any potential liability that might result from continued ownership of the involved street easement.

  5. FIND that the vacation of the westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace is in substantial conformance with the purposes, intent and provisions of the General Plan, in conformance with Section 556 of the City Charter.

  6. FIND that the vacation of the westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace is not necessary for non-motorized transportation facilities, in conformance with Section 892 of the California Streets and Highways Code.

  7. FIND that the vacation of the westerly half of the northerly side of Thrush Way approximately 175 feet northeasterly of Magnetic Terrace is not necessary for present or prospective public use, in conformance with Section 8324 of the California Streets and Highways Code.

  8. ADOPT the City Engineer's report dated August 19, 2016 with the conditions contained therein.

Fiscal Impact Statement:  The City Engineer reports that the petitioner has paid a fee of $14,980 for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC). Any deficit fee to recover the cost pursuant to LAAC Section 7.44 will be required of the petitioner. Maintenance of the public easement by City forces will be eliminated.

CONSIDERATION OF PROTESTS, ENVIRONMENTAL FINDING and PUBLIC WORKS AND GANG REDUCTION COMMITTEE REPORT relative to the vacation of the public right-of-way in the Belmont Learning Center Vacation District (VAC- E1400976).

 

Recommendations for Council action:

 

  1. CONSIDER protests relative to the proposed vacation of the public right-of-way in the Belmont Learning Center Vacation District.

  2. FIND that all the mitigation measures that are within the control of the City, as described in the Final Environmental Impact Report, State Clearinghouse No.2003081096 that are associated with the impacts of the street vacation and that other mitigation measures that are not within the authority of the City, have been or should be imposed as set forth in the findings of the Board of Education of the City of Los Angeles, dated June 22, 2004, as attached to the City Engineer report dated October 19, 2016. No new information exists to show that the project or circumstances of the project have been changed to require additional environmental review, as described in State CEQA Guidelines 15162, and therefore the existing environmental documents adequately describe the potential impact for this street vacation.

  3. FIND that the street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of way indicated below and shown colored blue on Exhibit B of the October 19, 2016 City Engineer report, attached to the Council file:

  1. REQUEST the Los Angeles Housing and Community Investment Department (HCIDLA) and the City Attorney to report in 60 days relative to:

    1. The 2003 Report of the City of Los Angeles Notice Ordinance Working Group recommendations and any relevant concepts that could be included in a local Affordable Housing Notice Ordinance.

    2. Clarifying state law and identify other provisions, tracking and enforcement mechanisms that augment the notice provisions as appropriate to address local conditions.

    3. Current data management tools and their suitability for identifying affordable housing stock in the City of Los Angeles at-risk of losing their rental subsidies or affordability restrictions through the combined expiration and/or termination of covenants, restrictions and/or rental subsidies.

  2. REQUEST the City Attorney, with the assistance of the HCIDLA, to prepare and present an ordinance in 60 days establishing an affordable housing notification requirement mirroring California Government Code Sections 65863.10, 65863.11, and 65863.13 (Notice of Intent), including local enforcement provisions as appropriate.

    3. Assign and transfer the Deed of Trust to the Buyer and all of the Seller’s rights and interests in and to the Deed of Trust.

    4. Assign and transfer the Loan Documents, as defined in the City Loan Agreement (Contract No. C-114663) to the Buyer and all of the Seller’s rights and interests in and to the Loan Documents.

    5. Prepare and execute any additional ancillary documents necessary to effectuate the purchase and sale of the Promissory Note secured by the property located at 6800 South Avalon Boulevard, subject to the approval of the City Attorney as to form and legality.

  2. AUTHORIZE the General Manager, EWDD, or designee, to receive the Promissory Note sale proceeds and payback the outstanding Section 108 loan of up to amount $3,817,000 and other expenditures incurred by the City to the US Department of Housing and Urban Development (HUD).

  3. AUTHORIZE the General Manager, EWDD, or designee, to prepare Controller instructions and any technical adjustment(s) that may be required and are consistent with this action, subject to the approval of the City Administrative Officer; and REQUEST the Controller to implement the instructions.

 

Fiscal Impact Statement:  The EWDD reports that there is no General Fund impact resulting from the recommended actions.  The City’s total investment to the Project is $3,817,000 from the Section 108 Loan Guarantee Program (Section 108) plus administrative and collection cost that are guaranteed with the Community Development Block Grant allocations to the City from HUD.  The collateral and debt service obligations on the City loan, as funded by Section 108 are the sole responsibility of the loan Borrower, and in this case the proceeds from the sale of the Promissory Note will be used to payback the outstanding Section 108 loan to HUD and expenses that the City incurred for the evaluation of this project.

Recommendations for Council action:

 

  1. REAFFIRM the FINDINGS of September 24, 2013, that the vacation of a portion of the alley easterly of Highland Avenue from Selma Avenue to 25 feet northerly thereof (airspace), pursuant to the City of Los Angeles Environmental Guidelines, is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City of Los Angeles Environmental Guidelines.

  2. REAFFIRM the FINDINGS of September 24, 2013, that this vacation is in substantial conformance with the General Plan pursuant to Section 556 of the Los Angeles City Charter.

  3. ADOPT the accompanying RESOLUTION TO VACATE No. 17-1401220 for the vacation of a portion of the alley easterly of Highland Avenue from Selma Avenue to 25 feet northerly thereof (airspace).

  4. INSTRUCT the City Clerk to transmit, following Council adoption, Resolution to Vacate No. 17-1401220 to the Land Development Group of the Bureau of Engineering for recordation of said Resolution with the Los Angeles County Recorder.

COMMUNICATION FROM THE BOARD OF WATER AND POWER COMMISSIONERS (Board) relative to authorizing a Standard Offer for the Los Angeles Department of Water and Power (LADWP) Outdoor Lighting (OL) Program Service Agreement and Rate Calculation Methodology for a 20-year term.

 

Recommendation for Council action:

 

CONCUR with the Board action of January 17, 2017, Resolution No. 017-144, authorizing the use of a new Rates Calculation Methodology and 20-year Standard Offer for the LADWP OL Program Service Agreement for premises initially receiving OL service and for premises already receiving OL service once an OL fixture type serving such premises is changed and authorizing the continued provision of the same OL service on a month-to-month basis to any premises already receiving this service from LADWP other than by ordinance until an OL fixture type serving such premises is changed.

 

Fiscal Impact Statement:  The City Administrative Officer reports that approval of the proposed resolution is not anticipated to impact the Power Revenue Fund or the Water Revenue Fund.  The proposed agreement complies with the LADWP adopted financial policies and will not impact the City's General Fund.
