Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND that the dedication of City-owned real property as public street lying on the southeast line of Mission Road southwest of Golden State Freeway (Right of Way No. 36000-2132) is categorically exempt from the California Environmental Quality Act of 1970 pursuant to Article III, Class 5(4) of the City's Environmental Guidelines.

  2. FIND that the City-owned Real property lying on the southeast line of Mission Road southwest of Golden State Freeway, shown in the Exhibit Map, be dedicated, accepted and established as part of Mission Road, a public street of said City.

  3. FIND that pursuant to Section 556 of the City Charter, that this dedication, acceptance and establishment of City-owned real property as public streets and alley is in substantial conformance with the purpose, intent and provisions of the General Plan.

  4. PRESENT and ADOPT the accompanying ORDINANCE dated June 7, 2016 effectuating the dedication, acceptance and establishment of certain real property owned by the City of Los Angeles, lying on the southeast line of Mission Road southwest of Golden State Freeway, a public street of said City.

  5. INSTRUCT the Real Estate Division of the Bureau of Engineering, to record the Ordinance, as detailed above in Recommendation No. 4, with the County Recorder.

  6. INSTRUCT the City Clerk to forward a copy of the Council action on this project to the Real Estate Division of the Bureau of Engineering for processing.

GENERAL EXEMPTION, HOMELESSNESS AND POVERTY COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to amending Sections 5.500 and 7.33.1 of the Los Angeles Municipal Code (LAMC) to require Fiscal Year 2016-2017 proceeds from the sale of any surplus properties approved by City Council for use in support of the City's Using Public Land for Affordable and Homeless Housing strategy to be deposited into the Affordable Housing Trust Fund.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. FIND that the amendment to Sections 5.500 and 7.331 to the LAMC, is exempt from the California Environmental Quality Act (CEQA) under the General Exemption (Article 19) and Categorical Exemption (Section 15312) of the State CEQA Guidelines and (Article II, Class 12) of the City CEQA Guidelines.

  2. PRESENT and ADOPT the accompanying ORDINANCE dated June 23, 2016 amending Sections 5.500 and 7.33.1 of the LAMC to require that during Fiscal Year 2016-2017 that proceeds from the sale of any surplus properties in the City approved by City Council for use in support of the City's Using Public Land for Affordable and Homeless Housing strategy, which would otherwise be deposited 50 percent into the Council District Real Property Trust Fund in which property was located and 50 percent into the General Fund, be instead fully deposited into the Affordable Housing Trust Fund.

  3. AUTHORIZE the Housing and Community Investment Department and the Controller to establish a sub-account within the Affordable Housing Trust Fund to receive deposits and make expenditures for properties/projects located within the Venice area as defined by the Los Angeles Administrative Code Section 5.121.

Recommendations for Council action, pursuant to Resolution (Huizar - Ryu):

 

  1. RESOLVE, pursuant to Los Angeles Municipal Code Section 80.69.4 and California Vehicle Code Section 22507, to hereby prohibit the parking of vehicles that are in excess of 22 feet in length or over seven feet in height, during the hours of 2:00 am and 6:00 am, on:

    1. Huntington Drive North between Maycrest Avenue and Van Horne Avenue

    2. North Avenue 66 between York Boulevard and Meridian Street
                     
  2. DIRECT the Los Angeles Department of Transportation (LADOT), upon approval of this action, to post signs giving notice of a Tow Away, No Parking restriction for oversized vehicles on the streets listed above in Recommendation No. 1.
       
  3. AUTHORIZE the LADOT to make any technical corrections or clarifications to the above instructions in order to effectuate the intent of this action.

  1. RESOLVE, pursuant to Los Angeles Municipal Code Section 80.69.4 and California Vehicle Code Section 22507, to hereby prohibit the parking of vehicles that are in excess of 22 feet in length or over seven feet in height, during the hours of 2:00 am and 6:00 am, on both sides of the public streets that are bounded:

    1. On the north by 240th Street/Frampton Avenue

    2. On the west by South Western Avenue

    3. On the south by Lomita Boulevard

    4. On the east by Frampton Avenue
                     
  2. DIRECT the Los Angeles Department of Transportation (LADOT), upon approval of this action, to:

    2. Initiate the necessary procedures for the preparation and sale of overnight parking permits, as specified in LAMC Section 80.69.4 (c)

BUDGET AND FINANCE COMMITTEE REPORT relative to the Fiscal Year 2014-15 Medi-Cal Intergovernmental Transfer Program (FY 2015 IGT) to access federal Medicaid funds for emergency medical and ambulance transport services.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. REQUEST the City Attorney to draft an ordinance establishing a special fund titled Medi-Cal Intergovernmental Transfer Program (IGT Fund) for the deposit of monies received from the State of California Department of Health Care Services (DHCS), or its contracted Health Care Plans (HCPs), for the Los Angeles Fire Department (LAFD) to provide emergency medical and ambulance transport (EMS) and health care services in accordance with California Welfare and Institutions Code Section 14301.4.

  2. AUTHORIZE the Controller to:

    1. Electronically transfer $9,512,324 from the LAFD Fund No. 100/38, EMS Program Account No. 001012 Salaries Sworn, to the DHCS, by no later than September 9, 2016, for LAFD participation in the FY 2015 IGT to access federal Medicaid funds for EMS services.

    2. Set up a receivable in the new IGT Fund in an amount to be determined upon receipt of the FY 2015 IGT Program funds from the DHCS or its contracted HCPs.

    3. Establish an appropriation account, account number to be determined (TBD), within the new IGT Fund, titled FY 2015 Medi-Cal Intergovernmental Transfer, for the receipt and disbursement of the FY 2015 IGT funds.

  3. AUTHORIZE the LAFD to:

    1. Deposit the FY 2015 IGT receipts in the new IGT Fund, FY 2015 Medi-Cal IGT Account No. TBD.

    2. Transfer $9,512,324 from the new IGT Fund, FY 2015 Medi-Cal IGT Account No. TBD to the LAFD Fund No. 100/38, EMS Program Account No. 001012 Salaries Sworn.

  4. AUTHORIZE the Controller, if the new IGT Fund has not been established when the FY 2015 IGT Program funds are received, to deposit receipts into the Fire Department Trust Fund No. 848/38, Revenue Source No. 5504 Contribution - Trust, and transfer therefrom the amount of $9,512,324 in advanced funds to the LAFD Fund No. 100/38, EMS Program Account No. 001012 Salaries Sworn, in place of Recommendation Nos. 2b through 3b above.

  5. INSTRUCT the LAFD and City Administrative Officer (CAO) to report, upon receipt of the FY 2015 IGT Program funds, on the current fiscal condition of the LAFD budget and its EMS resource priorities.

  6. AUTHORIZE the LAFD to prepare Controller instructions for any technical adjustments in compliance with the intent of Council actions, subject to the approval of the CAO; and, AUTHORIZE the Controller to implement the instructions.

Fiscal Impact Statement: The CAO reports that approval of the recommendations in this report will require an upfront transfer of $9.51 million, consisting of $7.93 million in eligible Medi-Cal costs and $1.58 million for administrative fees, from the LAFD's Sworn Salaries Account to the DHCS. The anticipated amount transferred back to the City from the DHCS or its contracted HCPs will be $15.37 million, including $5.86 million in net revenues. There is no additional General Fund impact. These actions are in compliance with the City’s Financial Policies in that proposed ongoing programs or services are to be supported by ongoing revenues.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. REVISE RECOMMENDATION 2(a), to read as follows:

    Transfer $9,512,324 from the LAFD Fund No. 100/38, EMS Program Account No. 001012 Salaries Sworn, to Fund No. 100/38 Account No. 003040 Contractual Services, and electronically transfer $9,512,324 therefrom to the DHCS by no later than September 9, 2016 for LAFD participation in the Fiscal Year 2014-15 Medi-Cal Intergovernmental Transfer (FY2015 IGT) program to access federal Medicaid funds for EMS services.

  2. REVISE RECOMMENDATION 4 to clarify that any IGT program receipts remaining in the Fire Department Trust Fund No. 48/38 after the transfer of $9,512,324 back to the EMS Sworn Salaries account shall remain in that Fire Department Trust Fund, and may not be expended from that Fund. All remaining receipts shall be transferred from the Fire Department Trust Fund to the new IGT Fund when that new IGT Fund is subsequently created.
