Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND that this action is categorically exempt (No. ENV-2015-2329-CE) from California Environmental Quality Act (CEQA) pursuant to the Categorical Exemptions set forth in CEQA Guidelines Sections 15301 (Class 1 Categorical Exemption for Existing Facilities), 15302 (Class 2 Categorical Exemption for Replacement or Reconstruction), 15303 (Class 3 Categorical Exemption for New Construction or Conversion of Small Structures), 15304 (Class 4 Exemption for Minor Alterations to Land), and 15316 (Class 16 Exemption for Transfer of Ownership of Land in Order to Create Parks). Adoption of these Categorical Exemptions are appropriate when the Council, exercising its independent judgment, determines that the project meets all of the requirements set forth in the above-referenced section of the CEQA Guidelines and that none of the exceptions to the use of a Categorical Exemption set forth in CEQA Guidelines, Section 15300.2 apply to this project, based upon substantial evidence contained in the entire administrative record.

  2. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of the Council.

  3. ADOPT the accompanying RESOLUTION as recommended by the Mayor, the Director of Planning and the LACPC, to amend the definitions of park sites and recreational amenities and facilities within the Public Recreation Plan, a portion of the Service System Element of the City of Los Angeles General Plan to modernize the City's Park Fee (currently the Quimby and Finn fees) to mitigate park and open space impacts from residents of new residential projects.

  4. PRESENT and ADOPT the accompanying ORDINANCE dated June 16, 2016 amending Sections 12.21 and 12.33 of Article 2 of Chapter 1, and Sections 17.03, 17.12 and 17.58 of Article 7; deleting Sections 17.07 and 19.01; and adding Section 19.17 to the Los Angeles Municipal Code to update the City's Park Fees.

  5. INSTRUCT the Department of City Planning to update the General Plan and appropriate maps pursuant to this action.

Fiscal Impact Statement: The City Administrative Officer (CAO) reports that the LAHD request for the proposed amendment to Tariff No.4, Section Three, Item No. 330 will increase charges to Pilotage fees. The increase to the Pilotage fees will reduce the current revenue shortfall, continue to provide funding for capital improvement and training, customer service delivery and efficiency, and establish a more sustainable budget model. The LAHD's proposed amendments to Tariff Item No. 330 are expected to increase revenue from Pilotage charges by approximately $1.5 million annually in Fiscal Year 2016-17, depending on the size of future vessels and the number of Port Pilot assisted moves. Annual future revenue amounts will be contingent on the size of the vessels and number of Port Pilot vessel assisted moves. The LAHD states that the proposed increase is one of a multiphase cost recovery plan, which will enable the LAHD to operate the Port Pilot operations with a balanced budget. In addition to the proposed increases to the Pilotage charges, the LAHD is planning to conduct an efficiency or performance study on the Port Pilot services. There will be no impact to the City's General Fund from the implementation of the proposed Amendment.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. AUTHORIZE the Mayor, or designee, to retroactively execute a Cooperative Agreement with Caltrans and accept funding in the amount of $8,913,648 to implement the Los Angeles Transitional Employment Services Litter Abatement Program for parolees and probationers within the Caltrans Right of Way (Caltrans District 7 - LA/Ventura Counties) 60 mile radius, for a three-year period effective July 1, 2016 through June 30, 2019, and submit any other necessary agreements and documents relative to the implementation of this program, subject to the review and approval of the City Attorney as to form and legality.

  2. APPROVE, retroactively, the issuance of a Request for Proposals (RFP) to solicit for the provision of a transitional employment services litter abatement program for Los Angeles area parolees and probationers, for a performance period of three years, subject to the availability of funds, compliance with City contracting requirements and approval of the City Attorney as to form and legality.

  3. APPROVE the results of the RFP issued on May 10, 2016, attached to the Council file, and the recommended provider, Chrysalis Enterprises, as selected by the Mayor's Office of Re-Entry; and, AUTHORIZE the Mayor, or designee, to negotiate and execute a contract with Chrysalis Enterprises for the implementation and coordination of the Los Angeles Transitional Employment Services Litter Abatement Program in an amount not to exceed $8,224,693, for a three-year term effective from July 1, 2016 through June 30, 2019, in substantial conformance with the scope of work included in the RFP, subject to the approval of the City Attorney as to form and legality, availability of funds and compliance with the City's contracting requirements.

  4. AUTHORIZE the Mayor, or designee, to conduct a competitive bid process to solicit for a contractor to provide life skills related training to Los Angeles Transitional Employment Services Litter Abatement Program participants on an as-needed basis, in the amount of $65,000, effective for a three-year term from July 1, 2016 through June 30, 2019, subject to the approval of the City Attorney as to form and legality, availability of funds and compliance with the City's contracting requirements. 
           
  5. AUTHORIZE the Controller to establish a new interest bearing fund entitled 2016 Caltrans Transitional Employment Services Fund No. XXX/46, recognize a receivable in the amount of $8,913,648, receive and disburse the funds upon presentation of documentation on proper demand from the Mayor's Office, and create new appropriation accounts within the new Fund No. XXX/46 as follows:

Fiscal Impact Statement:  The CAO reports that acceptance of the 2016 Caltrans Cooperative Agreement in the amount of $8,913,648 and approval of grant-related actions will result in the implementation of the City's Transitional Employment Services Litter Abatement Program and provide transition employment for over 1,300 parolees and probationers.  The cooperative agreement provides funding for program implementation through personnel, contractual services and office and administration costs; financing the majority of activities with the exception of a portion of the Mayor's Office of Re-Entry salaries and fringe benefits.  The amount for Year One totals $124,321 and is included in the 2016-17 Mayor's Adopted Budget so no additional appropriation is necessary at this time.  Accepting the grant and approving the recommendations would be in compliance with the City's Financial Policies in that budgeted General Fund revenues plus grant revenues are available to support the cost of this program.  Funding to continue the programs beyond the performance periods is dependent on receipt of additional grant funds or General Fund appropriations.

  2. APPROVE LAHD Resolution Nos. 16-7977 and 16-7978 authorizing the LAHD to approve the 2016 Refunding Revenue Bonds.

 

Fiscal Impact Statement: The City Administrative Officer (GAO) reports that there is no impact to the City or the General Fund. Approval of the proposed request by the LAHD to replace the existing bonds with new bonds will lower interest rates and reduce debt services costs. The LAHD will authorize the issuance of up to $240 million in 2016 Refunding Revenue Bonds to refund all or part of the LAHD's outstanding Year 2006 Series A, B, and C Bonds (2006 ABC Bonds) up to $119,245 million, and Advance Refunding of the 2009 Series B Bonds (2009 B Bonds), up to $100 million for a total of $219,245,000 in refunded bonds. The $240 million will cover any unanticipated rise in interest rates as well as all costs associated with the issuance refunding bonds. Based on current interest rates, the LAHD projects a combined present value savings of $33.7 million or 15.35 percent of the bonds to be refunded. The bond savings will equal an average annual debt savings of approximately $1.7 million over the repayment life of the bond through August 1, 2039. The LAHD states that the proposed transactions will not change the maturity of these bonds or result in additional debt, but will replace the current higher interest debt with lower interest rate debt obligation and therefore reduce the future debt service payment obligations for the LAHD. Debt issuance costs are estimated at approximately $600,000 for the $240 million bond refunding transactions. Debt service on these revenue bonds and all projected savings will accrue to the LAHD Revenue Fund.
