Recommendations for Council action, as initiated by Motion (Krekorian - O'Farrell):

 

  1. INSTRUCT the Chief Legislative Analyst (CLA), with the assistance of the City Administrative Officer (CAO), to report by April 1, 2017 on the following:

    1. A list of Federal funding that the City of Los Angeles receives or administers, the legal authority which allowed for those funds to be appropriated and remitted to the City of Los Angeles, and the nature of the City's programs that make use of them.

    2. The budgetary and operational implications of a loss of Federal funding in the event that the Congress and President act to remove funds from cities that have policies similar to Special Order 40.

    3. A plan to address the budgetary shortfall that would result from the loss of Federal funds.

    4. An assessment of the risk factors and degree of risk of the loss of various Federal funds the City receives.

  2. REQUEST the City Attorney to report in Closed Session on how the City can defend itself.

APPROVE and AUTHORIZE the President, Board of Public Works, to execute Amendment No. 3 to Contract No. C-102635 with Swinerton to extend the contract term for five years through August 31, 2021 in an amount not to exceed $6,200,000, subject to the approval of the City Attorney.   
   

Fiscal Impact Statement:  The City Administrative Officer reports that the proposed Third Amendment to Contract No. C-102635 extends the term of the Program Management/Construction Management contract between the City and the above-referenced consulting firm, without increasing the maximum compensation level of $6,200,000.  Expenditures associated with construction of the North Central Animal Shelter Renovation Project will come from the Municipal Improvement Corporation of Los Angeles (General Fund) authorized in the 2016-17 Budget.

Recommendations for Council action, as initiated by Motion (Huizar, et al. - Krekorian):

 

  1. INSTRUCT the Department of City Planning (DCP)  and the City Administrative Officer (CAO) to report with the necessary budget resources, staffing needs and funding analysis to implement a six year, accelerated update cycle, and for the DCP to report with a draft ordinance to codify that requirement.

  2. INSTRUCT  the DCP to immediately implement administrative procedures to batch General Plan Amendments, and to begin working on an ordinance to make General Plan Amendments batching the law.

  3. INSTRUCT the DCP to immediately implement EIR Processing Option Two of the DCP report dated January 26, 2017 (attached to Council file No. 16-0422), requiring that all future EIRs associated with development be prepared only by City-approved consultants, and an applicant hire a consultant from the City's pre-qualified list.

  4. INSTRUCT the DCP to issue an Request for Qualifications to establish a Pre-Qualified List of environmental consultants.

    2. Recommendations on the conditions that the City should consider for the use of any funds, including whether the recipient of any legal aid provided by City funding should be a resident of the City of Los Angeles and not have any criminal history more significant than a misdemeanor offense.

    3. Recommendations on the potential sources of funds for the City of Los Angeles to contribute up to $2 million for the proposed Los Angeles Justice Fund to provide qualified legal representation to immigrants at risk of facing deportation or removal proceedings who are otherwise unable to afford or access legal services.

    4. Recommendations in maintaining appropriate oversight, accounting and evaluation of the expenditure of funds provided by the city, including an analysis of whether appropriate transparency would be adversely impacted by the attorney-client privilege or the doctrine of attorney work product.

    5. An analysis of the potential for such a program to give rise to future City liability to any third parties, or the creation of fiduciary or other responsibilities to the recipients of these legal services.
