Recommendations for Council action:

 

  1. REQUEST the City Attorney, with the assistance of the Los Angeles Housing and Community Investment Department (HCIDLA), to prepare and present an ordinance to amend the Rent Stabilization Ordinance (RSO) to incorporate the following:

    1. Allow for a 50 percent pass-through of seismic retrofits costs amortized over 120 months with no phase in.

    2. Cap the total pass-through at $38 per month.

    3. Stipulate that the pass-through cost to be a temporary rent adjustment.

    4. Allow the pass-through of an imputed interest expense.

    5. Language requesting the Rent Adjustment Commission (RAC) to adopt rules and/or amend existing RAC regulations to effectuate the RSO changes adopted by Council.

    6. Additional language to require landlords to adjust the pass-through if new funding becomes available.

  2. REQUEST the City Attorney, with the assistance of the Department of Building and Safety, to prepare and present an ordinance to:

    1. Amend Division 93 of Article 1 of Chapter IX of the Los Angeles Municipal Code to modify deadlines for compliance with seismic retrofit mandates for soft-story buildings to require property owners to acquire the necessary permit(s) within one and one-half years after the program's initial two-year period; and, that all retrofit construction must be complete within three and one-half years after permits have been issued by the Department of Building and Safety.

    2. Clarify the Ordinance's engineering analysis terms and specifications.

    3. Reduce the amount of required parking spaces if parking spaces are displaced as a result of compliance with the mandatory seismic retrofit provisions of Divisions 93 and 95 of Article 1 of Chapter IX of the Los Angeles Municipal Code.

  3. INSTRUCT the HCIDLA to report relative to:

    1. Funding recommendations for resources, including systems development and staffing, necessary to implement the seismic retrofit program.

    2. A new application that streamlines the pass-through process.

    3. An option that allows the pass-through application to commence at the moment permits are pulled from the Department of Building and Safety.

  4. INSTRUCT the City Administrative Officer (CAO), with assistance from the Mayor and City Attorney, to report relative to pursuing a partnership with the California Residential Mitigation Program, or other appropriate State agencies, to create or expand grant fund opportunities available to property owners in the City who are required to seismically retrofit their properties.

  5. INSTRUCT the CAO and Chief Legislative Analyst to report, in conjunction with recommendations made relative to the Program Year 42 Con Plan on the use of Community Development Block Grant funds to support the seismic retrofit program.

  6. INSTRUCT the CAO, with assistance from the Mayor, City Attorney, Department of Building and Safety, and HCIDLA to report relative to hosting a workshop with banks and lenders to encourage low-interest loans to property owners whose properties are subject to the Mandatory Seismic Retrofit Ordinance.

Fiscal Impact Statement: The HCIDLA reports that the proposed RSO changes will not impact the General Fund.  The CAO reports that the financial impact of any program financing option to be considered by the Mayor and Council will be addressed in future reports, if necessary.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

  1. APPROVE and AUTHORIZE the City Attorney, or designee, to execute Contract Amendment No, 1 of the City Administrative Officer’s (CAO) transmittal dated November 17, 2015, attached to the Council file, between the County of Los Angeles and the City of Los Angeles in the amount of $137,810 for the period of July 1, 2015 to June 30, 2016, subject to the approval of the City Attorney as to form and legality.

  2. AUTHORIZE the City Attorney, or designee, to accept grant funding in the amount of $137,810 from the Los Angeles County Department of Community and Senior Services.

  3. APPROVE the City cash and in-kind match in the amount of $65,424 for the period of July 1, 2015 to June 30, 2016.

  4. AUTHORIZE the Controller to:

    1. Establish a receivable within Fund 368 in the amount of $137,810 from the County of Los Angeles.

    2. Establish a new appropriation account within Fund 368 as follows:

      Account 12M702- FY 15-16 DRPA VO Grant - $137,810

  5. TRANSFER $96,693 from Fund 368, Account 12M702 to Fund 100/12, Account 001010 Salaries General.

  6. TRANSFER up to $35,496 from Fund 368, Account 12M702 to Fund 100/12, RSRC 5301 - Reimbursement from Other Funds/Departments upon receipt of reimbursement.

  7. AUTHORIZE the City Attorney to prepare Controller instructions for any necessary technical adjustments subject to the approval of the CAO; and, AUTHORIZE the Controller to implement the instructions.

 

Fiscal Impact Statement: The CAO reports that the total cost of the 2015-16 NJP is $203,234, of which $137,810 will be reimbursed by the County of Los Angeles. The General Fund impact will be $43,483 comprised of $18,304 in central services and $25,179 in department administration. The City will provide $21,941 in volunteer hours. No additional appropriation is needed. The recommendations in this report are in compliance with the City’s Financial Policies in that budgeted appropriations will be balanced against receipts expected from the continuation of this grant.

Recommendations for Council action:

 

  1. INSTRUCT the Department of Recreation and Parks, Los Angeles Department of Water and Power, Los Angeles Department of Transportation (LADOT), the Public Works Department, and the Emergency Management Department, with assistance from the City Attorney, to grant access and Right of Entry, as well as the authorization to complete documentation and/or execute agreements, with the USACE to perform interim temporary protective measures such as vegetation removal, installation and maintenance of barrier baskets, and staging related equipment to bolster the flood protection of the Los Angeles River.

  2. DESIGNATE the Emergency Management Department as the City's administrative and coordination agent with the USACE.

  3. PROVIDE the LADOT and Public Works Department with assistance in identifying and monitoring bicycle paths and lanes for as needed closures to maximize public safety during the deployment of the proposed protective measures.

  4. REQUEST the USACE to document and submit, with written records and photographs, current site and facility conditions and to restore and repair all utilized City areas to prior condition, or better, at the close of this authorization.

  5. REQUEST the USACE to provide a regular report on the protective measures, their performance and maintenance, and an after-action report on the habitat and environmental value of the river.

CONTINUED CONSIDERATION OF PROTESTS, CATEGORICAL EXEMPTION and PUBLIC WORKS AND GANG REDUCTION COMMITTEE REPORT relative to vacation proceedings for the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue (VAC - E1401249).

 

Recommendations for Council action:

 

  1. CONSIDER protests relative to the proposed vacation of the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue.

  2. FIND that the vacation of the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines.

  3. FIND that the street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of way indicated below and shown colored blue on Exhibit B of the August 14, 2015 City Engineer report:

    The north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue.

  4. FIND that the vacation of the area shown colored orange on Exhibit B of the August 14, 2015 City Engineer report be denied.

  5. FIND that there is a public benefit to the vacation of the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue. Upon vacation of the alley, the City is relieved of its ongoing obligation to maintain the right-of-way. In addition, the City is relieved of any potential liability that might result from continued ownership of the involved street easement.

  6. FIND that the vacation of the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue is in substantial conformance with the purposes, intent and provisions of the General Plan, in conformance with Section 556 of the City Charter.

  7. FIND that the vacation of the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue is not necessary for non-motorized transportation facilities, in conformance with Section 892 of the California Streets and Highways Code.

  8. FIND that the vacation of the north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue is not necessary for present or prospective public use, in conformance with Section 8324 of the California Streets and Highways Code.

  9. ADOPT the City Engineer's report dated August 14, 2015 with the conditions contained therein.

Fiscal Impact Statement:  The City Engineer reports that the petitioner has paid a fee of $14,980.00 for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC). Any deficit fee to recover the cost pursuant to LAAC Section 7.44 will be required of the petitioner.  Maintenance of the public easement by City forces will be eliminated.

AMENDING MOTION (O'FARRELL - BUSCAINO)

 

Recommendations for Council actions:

 

ADOPT the following changes (indicated in underlining for additions and *** for deletions) to the recommendations and conditions contained in the City Engineer's report dated August 14, 2015:

 

A. That street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of-way indicated below and shown colored blue and orange on the attached Exhibit B, and that the limits of the vacation area be permitted to be adjusted based on the final design of the adjoining alley improvements:

 

The north/south alley westerly of Cahuenga Boulevard between Selma Avenue and the east/west alley northerly of Selma Avenue.

 

 B. That the vacation of the area shown colored orange on Exhibit B, be denied.***

 

CONDITIONS:

 

6. That the following dedications be provided adjoining the petitioner's property in a manner satisfactory to the City Engineer***

 

a)  Dedicate or retain from the vacation sufficient area as public right of way to provide for a turning area at the westerly terminus of the remaining cast/west alley northerly of Selma Avenue.***

 

b)  Dedicate a partial future alley turnaround area, based on a 20-foot radius property line return on the northeasterly corner of Lot 14, Sackett Tract, adjoining the retained vacation area.***

 

7. That the following improvements be constructed adjoining the petitioner's property in a manner satisfactory to the City Engineer:

 

a)  Construct a modified turning area at the westerly terminus of the remaining east/west alley northerly of Selma Avenue.***

 

b)  Repair and/or replace all broken, off-grade or missing concrete pavement along the remaining alley northerly of Selma Avenue.

 

c)  Repair and/or replace all broken, off-grade, or missing sidewalk, curb and gutter along Selma Avenue.

 

d)  Close the alley intersection at Selma Avenue with standard curb, gutter and sidewalk or construct standard driveway apron.

 

e)  That all drainage matters be addressed to the satisfaction of the City Engineer, including that any necessary provisions be made to collect or divert any surface flows from impounding within the area to be vacated, unless drainage easements are to be reserved from the vacation

 

12.  That a Covenant and Agreement be recorded satisfactory to the City Engineer preserving an area for vehicular turnaround purposes on the northern 30 linear feet of the area to be vacated shown colored orange on the attached Exhibit B.

 

13.  That a Covenant and Agreement be recorded satisfactory to the City Engineer providing that no structure shall be erected on the vacation area, and that it shall be used and maintained as a pedestrian plaza.
