  2. ADOPT the accompanying BALLOT TITLE RESOLUTION as follows:

    AFFORDABLE HOUSING AND LABOR STANDARDS RELATED TO CITY PLANNING. INITIATIVE ORDINANCE ___.

    Shall an ordinance providing that: 1) certain residential development projects are not eligible for general plan amendments or zoning changes unless the project (a) provides for affordable housing or the developer pays in-lieu fees into the City’s Affordable Housing Trust Fund (AHTF), and (b) complies with labor standards regarding using licensed contractors, paying prevailing wages and hiring workers from local and disadvantaged areas and State-approved apprenticeship programs; 2) nothing in the Municipal Code’s provision regarding general plan amendments shall restrict amendments for above-described projects located in regional centers, downtown centers, industrial zones or near major transit stops; 3) the City shall assess the impacts of community plan changes on affordable housing and local jobs and create and monitor affordable housing inventories within community plan areas; 4) AHTF projects shall comply with the above-described labor standards; and 5) the City shall create an affordable housing incentive program for developments located near major transit stops; be adopted?

  3. PRESENT and ADOPT the accompanying ORDINANCE, SUBJECT TO THE APPROVAL OF THE MAYOR, calling a Special Election to be held on Tuesday, March 7, 2017 for the purpose of submitting to the qualified voters of the City of Los Angeles a certain initiative ordinance and consolidating this Special Election with the City’s Primary Nominating Election to be held on the same date.

Fiscal Impact Statement:  The City Clerk reports that there is no election fiscal impact for adopting Recommendation 1 (adopt ordinance) in this report. There is zero to minimal election cost for adopting Recommendation 2 (March 2017 ballot) in this report, assuming there will be citywide races and a moderate number of Council-sponsored measures on that ballot. If, however, the City Council chooses to place this measure before the voters on a special standalone election, the cost is estimated to be $6,000,000. If Council chooses to place this measure before the voters on the County’s November 2016 Election, the cost is estimated to be $4,100,000 for the first measure, and $400,000 for each additional measure.

ADOPT the accompanying RESOLUTION providing that a ballot measure to amend the Charter of the City of Los Angeles be submitted to the qualified voters of the City AS AMENDED BELOW and REQUEST the City Attorney to submit a revised Ballot Text Resolution for Council consideration on Tuesday, June 21, 2016 that includes:
       
    1. Amend Section 678(a) lines 7 and 8 to read:

      i.     candidates to the Board of Water and Power Commissioners, which shall then provide a list of up to three recommended candidates …
            
    2. Amend Section 678(a) lines 9 and 10 to read:

      i.… shall provide the Mayor with an additional list of up to three candidates, in ranked order …

    3. Amend Section 678(b)(5) to read:

      (5) implement a monthly billing cycle and provide daily water usage data to the Bureau of Sanitation beginning no later than July 1, 2020, unless otherwise prescribed by ordinance.

    4. Add a sentence to Section 674(a)(1)(b) to read:

TRANSPORTATION COMMITTEE REPORT relative to acceptance of a grant award from the California Community  Foundation (CCF) to support equitable and healthy transit-oriented development planning in Los Angeles - Phase II.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. AUTHORIZE the Mayor, or designee, to:

    1. Retroactively accept a grant award in the amount of $50,000 from the CCF Local Sustainability Matching Fund for the performance period of April 1, 2015 through March 31, 2017.

    2. Retroactively approve the executed Grant Award Agreement and submit any other necessary agreements and documents relative to the grant award, subject to the review and approval of the City Attorney as to form and legality.

    3. Prepare Controller instructions and make any necessary technical adjustments consistent with the Mayor and Council action needed on this matter, subject to approval of the City Administrative Officer (CAO), and authorize the Controller to implement these instructions.
                     
  2. AUTHORIZE the Controller, upon receipt of grant funds, to transfer and appropriate $25,000 from the Mayor Fund, Transfers and Grants Revenue Source Code Account No. 4513, to the Salaries As- Needed Account No. 1070.

 

Fiscal Impact Statement:  The CAO reports that there is no additional impact to the General Fund. Approval of the recommendations will result in the acceptance of a $50,000 grant from the CCF Local Sustainability Matching Fund to continue implementation of transit-oriented planning activities.  The remaining balance of salary and related costs are provided in the Mayor’s Adopted Budget.  The above recommendations are in compliance with City Financial Policies in that funding for the proposed activities is available within the identified grant funds.

There is no impact to the General Fund.     2. INSTRUCT the CAO and the CLA to monitor the County and State proposals regarding funding for housing and homeless as well as State measures that could be on the ballot relative to those issues.

INSTRUCT the CAO and the CLA to incorporate the issues and concepts that were discuss during the May 25, 2016 Homelessness and Poverty Committee meeting such as flexibility and leveraging resources to make sure that the City can maximize its ability to meet the needs that have been identified for housing.

      1. Capital to construct or finance housing development and acquire real property.

      2. New acquisition, construction, renovation, or improvements.

        1. Extremely Low Income (0-30 percent of Area Median Income [AMI]).

        2. Very Low Income (31-50 percent of AMI).

        3. Low Income (51-80 percent of AMI).

    3. Provide for a robust Public Oversight Committee of seven members with four appointments by the Mayor and three appointments by the Council.

    4. Establish an Administrative Oversight Committee comprised of the Mayor, CAO, and CLA or their designees.

    5. Require an annual allocation plan to be submitted by the Public Oversight Committee to the Administrative Oversight Committee on April 1st of each year beginning in 2018 and adopted by the City Council and Mayor prior to the beginning of each Fiscal Year.

    6. Bonds to be issued as needed, and expended, based on an allocation process that includes an annual allocation plan to determine funding priorities and awards, as well as an annual audit conducted by the Controller.

    7. Bonds to be administered by the CAO and programs to be administered by the Housing and Community Investment Department, or other department as designated by the Council and Mayor, with oversight by the Citizens Oversight Committee and the Administrative Oversight Committee.

REQUEST the City Attorney, with the assistance of the CLA, the CAO and the Chair of the Rules, Elections, Intergovernmental Relations, and Neighborhoods Committee, to prepare the necessary election ordinance and resolution to place a ballot measure before the voters at the November 8, 2016 general election that would authorize a parcel tax for homelessness services and housing.

    1. 80 million dollars annually based on a per parcel tax with a July 1, 2027 sunset clause.

    2. Eligible uses would include all of the elements listed in the Comprehensive Homeless Strategy and amendments, as well as supportive housing, homeless facilities (e.g. storage, shelters, showers, etc.), affordable housing, accessible housing, veterans housing, and associated infrastructure, such as utilities, sidewalks, and streets, related to properties/projects, which may be carried out in partnership with public, private or non-profit parties, including, but not limited to:

      1. Capital to construct or finance housing development and acquire real property;.

      2. New acquisition, construction, renovation, or improvements.

Fiscal Impact Statement:  The CAO reports that the Department of Airports will bear all costs associated with implementation of MOU 30.  Implementation of the provisions of the MOU would result in no cost increases for Fiscal Year (FY) 2014-15 or FY 2015-16.  Cost increases of approximately $2.4 million will be incurred in FY 2016-17 and an additional $1.2 million in FY 2017-18.  The annual ongoing costs amount to approximately $5.2 million per year over current expenditures.

  3. COMMIT to future year allocations of the City’s apportionment of 9% Low Income Housing Tax Credits to Phases II, III and IV of the Jordan Downs Redevelopment Plan to construct up to 375 units of affordable housing for the City of Los Angeles, with the restriction of funding no more than 125 units with 9% LIHTC in any one fiscal year, subject to a grant award from the HUD's Choice Neighborhoods Implementation program.

  4. INSTRUCT the Los Angeles Housing and Community Investment Department (HCIDLA) to target and reserve $625,000 for unassisted households living within the designated neighborhood boundaries in the redevelopment plan (illustrated in the map attached to Motion) from the following Consolidated Plan programs: $75,000 in services from the Handyworker Program, $300,000 for first-time home-buyer loans, and $250,000 in program income from the Neighborhood Stabilization Program for eligible program activities, subject to a grant award from the HUD's Choice Neighborhoods Implementation program.

  5. REQUEST that the HACLA report to the Council upon notification of the results of the Choice Neighborhood Initiative Implementation Grant.
