BUDGET AND FINANCE COMMITTEE REPORT relative to additional appropriations for outside counsel in connection with the Kern County Biosolids Litigation.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. AUTHORIZE the City Attorney to extend the term of Contract No. C-110169 for two years, and increase the funding by $850,000, for a total contract amount with Beveridge and Diamond, P.C. not to exceed $6,283,565.

  2. AUTHORIZE the City Attorney to amend Contract No. C-126415 with the Law Offices of Michael J. Lampe in Visalia, California by increasing the funding by $100,000, for an amount not to exceed $450,000.

  3. REQUEST the City Attorney to report to the Budget and Finance Committee on a regular basis relative to the status of this matter.

ARTS, PARKS, AND RIVER COMMITTEE REPORT relative to the framework and the time frames required to release a Request for Proposals (RFP) for concessions at the Los Angeles Zoo (LA Zoo).

 

Recommendations for Council action:

 

  1. INSTRUCT the LA Zoo and the Greater Los Angeles Zoo Association (GLAZA) to provide greater participation in the concessions RFP process by requiring:

    1. The new RFP to follow City contracting procedures pursuant to Section IV.A of the Operating Agreement between the City and GLAZA and as identified in Article III of the City Charter and Division 10 of the Administrative Code (Attachment 1).

    2. A City representative with experience in the management of concessions within a department including but not limited to El Pueblo de Los Angeles Historical Monument, the Department of Recreation and Parks, or Los Angeles World Airports to assist with the development of strategies, standards and evaluation criteria in the RFP and to participate in the selection process as a member of the evaluation committee.

    3. The provisions of the City's Good Food Purchasing Policy to be incorporated into the RFP.

  2. EXTEND the Concession Agreement between the LA Zoo and GLAZA by twelve months to August 31, 2017 with a six month renewal option to allow time for the issuance of the new Concessions RFP and the selection of a proposed vendor, subject to the review of the City Attorney as to form, and Council approval.
         
  3. INSTRUCT the LA Zoo and the GLAZA to:

    1. Report to the Arts, Parks, and River Committee every 90 days with a status report on the development of the proposed RFP and the findings of the consultant.

    2. Transmit a draft RFP for concessions to the Arts, Parks, and River Committee for approval by Council.

    3. Transmit the draft concessions contract to Council for review and approval prior to execution.
         
  4. INSTRUCT the LA Zoo to ensure that the new concessions contract includes a greater revenue share for the LA Zoo that ensures a larger distribution of commissions to the LA Zoo.
         

Fiscal Impact Statement:  The City Administrative Officer and the Chief Legislative Analyst report that there is no  General Fund impact from the recommended actions as no funding is involved. Approval of the recommendations will not result in changes to the LA Zoo’s 2016-17 Adopted Budget.

PUBLIC SAFETY COMMITTEE REPORT relative to the proposed adjustments to Police Permit Fees for Fiscal Year 2016-17.

 

Recommendations for Council action:

 

  1. REQUEST the City Attorney to draft the appropriate Ordinances to effectuate the recommended fees contained in the Board of Police Commissioners report, dated April 5, 2016.

  2. INSTRUCT the Los Angeles Police Department (LAPD) to identify additional businesses and activities which generate significant enforcement activities and report on the feasibility of permitting those businesses.

  3. INSTRUCT the LAPD to submit its annual fee study with its Fiscal Year (FY) 2017-18 Proposed Budget for consideration as part of the Annual Budget process.

 

Fiscal Impact Statement: The City Administrative Officer (CAO) reports that the proposed fees in the CAO report dated June 17, 2016 are estimated to generate approximately $15.84 million in revenue in FY 2016-17. In FY 2015-16, the receipts from new and renewal police permits and excessive false alarms totaled $15.37 million. It is anticipated that the LAPD will achieve the budgeted revenue from police permit fees in 2016-17. The recommendations above are in compliance with the City's Financial Policies as the proposed fees are fair and recover the full cost of providing such services.

ADMINISTRATIVE EXEMPTION and INNOVATION, GRANTS, TECHNOLOGY, COMMERCE AND TRADE COMMITTEE REPORT relative to the execution of the fourth amendment with MapLAX, a Joint Venture (MapLAX) to extend the term of performance and increase the contract value to continue project management and planning services in support of the Landside Access Modernization Program at Los Angeles International Airport (LAX).

 

Recommendations for Council action:

 

  1. ADOPT the determination by the Board of Airport Commissioners (Board) that the proposed action is exempt under the California Environmental Quality Act (CEQA) as provided in Article II, Section 2(f) of the Los Angeles City CEQA Guidelines.

  2. APPROVE the fourth amendment to Contract DA-4860 with MapLAX, extending the term for nine months and adding $10,360,000 for increased funds of $39,875,000.

  3. CONCUR with the Board’s action of July 20, 2016 by Resolution No. 256028 authorizing the Chief Executive Officer, Los Angeles World Airports (LAWA), to execute the fourth amendment with MapLAX, extending the term for nine months and adding $10,360,000 for increased funds of $39,875,000 at LAX.

 

Fiscal Impact Statement: The City Administrative Officer reports that approval of the fourth amendment will have no impact on the General Fund. The $10,360,000 allocation needed to finance the proposed term extension will be requested by LAWA from the following LAX Airport Revenue Fund Work Breakdown Structures: 1.15.07-700 - Consolidated Rent-A-Car Center, 1.15.08-700 - Automated People Mover System, 1.15.09-700 - Intermodal Transportation Facility, 1.15.11-700 - Roadway Infrastructure Modifications and Improvements, and other capital projects and their respective Work Breakdown Structures, as needed. While the project costs incurred will be capitalized, when the projects are placed in service those costs will be recovered through terminal rates and charges, landing fees, and revenue from nonairline related facilities (e.g., concessions, parking lot revenue, etc.). This project complies with LAWA’s adopted Financial Policies.
