Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

  1. HOLD a public hearing as required by Section 147(f) of the Internal Revenue Code of 1986 regarding the issuance of one or more series of revenue bonds in an aggregate principal amount not to exceed $15,000,000 for the purpose of financing the acquisition, rehabilitation, and improvement of a multi-family and senior affordable housing project called Mission Village Apartments located at 4001 North Mission Road in Council District 14.   

  2. ADOPT the accompanying RESOLUTION approving the issuance of multifamily housing revenue bonds by the California Municipal Finance Authority in a principal amount not to exceed $15,000,000 for the purpose of financing or refinancing the acquisition, rehabilitation, improvement and equipping of the Mission Village Apartments.

Recommendations for Council action, as initiated by Resolution (Bonin - Buscaino):

 

  1. RESOLVE, pursuant to Los Angeles Municipal Code (LAMC) Section 80.69.4 and California Vehicle Code Section 22507, to hereby prohibit the parking of vehicles that are in excess of 22 feet in length or over seven feet in height, during the hours of 2:00 AM and 6:00 AM, along the following streets:

    1. Westlawn Avenue from Short Avenue to Louise Avenue

    2. Beethoven Avenue from Short Avenue to Panama Avenue

    3. Culver Drive between Inglewood Boulevard and Mesmer Avenue

    4. Sanford Street from Inglewood Boulevard to the end of the cul-de-sac

    5. 1000 block of Princeton Drive between Carter Avenue and the end of the street

TRANSPORTATION COMMITTEE REPORT relative to comments to be submitted  by the City to the Southern California Association of Governments (SCAG) in regard to the draft 2016 Regional Transportation Plan/Sustainable Communities Strategy (RTP/SCS).

 

Recommendations for Council action:

 

  1. APPROVE the comments detailed in the January 20, 2016 Los Angeles Department of Transportation (LADOT) report, attached to the Council file, as the City of Los Angeles' comments to the SCAG draft 2016 RTP/SCS.
           
  2. DIRECT the LADOT to transmit comments to SCAG that are substantially consistent with those contained in the January 20, 2016 LADOT report, attached to the Council file, including the attached comments from other City Departments.

  3. DIRECT the LADOT to work with SCAG to incorporate the comments into the final RTP/SCS and related Program Environmental Impact Report (PEIR).

 

Fiscal Impact Statement:  The LADOT reports that the January 20, 2016 LADOT report, attached to the Council file, contains comments regarding proposed policies and projects included in the draft 2016 RTP/SCS and related PEIR.  The comments to be transmitted to SCAG will not impact the City's General Fund.

HOMELESSNESS AND POVERTY COMMITTEE REPORT relative to the City's Comprehensive Homelessness Strategy.

 

Recommendations for Council action:

 

  1. ADOPT the 14 Guiding Principles.

  2. ADOPT the Comprehensive Homeless Strategy, as amended.

  3. DIRECT the Homeless Strategy Committee to review and recommend any new best practices or stakeholder input that occurs subsequent to the approval of the Comprehensive Homeless Strategy.

  4. AUTHORIZE the City Administrative Officer (CAO) and Chief Legislative Analyst (CLA) to make technical adjustments to the Comprehensive Homeless Strategy, including changes to the narrative to reflect the adopted changes to the Strategy Briefs.

  5. INSTRUCT the CAO and CLA to publish the final Comprehensive Homeless Strategy upon City Council approval.

  6. INSTRUCT the City Clerk with the assistance of the CLA to consolidate the council files directly associated with the Comprehensive Homeless Strategy, listed in Section 11.9 of the Appendix, including Council File (15-1357).
       
  7. REQUEST funding in Fiscal Year 2015-2016 for immediately implementable projects within the following strategies as detailed in the joint CAO and CLA report dated January 26, 2016 (attached to Council file No. 15-1138-S1):

    • 3A (Standardize First Responder Training For Homeless);

    • 3B (Develop Encampment Engagement Protocol);

    • 3C (Widen Access to First Responder Teams for Homeless);

    • 4A (Strengthen CES Technology, Staffing & Standardization);

    • 6A (Co-Locate Homeless Services Within Homeless Storage Facilities & Create New Facilities);

    • 6C (Establish Citywide Mobile Shower and Public Restroom System);

    • 6E (Evaluate Homeless Navigation Centers);

    • 6F (Expand Access to Public Restrooms);

    • 7A (Shelter System Personnel Need For Bridge Housing Conversion);

    • 7F (Linkage Fee Nexus Study);

    • 7Q (Support House LA Initiative);

    • 7R (Expand Access to Flexible Housing Programs);

    • 10B (Establish the Homeless Services Trust Fund); and

    • In addition, if any of these projects are not ready for citywide implementation, those programs should be pursued as pilot projects in the near term (See 10E - CAO and CLA Report on Desired Strategies). 

  8. REQUEST the Mayor to include funding in the Fiscal Year 2016-2017 Budget, for the following strategies as detailed in the joint CAO and CLA report dated January 26, 2016 (attached to Council file No. 15-1138-S1):

    • 3C (Widen Access to First Responder Teams for Homeless);

    • 3D (Expansion of Jail In-Reach);

    • 4A (Strengthen CES Technology, Staffing & Standardization);

    • 5A (Establish Homelessness Coordinator);

    • 6B (Establish Citywide Safe Parking Program);

    • 6C (Establish Citywide Mobile Shower and Public Restroom System);

    • 6D (Identify Public Land for Homeless Facilities);

    • 7A (Shelter System Personnel Need For Bridge Housing Conversion);

    • 7B (Expand Rapid Re-Housing);

    • 7D (Using Public Land for Affordable and Homeless Housing);

    • 7H (Facilitate Utilization of Federal Housing Subsidies);

    • 9K (Women's Homelessness & Domestic Violence);

    • 10C (Augment Supportive Housing Loan Fund & New Generation Fund); and

    • 10D (New Funding Programs and Guidelines).    

 

Fiscal Impact Statement: The CAO and CLA report that implementation of various components of the Comprehensive Homeless Strategy will have a financial impact. Estimates of these costs will be reported under separate cover.

AMENDING MOTION 6A (RYU - HUIZAR)

 

Recommendation for Council action:

 

AMEND to include the following additional or amended language:

  1. On page 38, 3.7. 311, Information Technology Agency (ITA) add the following sentence at the end of the paragraph on Current Initiatives: 311 operators should be provided the resources and training to refer homelessness calls directly to specific County agencies and service providers. The 311 app should be updated to add a category for encampments and homeless services to the service request options. 311 should be advertised as a one-stop navigator for homeless services calls.

  2. On page 71, Strategy 4C: Coordinated Entry System - Strengthen Data Sharing and Tracking add the following instruction to the end of the Description section: 12. Instruct the ITA to report on resources required and training and system changes needed to enable 311 to respond adequately to calls for homeless services and provide data on homeless services calls to relevant agencies.

 

AMENDING MOTION 6B (O'FARRELL - KORETZ)

 

Recommendation for Council action:

 

AMEND to revise Strategy 7N - Evaluate Youth Housing Needs to instruct the Housing Authority of the City of Los Angeles to report on the feasibility of expanding the Section 8 housing program to allow doubling-up in units for transition aged youth.

 

AMENDING MOTION 6C (HARRIS-DAWSON - HUIZAR - CEDILLO)

 

Recommendations for Council action:

 

AMEND to:

 

  1. Revise Strategy 3A - Standardize First Responder Training for Homeless, to:

    1. Include the Los Angeles Homeless Services Authority (LAHSA) in the list of collaborating departments/agencies.

    2. Incorporate the needs of homeless individuals with HIV/AIDS into first responder training.

  2. Revise Strategy 3E - Integration With County Health Sobering Centers to instruct LAHSA to report relative to the feasibility and the costs of providing short-term residential beds to individuals accessing Sobering Centers.

  3. Revise Strategy 7B - Expand Rapid Rehousing to:

    1. Direct LAHSA to manage a financial assistance program, including move-in and rental assistance.

    2. Include in the first bullet point in the Description section the following bolded language:

      Financial assistance includes short-term and medium-term rental assistance and move-in assistance, including payment for rental application fees, security deposits, and utility deposits as well as furniture, kitchen items, bedsheets, towels and other basic household necessities. Financial assistance can come in the form of a full subsidy, covering the full rent for a period of time, or a shallow subsidy, covering a portion of the rent with gradual decreases in the subsidy over time. LAHSA should be directed to manage this assistance program.

  4. Revise Strategy 7H - Facilitate Utilization of Federal Housing Subsidies to add three additional bullet points in the Description section and add three items to the Performance Metrics, as follows:

    1. Increased landlord incentives through provision of security deposits, other move-in costs that lead to greater rental stability.

    2. Participation by all federal subsidy programs serving the homeless, including but not limited to the following: Housing Choice Vouchers; Shelter Plus Care; and HOPWA rental assistance.

    3. Security Deposit/Move-in Assistance. Develop a program to source security deposit and move-in assistance funds for formerly homeless individuals and families receiving HUD vouchers. Average costs based on other municipalities and homeless housing providers here suggest that costs for security deposit and move-in assistance are around $2,000. This is a significant cost burden for someone coming off the street and can present a hindrance for a landlord housing a formerly homeless individual or family. The City and County in partnership with philanthropic sources could help offset these costs and lower potential barriers for landlords to house the homeless.

    4. Amend the performance metrics to include:

      Landlord retention rates, leasing success rates, and processing times.

  5. Add the following instruction to Section 7: Instruct LAHSA to report on the feasibility of developing a prevention and diversion program under the Coordinated Entry System. The prevention program should include, but not be limited to serving transition age youth and seniors and the diversion program should include, but not be limited to serving single adults. In addition, the report should include the feasibility of identifying funding for the prevention and diversion pilot program in the Family system.

  6. Revise Strategy 9F - Expand Youth Homeless Services to instruct LAHSA to: partner with local community colleges to help identify transition age youth homeless students and housing solutions for those youth; and identify additional emergency shelter, crisis and bridge housing resources and supportive services targeting the unique needs of the transition age youth homeless population.

AMEND to revise Strategy 4A - Strengthen CES Technology, Staffing and Standardization to add the following to the last bullet in the description section relative to the Los Angeles Homeless Services Authority report incorporating domestic violence services: Relative to Element 1, listed above, enlist local domestic violence experts to provide training to CES staff utilizing the State mandated 40-hour domestic violence curriculum, per Evidence Code 1037-1037.8, and following updated guidance from the Department of Housing and Urban Development.

  1. Add to Strategy 3A - No Wrong Door/Standardize First Responder Training for Homeless the following underlined language:

    1. . . . such as experience with trauma including domestic violence.

  2. Revise Strategy 3B Develop Encampment Engagement Protocol to replace homeless-victims-who have been victims of domestic violence  with . . .homeless individuals who have been victims of trauma, including domestic violence.

  3. Revise Strategy 9K - Women’s Homelessness and Domestic Violence as follows:

    1. Delete the instruction relative to employment development for homeless women and incorporate that instruction into a new Strategy 9L - Women’s Homelessness - Employment Development which is adopted hereby.

    2. Revise the Performance Metrics as set forth below:

AMENDING MOTION 6G (WESSON - HUIZAR - HARRIS-DAWSON) 

 

Recommendation for Council action:

 

AMEND to adopt the following additional recommendation:

 

  1. As part of Strategy 3C (Widen Access to First Responder Teams For Homeless) instruct the City Administrative Officer (CAO), with assistance from the Bureau of Sanitation and the Los Angeles Police Department (LAPD), to report back in 60 days with a financial analysis to determine the potential cost of expanding the Project HOPE pilot program into LAPD divisions throughout the City of Los Angeles.

  2. As relevant to Strategy 3B (Develop Encampment Engagement Protocol) instruct the Bureau of Sanitation, with assistance from the CAO and LAPD, to report back with a budget estimate and other options to deploy sanitation teams to the Project HOPE effort and similar LAPD initiatives that do not count against a Council offices monthly service day allocation.

  3. Instruct the Bureau of Sanitation to request those funds in the Mayor's upcoming budget proposal for Fiscal Year 2016-17, consistent with the Homelessness and Poverty committee report funding requests.

 

AMENDING MOTION 6H (MARTINEZ - WESSON)

 

Recommendation for Council action:

 

AMEND to:

 

  1. Add to Strategy 6A - Co-Locate Homeless Services Within Homeless Storage Facilities and Create New Facilities, an instruction to LAHSA and the Municipal Facilities Committee to report to the Council’s Entertainment and Facilities Committee with proposed facility location information, as well as an update on the availability of CES Leads for these proposed locations, prior to implementation.

  2. Add to Strategy 6B - Establish Citywide Safe Parking Program, an instruction to the Homeless Strategy Committee to report to the Entertainment and Facilities Committee with the proposed Safe Parking program, including information on how the program will require locations in all 15 Council Districts or an opt-in program, with implementation of a Safe Parking program being subject to future approval of the program by the Council.

  3. Add to Strategy 6C - Establish Citywide Mobile Shower and Public Restroom System, an instruction to LAHSA to report to Council on a Citywide Mobile Shower and Public Restroom System, including recommended locations and schedules, as well as recommendations to ensure locations in all 15 Council Districts or an opt-in program, for Council approval prior to implementation.

  4. Add to Strategy 6D - Identify Public Land for Homeless Facilities, an instruction to the City Clerk to refer the CAO report on this matter to the Council’s Entertainment and Facilities Committee for consideration when the directed report is transmitted.

 

AMENDING MOTION 6I (MARTINEZ - BUSCAINO)

 

Recommendation for Council action:

 

AMEND to:

 

  1. Add to Strategy 4A - Strengthen CES Technology, Staffing and Standardization an instruction to LAHSA to include in their quarterly reports information on the number of outreach attempts made per individual and how many were ultimately successful. LAHSA should also report on how they keep records of individuals who refuse services in order to keep population and location information current.

  2. Add to Strategy 4B - Strengthen Departmental Support for Homeless Case Managers an instruction to listed City departments to report to Council on how they will support this recommendation while ensuring that there is no reduction or negative impact in the core service provision to the originally intended clients of the facilities (e.g. children, youth or seniors at a park or library).

  3. Add to Strategy 4D - Discharge Data Tracking System and Planning Guidelines the following instructions to LAHSA:

    1. Report on how they will ensure that the development and implementation of discharge plans will prevent the funneling of individuals into targeted geographies.

    2. Report on funding available to assist individuals who desire to return to their home City or State, and include that voluntary component as an element of discharge planning guidelines.

 

AMENDING MOTION 6J (MARTINEZ - BUSCAINO)

 

Recommendation for Council action:

 

AMEND to:

 

  1. Add to Strategy 7N - Evaluate Youth Housing Needs an instruction to LAHSA to provide information on the locations and inventory of group homes, community care facilities, and other housing, (whether licensed by the State, County, or via de facto arrangements) that serve Transitional Age Youth.

  2. Add to Strategy 10E - CAO and CLA Report on Desired Strategies an instruction to the CAO and CLA to include in any report the financial and service delivery impact of financing the various components of the homeless strategy on the provision of core city services across the City.

Recommendation for Council action:

 

REQUEST the Mayor to include funding in the Fiscal Year 2016-17 Budget, for the clean up of homeless encampments citywide in accordance with Strategy 3B as detailed in the joint CAO and CLA report dated January 26, 2016 (attached to Council file No. 15-1138-S1).

 

AMENDING MOTION 6L (MARTINEZ - O'FARRELL)

 

Recommendation for Council action:

 

AMEND to:

 

  1. Add to Strategy 3B - Develop Encampment Engagement Protocol, a provision that all homeless encampments are cleaned with the requirement of a 24-hour notice instead of the 72-hour notice currently being provided.

  2. Add to Strategy 3C - Widen Access to First Responder Teams for Homeless, an instruction to LAPD and LAFD to report to Council with additional information and a proposed framework for the incorporation of Sobering Units into its homelessness strategy. Upon this information and proposal, Los Angeles Police Department and Los Angeles Fire Department should also secure Council approval at a future date in order to implement a Sobering Units component to the City’s efforts.

  3. Add to Strategy 3D - Expansion of Jail In-Reach, an instruction to LAPD to explore the feasibility of developing a protocol that not only ensures in-reach services are effective, but that seeks to ensure that no homeless individual walk out of any City jail without a safe place to stay. Upon release, LAPD or LAHSA should take or transport homeless individuals to an appropriate service provider.

  4. Add to Strategy 3E - Integration with County Health Sobering Centers, an instruction to LAFD and LAPD to report to Council on the proposed locations and distribution of Sobering Units within the City limits prior to securing Council approval for the utilization of the County’s proposed Sobering Centers.

HOMELESSNESS AND POVERTY COMMITTEE REPORT relative to the City's Comprehensive Homelessness Strategy.

 

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. AUTHORIZE the Controller to transfer $2.1 million from the Unappropriated Balance Serving and Housing LA's Homeless account to a new account to be established in the General City Purposes Fund, entitled El Nino Response to fund El Nino related services for the homeless inclusive of storage.

  2. AUTHORIZE the Controller to expend, encumber, and/or transfer these funds, at the direction of the City Administrative Officer (CAO), Chief Legislative Analyst (CLA), and the Mayor, without further approval from the Mayor and Council so that these funds may be directed and expended as expeditiously as possible.

 

Fiscal Impact Statement: The CAO and CLA report that that there is no fiscal impact related to the recommendation in this report. Existing funds have been set aside in the Unappropriated Balance that will be used to support the El Nino related activities. The fiscal impact associated with pursuing strategies presented in the Comprehensive Homeless Strategy report, attached to the Council file, will be identified in a future report back to the Council and Mayor.

    2. In conjunction with the Chief Legislative Analyst (CLA) and any other appropriate city departments, to identify options for preserving unapproved second housing units, including measures used by other jurisdictions to preserve unapproved units.

  2. REQUEST the City Attorney, in conjunction with the Departments of City Planning and Building and Safety, to prepare and present an ordinance that prescribes a permit process to allow the development of accessory dwelling units in accordance with Assembly Bill 1866.
