CONSIDERATION OF MOTION (CEDILLO – HUIZAR – WESSON – HARRIS-DAWSON – O'FARRELL – PRICE – RYU) relative to identifying and responding to potential changes in Federal laws regarding immigration and immigrants, and identifying the actions necessary to defend our neighborhoods and City residents.

 

Recommendation for Council action:

 

INSTRUCT the Chief Legislative Analyst and the City Administrative Officer:

 

  1. With the assistance of the City Attorney and the Mayor's Office of Immigrant Affairs, to report relative to:

    1. The roles and responsibilities of an Immigrant Advocate to be appointed by Council and to work in conjunction with the Mayor’s Office of Immigrant Affairs.

    2. The definition of the term Sanctuary City and how that term might apply to the City of Los Angeles.

    3. Identify and categorize all federal grants, loans, and other funding that the City of Los Angeles currently receives.

    4. Identify all state laws applicable to immigration and relevant to the City of Los Angeles that may come into conflict with potential changes in federal law.

    5. Identify all federal laws applicable to immigration and relevant to the City of Los Angeles that are currently enacted and not being enforced.

  2. In conjunction with the Los Angeles Unified School District and Los Angeles Community College District, and with the assistance of the Mayor’s Office of Immigrant Affairs, to identify mutual areas of concern and coordinate strategies to protect students and keep families together, and provide updates to Council on a quarterly basis.

  3. With the assistance of the Mayor's Office of Immigrant Affairs, to identify areas of potential collaboration with all levels of local government, including the County of Los Angeles, and the State of California, in order to develop comprehensive strategies that may result in legislative and/or legal action to protect our residents.

AMENDING MOTION 4A (RYU - WESSON)

 

Recommendation for Council action:

 

AMEND to APPROVE the appeal filed by Crystal Clear LLC from the determination of the Board of Building and Safety Commissioners, and thereby approve the application to export 3,500 cubic yards of earth from the project site located at 1561 North Blue Jay Way, with the following required conditions of approval (not volunteered):

 

  1. The applicant shall abide by a daily cap of 18 haul route round-trips allowed on applicant's route, north of Sunset Boulevard to the project site, and will coordinate with other active haul routes to determine the number of trips generated from active haul routes approved prior to the applicant, and will limit the applicant's haul route trips to the difference between the number of active haul route trips each day and the cap.

  2. Applicant automatically shall receive additional hauling days beyond those granted in the Haul Route Approval if implementation the haul route cap results in any of the following: delays; any circumstance permitting use of only a partial hauling day; reductions in the volume of allowable loads; or the reduction of the number of contemplated daily haul truck trips for Applicant's haul route, necessitating the extension of the hauling period.

  3. Applicant shall appoint a flag attendant supervisor, who shall conduct inspections of all flag attendant locations during hauling days and monitor hauling activities.

  4. Once hauling activities are commenced, Applicant shall submit bi-monthly reports to Council District Four, the Los Angeles Department of Building and Safety, and the Los Angeles Department of Transportation detailing the number of hauling trips used by the project, the number of trips remaining under the haul route approval, and any safety concerns or issues reported to Applicant or to the flag attendant supervisor during the course of hauling operations.

  5. Access for any construction-related vehicles of any size shall be limited to Doheny/Sunset and Sunset/Rising Glen entry/exit points. These entry points shall be prohibited (unless pre-approved by neighbors): Cory/Sunset, Doheny Rd./Sunset Hills, Sierra Alta/Doheny Rd., Doheny Dr./Shoreham, Wetherly/Doheny Dr., Bluebird/Flicker as cut-through to Doheny Dr.

  6. Parking for construction worker vehicles must be parked on site or outside the area, in a pre-approved parking area, and workers should be shuttled to site.

  7. A representative from project sites will be required to attend any monthly neighborhood meetings at the request of neighborhood leaders to address concerns.

  8. Speed limit. Any vehicles over 10,000 lbs shall travel 20 mph or at a speed lower than 20 mph that is safe.

  9. One truck per job site allowed in neighborhood at a time; No crossing of two hauling vehicles from the subject development shall be allowed in the Bird Streets Area. (Once one hauling vehicle leaves the Bird Streets Area, the next hauling vehicle may enter.)

  10. All hauling vehicles must be identified by a unique placard prominently identifying the project address and prominently displayed in the front windshield, lower back, and lower front of such vehicle. The signage shall include the property address and board file number with a minimum font size of 160. [PLACARD SIZE 22" X 11', BLOCK LETTERS, MIN FONT SIZE 199 OR HIGHER].

  11. All clearing, earth-moving and excavation activities shall be discontinued during periods of high winds (i.e., greater than 18 mph), so as to prevent excessive amounts of dust.

  12. All dirt/soil loads shall be secured by trimming or other appropriate means to prevent spillage and dust. All dirt/soil materials transported offsite shall be securely covered to prevent excessive amounts of dust.

  13. The only permitted dirt-hauling vehicles shall be 10-wheel dump trucks.

  14. Hauling operations shall be restricted from 10:00 a.m. to 2:00 p.m. on Mondays through Fridays. No hauling is allowed on Saturdays, Sundays, or City holidays.

  15. Haul vehicles may not enter the Bird Streets area before the designated start time, and must be out of the Bird Streets area after the designated end time.

  16. Staging for hauling vehicles is allowed onsite only. Staging of all other constructions vehicles is allowed onsite or along the frontage of the property on the same side of the street only.

  17. The phone number and email of a 24-hour contact person associated with the project shall be posted prominently along the frontage of the property, to be made visible to the public. [POSTED SIGN SHALL BE SIMILAR IN SIZE AND FONT TO THE ONES USED IN CITY OF BEVERLY HILLS].

  18. FLAG PERSONNEL: All flaggers shall be properly trained by taking an online or in person certification class similar to the American Traffic Safety Services Association Online Flagger Certification Training Course to familiarize the flagger with the regulations of the California Manual on Uniform Traffic Control Devices Section 6E.01 as well as the California Code of Regulations regarding Construction Safety Order Title 8, Division 1, Chapter 4, Subchapter 4, Article 11, Section 1599 - Flaggers. All flaggers shall be prohibited from smoking or consuming alcoholic beverages while on duty. All flaggers shall remove all of their trash from their stationed location upon being relieved of duty for any period of time. All flaggers must have a copy of the final action letter or letter stating the project and board file number of the project. All flaggers need to have the information for the 24 hour contact that can be shared with the community if requested.

  19. FLAG PERSONNEL: Stationed at entrance of Sunset Plaza/Sunset Blvd. and Rising Glen/Thrasher to manage traffic.
