CONSIDERATION OF RESOLUTION (KREKORIAN - MARTINEZ) relative to an Agreement for State Collection and Administration of Local Charges for prepaid mobile telephony services.

 

Recommendation for Council action, SUBJECT TO THE CONCURRENCE OF THE MAYOR:

 

RESOLVE to:

  1. Approve the local jurisdiction Agreement for State Collection and Administration of Local Charges, attached to the Council file; and, authorize the Director, Office of Finance (Finance), or designee, to execute the agreement.

  2. Appoint the Director, Finance, or designee as designated in writing by the Director, Finance, to the California State Board of Equalization (Board), to represent the City of Los Angeles with authority to examine prepaid mobile telephony services surcharge and local charge records of the Board pertaining to prepaid mobile telephony services surcharge and local charges collected for the Local Jurisdiction by the Board pursuant to the contract between the Local jurisdiction and the Board. The information obtained by examination of Board records shall be used only for purposes related to the collection of the Local Jurisdiction's prepaid mobile telephony services surcharge and local charges by the Board pursuant to the contract.

  3. Appoint the Director, Finance, or designee designated in writing by the Director, Finance, to the Board to represent the Local Jurisdiction with authority to examine those prepaid mobile telephony services surcharge and local charge records of the Board for other governmental functions or purposes related to tax administration and revenue collection.

  4. Ensure that the information obtained by examination of the Board records shall only be used for purposes related to the collection of the City of Los Angeles' prepaid mobile telephony services surcharge and local charges by the Board pursuant to the contract between the City of Los Angeles and the Board, or for purposes related to other governmental functions of the City of Los Angeles, as identified above.

CONSIDERATION OF RESOLUTION (BUSCAINO - BLUMENFIELD - WESSON - MARTINEZ) relative to resolution of labor issues at the Port of Los Angeles.

 

Recommendations for Council action:

 

  1. RESOLVE to reiterate support for all of the workers at the Port of Los Angeles, and call on all companies who conduct business at the Port of Los Angeles to comply with federal and state employment and labor laws and provide them with the same wage and benefits protection afforded to all employees in our City.

  2. RESOLVE to encourage all vested parties to resolve any labor issues proactively to avoid any work stoppages at the Port of Los Angeles.

COMMUNICATION FROM THE CHIEF LEGISLATIVE ANALYST (CLA) and RESOLUTION relative to the City of Los Angeles comments on the Draft 2015-16 Affordable Housing and Sustainable Communities (AHSC) Program funding guidelines.

 

Recommendations for Council action:

 

  1. ADOPT the accompanying RESOLUTION to support the Los Angeles Housing and Community Investment Department's (HCIDLA) comments on the draft 2015-16 AHSC Program guidelines.

  2. AUTHORIZE the HCIDLA to compile and submit comments included as Attachment C of the CLA report to Council dated October 23, 2015, with a joint City letter executed by the Mayor, Council President, and Chair of the Housing Committee, to the Strategic Growth Council by the October 30, 2015 deadline.

  3. DIRECT the HCIDLA, with the assistance of the CLA, to monitor any new proposed changes to the draft 2015-16 AHSC Program guidelines and report, as necessary, on additional comments for Council approval.

Fiscal Impact Statement: The CLA reports that this action will not impact the General Fund.

City of Los Angeles, Los Angeles Superior Court (LASC) Case No. BC565618; Hayley Fontaine, v. City of Los Angeles, et al., LASC Case No. BC571644; Yaar Kimhi, Tahl Beckerman Megerdichian and Yelena Novak v. The City of Los Angeles, LASC Case No. BC536272; Daniel Morski v. Los Angeles Department of Water and Power, LASC Case No. BC56872; Antwon Jones v. City of Los Angeles, LASC Case No. BC577267; Macias, et al. v. Los Angeles Department of Water and Power, LASC Case No. BC594049; and, City of Los Angeles v. Pricewaterhouse Coopers LLP (PwC), LASC Case No. BC574690. (These matters involve customer claims related to billing errors and overcharges that occurred following implementation of the Los Angeles Department of Water and Power's (DWP) new customer information and billing system; and, the City's claims of breach of contract, fraud and misrepresentation in defendant's actions in implementing DWP's new customer information and billing system.)
